2. ADDENDUM TO FAR 52.212-1, INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (OCT 2015) Paragraph (b) entitled “Submission of Offers” is deleted in its entirety and replaced with “Proposal Preparation Instructions”, below.

Paragraph (c) entitled “Period for acceptance of offers”, is tailored to read: “The offeror agrees to hold the prices in its offer firm for 100 calendar days from the date specified for receipt of offers.”

Paragraph (e) entitled “Multiple Offers” is tailored to read: “The government will not consider multiple offers presenting alternate terms and conditions for satisfying the requirements of this solicitation.”

Paragraph (g) entitled “Contract award (not applicable to Invitation for Bids).” Is tailored to read: “The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government may reject any or all offers if such action is in the public interest;

accept other than the lowest offer; and waive informalities and minor irregularities in offers received.”

Paragraph (h) entitled “Multiple awards” is tailored to read: “The Government intends to award one contract as a result of this solicitation. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.”

Formal communications, such as requests for clarification, questions and/or written information concerning this solicitation should be submitted in writing to:

Attn: Tim Gould US Army Corps of Engineers St. Louis District/CEMVS-CT 1222 Spruce Street St. Louis, Mo 63103 Office: (314) 331-8506 Fax: (314) 331-8746

Email: timothy.a.gould@usace.army.mil

The request should be in the following format:

Reference: Section ___, Page_____, Paragraph____ Question:______________________________________.

Written questions will be answered in writing and provided to all offerors via a posting to FedBizOps. However, due to the time required to research a question and provide an answer, questions received less than 7 calendar days prior to the due date of offers specified in this solicitation may not be answered.

3. PROPOSAL PREPARATION INSTRUCTIONS

a. General Information

(1) To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein.

Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. The response shall consist of three (3) parts, Part I – Price Proposal and Contract Documentation, Part II

– Technical Capability, and Part III - Past Performance Information, and Part IV Small Business Subcontracting Plan.

(2) The Contracting Officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the Contracting Officer’s opinion, adequate price competition exists no additional cost information will be requested and certification under FAR 15.406-2 will not be required. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists offerors may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness of the price.

(3) Documents submitted in response to this RFP must be fully responsive to and consistent with the following:

(i) Requirements of the RFP (Contract Line Items (CLINs) & Performance Work Statement (PWS)), and government standards and regulations pertaining to the PWS.

(ii) Evaluation Factors for Award (See paragraph 4 below).

(4) Proposal format:

i) Proposals shall be 8 1/2” x 11” paper except for fold-outs used for charts, tables, or diagrams which may not exceed 11” x 17”.

ii) A page is defined as one face of a sheet of paper containing information.

iv) Typing shall not be less than size 12 font except for figures and diagrams, where smaller font is acceptable as long as it is readable.

(v) Offerors shall submit their proposals in the following numbers and arrangement:

(1) One three-ring loose-leaf binder which contains the originals of Part I, Part II, and Part III, and

Part IV with each part clearly tabbed, and

(2) Three separate loose-leaf binders each of which shall contain a copy of Part II and Part III, with each part clearly tabbed.

vi) Elaborate formats, bindings or color presentations are not desired or required. vii) Electronic proposals

(including fax copies) WILL NOT be accepted.

b. Specific Instructions:

(1) PART I – PRICE PROPOSAL AND CONTRACT DOCUMENTATION

(a) This part shall consist of a cover page which contains the name, title, telephone number, and email address of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

(b) Complete blocks 12, 17a and 30a, b and c of the SF 1449. In addition include signed amendments to the RFP, if applicable. In doing so, the offeror accedes to the contract terms and conditions as written in the RFP.

(c) Insert proposed unit and extended prices on Attachment 1 – Price Schedule.

(d) Complete the necessary fill-ins and certifications. These provisions shall be returned along with the proposal. System for Award Management (SAM) applies to this procurement. Contractors must be registered prior to award; lack of registration in SAM will make an offeror ineligible for award. Information on SAM registration may be obtained at http://www.sam.gov

(2) PART II – TECHNICAL CAPABILITY Limited to no more than 5 pages.

TECHNICAL PROPOSAL – The offeror shall submit a technical proposal that demonstrates your ability to provide the necessary tools, labor, materials, equipment, supplies, and transportation necessary to provide the full range of services required in accomplishing PWS paragraph 1.1 and its subsequent sub-paragraphs within the required period of performance (i.e. submit a capability statement, Illinois Elevator Licenses, and any other credentials). The technical proposal shall be clear, concise and include sufficient detail which explains company procedures for callbacks and emergencies, preventative maintenance schedule and how to manage unplanned service outages; not simply can or will comply with PWS or simply paraphrasing the PWS or parts thereof. It also should demonstrate your relevant work experience for projects of similar type, size, and complexity as the work described in the Performance Work Statement.

(3) PART III – PAST PERFORMANCE INFORMATION

(a) Past Performance Surveys: The government will evaluate the quality and extent of offeror’s performance deemed relevant to the requirements of this RFP. The government will use information submitted by sources, such as other Federal Government offices and commercial sources, to assess performance. The offeror shall provide a list of up to four (4) relevant contracts, Points of Contact (POCs) and a brief description on why they find the reference relevant. It is the offerors responsibility to verify POC information to ensure phone numbers and email addresses provided are current.

The evaluation of past performance information will take into account past performance information regarding subcontractors that will perform major or critical aspects of the requirement when such information is relevant to the acquisition.

1) If a joint venture is contemplated, provide complete information as to the arrangement, including specific details on which requirements of the Performance Work Statement each party will be performing.

2) If a subcontractor will perform major or critical aspects of the requirement, provide complete information as to the arrangement, including specific details on which requirements of the Performance

Work Statement the subcontractor will be performing.

(c) Subcontractor Consent: Past performance information pertaining to a subcontractor cannot be disclosed to the prime offeror without the subcontractor’s consent. Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.

ADDENDUM TO FAR 52.212-2

FAR 52.212-2 is amended in its entirety as follows:

(A) Basis for contact award. This is a competitive best value source selection and the Government intends to award a single contract resulting from this solicitation. The Government will conduct a low price technically acceptable (LPTA) source selection and intends to award a contract without conducting discussions. However, the Government reserves the right to conduct discussions if it is determined to be in its best interest. The Government will utilize a LPTA source selection process as described below to identify the offeror who represents the best value to the Government. The following factors, in the order of importance shown below, shall be used to evaluate proposals:

(1) Price

(2) Technical Capability

(3) Past Performance

(4) Small Business Subcontracting Plan (applies to other than Small Business)

(B) Evaluation Process

(1) After receipt of proposals, the Government will calculate the Total Proposed Price (TPP), to include any option prices if applicable, of all offerors as described below and rank them in ascending order. The Technical Capability evaluation will begin with the proposal calculated to have the lowest TPP.

(2) If the lowest priced offeror has an Acceptable Technical Capability, the Government will then evaluate the offerors Past Performance and Small Business Subcontracting Plan (if applicable). If the offeror has an Acceptable rating in all evaluation factors, and that offeror’s pricing is determined fair and reasonable, that offer represents the best value for the Government and the evaluation process stops at this point. Award will be made to that offeror without further consideration of any other offers.

(3) If the lowest priced offer is rated unacceptable, the next lowest priced offer will be evaluated for Technical Capability, Past Performance and Small Business Subcontracting Plan (if applicable). If rated Acceptable, award will be made to that offeror without further consideration of any other offers. This process will continue until an offeror is determined to be Acceptable in all factors.

(C) Evaluation Factors

(1) Each offeror’s’ proposal will be evaluated against the following criteria: Price, Technical Capability, Past Performance and Small Business Subcontracting Plan (if applicable).

(a) Factor 1 – Price: Price will be considered in determining the best value offeror. FAR 52.217-8, Option to Extend Services Clause, is included in this RFP. The Government will calculate the offeror’s TPP by adding the total price of the base requirement, all ordering periods, and the total price for the 6-month extension of services. Pricing for the 6-month extension of services period will be based on the unit prices proposed in the offeror’s final ordering period. Evaluation of options will not obligate the Government to exercise the option(s).

Prior to award, the Government will complete a price analysis to determine if the TPP is fair and reasonable using techniques at FAR 15.404-1(b)(2).

(b) Factor 2 – Technical Capability: Technical Capability will be evaluated on an Acceptable or Unacceptable basis.

Proposals receiving final rating of Unacceptable will not be considered for award.

Technical Ratings Description

Acceptable Proposal clearly meets the Government’s minimum requirements of the solicitation Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation

To be rated Acceptable:

(i) The offeror’s proposal effectively demonstrates it meets the requirement for elevator repair and maintenance (proper certification, i.e. current Illinois Elevator Repair Contractor license(s), preventative maintenance plan/schedule, etc).

(ii) The offeror’s proposal provides details and timelines for response to non-standard service calls (i.e. 24/7 call response and availability).

(c) Factor 3 – Past Performance. The Government will begin the Past Performance evaluation by determining the recency and relevancy of each offeror’s submitted Past Performance examples, per the RFP. Recency is defined as any work performed within the past three years from the date of issuance of the solicitation. Only those references that are determined to be recent and relevant will be evaluated.

(i) The Government will assign an overall Past Performance Information rating of Acceptable or Unacceptable to each offeror based upon the past performance information obtained by the Government through the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), electronic Subcontract Reporting System (eSRS), other databases, interviews with Program Managers, Contracting Officer, references submitted, or any other source available to the Government.

Rating Description

Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record or relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)).

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.

(d) Factor 4 – Small Business Subcontracting Plan.
