SECTION 00700 - CONTRACT CLAUSES
The following have been deleted:
252.219-7011 Notification to Delay Performance JUN 1998
(End of Summary of Changes)
The following items are applicable to this modification:
RESPONSE TO QUESTIONS
Contractor Questions and Government Responses
1) Spec section 075200.0028.1.10.1 states that the installer must warrant the roof for a period of 20 years independent of the membrane manufacturer’s warranty. This is not a typical request. Industry standard is typically a 2-year installer’s warranty. Please confirm that a
2-year installer warranty is acceptable.
Response: Confirmed. Specifications 07 52 00 has been revised as part of this amendment to reduce the Installer Warranty to 2 years.
2) Spec section 075600.1028.1.8.2.2 states that the installer must warrant the PMMA flashings a period of 20 years independent of the membrane manufacturer’s warranty.
This is not a typical request. Industry standard is typically a 2-year installer’s warranty.
Please confirm that a 2-year installer warranty is acceptable.
Response: Confirmed. Specifications 07 56 00 has been revised as part of this amendment to reduce the Installer Warranty to 2 years.
3) Detail F1/S-501 states “CONCRETE REINFORCEMENT TO BE DETERMINED BY THE
CONTRACTOR’S PE.” Will the Contractor be required to provide professional structural engineering services to perform calculations for any new precast concrete planks?
Response: Precast shall be designed, signed and sealed as outlined in SECTION 03 41
16.08 28, paragraph 2.2.1 Precast Concrete Roof Infill.
4) Detail F1/S-501 states “CONCRETE REINFORCEMENT TO BE DETERMINED BY THE
CONTRACTOR’S PE.” If the Contractor is required to determine this reinforcing, will the
Contractor be required to submit professional structural engineer signed and sealed calculations and/or drawings to the Government for review?
Response: A registered professional civil or structural engineer is required to do the concrete design in accordance with SECTION 03 41 16.08 28, Par. 2.2.1.
5) Detail F11/S-501 states “THE ADEQUACY OF THE (8) (E) CHANNEL
CONNECTIONS TO THE (E) WFs ARE NOT ABLE TO BE EVALUATED PRIOR TO
THE EXHAUSTSTACK REMOVAL.” Is the Contractor required to have these connections evaluated by a professional structural engineer or will the Government designer of record evaluate these connections?
Response: No, the contractor does not need to have a licensed engineer evaluate these connections. Per spec section 05 05 13.00 28, paragraph 2.2.1.1, the government will provide a visual inspection of these connections and confirm their adequacy.
6) Detail F11/S-501 states “THE ADEQUACY OF THE (8) (E) CHANNEL
CONNECTIONS TO THE (E) WFs ARE NOT ABLE TO BE EVALUATED PRIOR TO
THE EXHAUST STACK REMOVAL.” These connections are not readily visible due to existing ceilings, insulation, shaft walls, ductwork, and various MEP. If the Contractor is required to evaluate these existing connections will the Government temporarily remove the existing ceilings, insulation, ductwork, and various MEP that currently prevents visual observation or is the Contractor responsible for this?
Response: The Contractor will be responsible for removing ceiling tiles, insulation and ductwork. If ductwork needs to be moved, the Contractor will need to coordinate with the
COR. Work requiring access to the interior of the building shall be arranged to take place outside of regular work hours. See spec SECTION 01100 - GENERAL PROVISIONS, page 9, 21. OCCUPIED BUILDING WORK RESTRICTIONS.
7) Detail K9/A-401 note states “METAL WALL PANEL, INSULATION AND INFILL
STUDSMATCH EXISTING”. Will the Government indicate what the existing metal wall panel, insulation, and infill studs are so that we can price appropriately?
Response: Per spec Section 07 42 13.00 28, the characteristics of the existing metal wall = panels is described under Part 2.1(1). See resource drawing sheet R-022 for additional existing steel stud and wall insulation information.
8) Please confirm that all existing interior roof drain lines are to remain.
Response: Confirmed.
9) Please confirm that the only new interior roof drain lines to be installed by the Contractor are those indicated on sheet M-401.
Response: Confirmed.
10) Detail H13/A-502 indicates that the new PV Rack stanchion anchors are to be “per PV
Rack and stanchion manufacturer to meet wind criteria see specification.” Specification
05 50 13.00 para 1.6.1 indicates the Contractor must procure the services of a PV array rack designer and manufacturer for the design of the system, and the calculations and design drawings must be signed and sealed by the registered professional engineer. Please confirm the Contractor must procure these services and submit professional engineer signed and sealed calculations from qualified PV in accordance with specifications.
Response: PV rack shall be designed, signed and sealed as outlined in SECTION 05 50
13.00 28 paragraph 1.6.1 Photovoltaic (PV) Solar Array Rack System Design.
11) Is there an existing lighting protection system? The drawings and specifications do not indicate.
Response: No.
12) If there is an existing lighting protection system, will the Contractor be allowed to re-use existing downleads?
Response: There is not an existing lightning protection system. This is a new system.
13) If there is an existing lighting protection system, will the Contractor be allowed to re-use existing grounding systems in place?
Response: There is not an existing lightning protection system. This is a new system.
14) If there are no existing Lighting Protection System grounding systems in place, the
Contractor will need to install new. Much of the building perimeter is paved which will require demolition and replacement of paving to install grounding. Is the Contractor required to include in their bid the demo and replacement of existing paving to accommodate new LPS grounding?
Response: Contractor shall try to minimize removing pavement, but where required contractor shall replace pavement. Contractor will have to hand dig portions of the building to avoid existing utilities. Contractor shall field verify.
15) Are there existing interior or exterior downleads we can use for the new lightning protection system? If yes, please provide locations and sizes of existing downleads.
Response: No, this is a new system.
16) If Contractor is required to install new downleads for new lightning protection system, will it be acceptable to install exterior downlead on face of building?
Response: Bid as specified in the plans and specs.
17) Is there an existing surge protection device at the electrical service(s) to the building?
Response: No.
18) In relation to new lightning protection system planning, will the Government provide location of the existing electrical rooms to determine grounding and surge protection scope of work?
Response: Yes.
19) Specification 26 41 00 para 3.3 indicates that Contractor is to “bond metal fencing” within
6 feet of the new LPS to the new LPS system. To determine this can the Government provide a site plan that indicates locations of metal fencing within 6 feet of the building.
Response: Metal fencing that requires bonding surrounds the chill water and generator yard adjacent to the south building. Contractor shall field verify any other locations.
20) Specification 26 41 00 para 3.3 indicates that Contractor is to “bond metal fencing” within
6 feet of the new LPS to the new LPS system. Is the loading dock vehicle barrier (steel bollards with crash cables) considered “metal fencing” that is to be bonded?
Response: Metal fencing that requires bonding surrounds the chill water and generator yard adjacent to the south building. Contractor shall field verify any other locations.
21) Sheet A-401 indicates installing new double door and wall paneling on the West
Elevation. Photo E11/A-901 indicates existing electrical/communications conduit, box, and wiring on the interior of this wall. Is this to be demoed and cut off at concrete deck level?
Response: Conduit, box, and wiring on this wall of Penthouse 2 will be removed by the
Government.
22) Sheet M-401 indicates installing new 4” storm drain line in the plenum space above the ceiling from new roof drains to existing storm drain downleads approximately 50-60 linear feet away. In observing the existing plenum space in these areas during the site walk, and as reflected in the plenum photos provided on Sheet M-901, it appears that there will likely be significant conflicts where the proposed drain line path in the plenum space is completely blocked by ductwork, piping, and structure. In lieu of this proposed routing will the Government allow new drains to daylight through the closest exterior walls with wall-mounted lambs tongue and/or new exterior downspouts?
Response: No. Suggested routing shown was intended to minimize conflicts with existing in-ceiling infrastructure. Should conflicts be unavoidable through reasonable adjustments to recommended routing and require additional work performed modifying existing in-ceiling utilities, this will be addressed through a contract modification.
23) Has the Government performed a hazardous material investigation on any of the materials the Contractor will be disturbing (roofing, insulation/mastic/etc. in plenum space, etc.)?
Response: A roof moisture survey was performed in 2008. 13 core samples were laboratory tested for asbestos containing materials (ACM). ACM was not detected in any of the samples. See copy of asbestos testing report attached to specification
SECTION 07 01 50.10 28 as part of this amendment.
24) If the Government has not performed a hazardous material investigation is the
Contractor required to perform?
Response: No. See spec SECTION 01 35 26 Page 25, 3.1.3 Unforeseen
Hazardous Material.
25) Section 01 35 26 paragraph 1.7.1.1.1 indicates that the SSHO may not serve as the
CQCM or Superintendent. Can Superintendent also serve as the CQCM?
Response: No. The Superintendent and Quality Control Manager need to be 2 separate individuals.
26) Can the Superintendent be a “working” superintendent participating in the project labor requirements?
Response: No.
27) Please confirm that the Government takes no exception and has no special requirements regarding the temporary removal of all roof mounted antennas to accommodate Contractor work.
Response: Confirmed. The Contractor will not be responsible for relocating antennas on the roof.
28) Section 00010 “Bidding Schedule” includes Line Item 0003 “PV Solar Array Support
Structure” under the Base Work.
Response: The Base Work (south building) includes installation of support structure for a future solar array. OW-1 (center building) and OW-2 (north building) do not include a solar array structure.
29) Is this project sales tax exempt?
Response: New Orleans District does not provide nor does the Contracting Officer sign a
Sales Tax Exemption Form
30) Section 01100 paragraph 3.n states that Fall Protection shall be in accordance with EM
385-1-1 Chapter 21 with the exception that fall protection carts shall not be used under this contract. Will the Government confirm that the use of fall protection carts will not be allowed?
Response: Confirmed. See spec 01100-6, (n) Fall Protection. All fall protection shall be in accordance with EM 385-1-1 Chapter 21 Fall Protection with the exception that fall protection carts shall not be used under this contract.
31) Section 01100 paragraph 3 indicates that the Contractor is to follow the 15 March 2024 edition of EM 385-1-1. This edition contains significant changes to the previous 2014 edition. Will the Government confirm that Contractor’s are to follow the 15 March 2024 edition and not the 2014 edition?
Response: Confirmed. ALL WORK UNDER THESE SPECIFICATIONS SHALL BE
PERFORMED IN ACCORDANCE WITH THE PROVISIONS OF EM 385-1-1 "SAFETY
AND OCCUPATIONAL HEALTH REQUIREMENTS” DATED 15 MARCH 2024.”
32) The Contractor is not the designer of record and is not in possession of the ACAD files.
Will the Government confirm that the “Final As-Built Drawings” described in Section 01 78
02.00 10 paragraph 1.3 are not required to be prepared in AutoCAD but can be prepared neatly by hand or with PDF editing software (such as Adobe)?
Response: The Government will accept "red lined" final as-built drawings in accordance with the Construction Solicitation and Specifications. See SECTION 01 78 02.00 10, CLOSEOUT SUBMITTALS.
33) Section 01 33 00 paragraph 1.9 infers that the Contractor is to allow “a minimum of 30 calendar days” for Government review and approval of submittals. This is excessive and would negatively impact project schedule. Can the Government clarify their submittal review duration is 14 or 21 days which aligns more with our past experience with USACE?
Response: A minimum of 30 calendar days is required for Government review and approval of submittals.
34) Our firm exclusively uses Primavera P6 software for project scheduling. Section 01 32
01.00 indicates that the Contractor should prepare and submit schedules using Primavera
P6 but, if using an alternative software, the Contractor should meet the requirements of paragraph 2.1.2.2 and provide the Government two licenses, two computers, and training for two Government employees to use the alternative software. To ensure equal bidding and meet Government expectations, will the Government confirm if they will not entertain exceptions to the requirements noted in 01 32 01.00 paragraph 2.1?
Response: Bid as specified. See spec DIVISION 01 - GENERAL REQUIREMENTS
SECTION 01 32 01.00 12, PROJECT SCHEDULE, Part 2 - Products.
35) Section 00010, NOTE 6 indicates that the Government may exercise award of Option 1 between 10/1/2025 and 12/31/2025 and Option 2 between 10/1/2026 and 12/31/2026.
This infers the Contractor must hold their Option 1 bid price for 303 days after bid date and their Option 2 bid price for 668 days after bid date. This is not reasonable. Please clarify how long the Contractor must hold their bid price for Option 1 and Option 2 after the March 3, 2025, bid date.
Response: Throughout the life of the contract. This is typical practice for much larger, and longer duration, construction projects that are administered by the New Orleans
District. As stated in NOTE 6 in the Bidding Schedule: All prices bid by the Contractor to secure a responsive bid shall be binding throughout the life of the contract.
36) The contract documents do not reference FAR 52.216-4 “Economic Price Adjustment –
Labor and Material.” Given the potential volatility in the market based on potential tariffs and the potential delay in awarding Option 1 and Option 2 as noted in section 00010
NOTE 6, will the Government include this FAR clause in the contract?
Response: No.
37) On Page 20 of the Section:52.228-1 BID GUARANTEE (SEP 1996) (c) The amount of the bid guarantee shall be _twenty_ percent (20%) of the bid price or $_3,000,000.00_, whichever is less.- *** Why is the Bid Bond Amount stipulated Lower (less) than the estimated value amount as listed on Page 6 On form (SF1442) - The estimated value of this work is between $5,000,000 and $10,000,000) ??
Response: The estimated value of $5,000,000.00 - $10,000,000.00 is the magnitude of construction per FAR 36.204. FAR 52.228-1 Is the BID GUARANTEE required in the solicitation.
38) Please confirm that the PMMA coating is only for the canopies on the front of the building.
No PMMA coating on main roof structure.
Response: No. The canopies will have a PMMA fluid-applied roofing system, see sheets A-
102, A-103, and A-104. The main roof structure will have PMMA fluid-applied flashing for the modified bitumen roofing, see details on sheets A-501 through A-514.
39) Please confirm that only 5,605 sq ft of solar array rack area is to be included and that this is part of the base bid only.
Response: Minimum square footage shown on A-104 sheet keynote 16 has been increased.
See amended drawing A-104.
40) Please specify whether a ballasted solar array rack system will be acceptable for this scope of work.
Response: No, a ballasted solar array rack system is not acceptable. See contract specifications section 05 50 13.00 28 Paragraph 1.6.1.
41) Please confirm that the structural concrete on the main roofs for the base bid, OW-1 and
OW-2 are structurally sloped and will not need a taper system except on sheet keynote octagon - Note: I pulled a core sample on the high side main roof of the roof and near the drain.
Response: As part of this amendment, see new S-101 sheet which shows the structural deck type and slope. Additionally, it is recommended that bidders review resource drawings R-
002, R-003, and R-004 for the Structural Roof Level Framing Plans.
42) Please confirm whether or not the metal coping will be required to be a part of the weathertight warranty from the roofing manufacturer. If this is the case the coping will have to be premanufactured by the roofing manufacturer and we will not be able manufacture our own coping metal. Note: (This will be considerably more expensive.)
Response: Per contract specifications Section 07 60 00.00 28, there is no roofing manufacturer required for the sheet metal. However, a warranty for the finish of the sheet metal flashing is specified.
43) Please specify if there is a Preferred Roofing Manufacturer for this project.
Response: There is no preferred roofing manufacturer. The submitted roofing manufacturer and system must meet the technical and warranty requirements as specified.
44) Please specify where the lines are to be run and how many new lines are necessary. -It is unclear where the new drain lines are to be located, drawing sheet M-401 says to reference
A-101 and A-102; but there are no callouts on those pages.
Response: There are 4 new drain locations shown on M-401, the two drain locations between building grid lines 9 and 10, and the two drain locations between building grid lines 18 and
19. Suggested routing of tie in lines to existing storm drain risers is shown on M-401. Neither
M-401, nor A-102 call out the new drain explicitly as new, but the new drains are the ones not shown on the corresponding demolition sheets (e.g. AD-102). Drawings A-102 and A-
104 have been amended to identify the 4 new roof drains with a sheet keynote.
45) Could an onsite manager (QCM, SSHO, or Superintendent) be assigned multiple roles?
Such as one individual being the Superintendent and SSHO.
Response: No. Construction Solicitation and Specifications Section 01 35 26, Page 12,
1.7.1.1.1 Additional Site Safety and Health Officer (SSHO) Requirements and Duties, states:
“The SSHO may not serve as the Quality Control Manager. The SSHO may not serve as the
Superintendent.” Construction Solicitation and Specifications Section 01 45 04.00 10, Page
3, 3.2.1 (a) states: “The staff shall include a CQC System Manager who shall report to the project superintendent.”
46) Over the years, our company has performed some roof repairs but, in each case, we had to be sub-contracted through the disadvantaged business program. We do not qualify as a disadvantaged business, so would we need to contract with a disadvantaged business? Are we allowed to schedule a site visit in the next week or so?
Response: This solicitation is issued as unrestricted. The opportunity for site visits closed on
2/19/25.
47) It was mentioned at the site visit that a core cut sample has been performed on the existing roof. Can you please share the results of the core sample?
Response: Yes. 4As part of this amendment, see revised contract specification section 07 01
50.10 28 and attached "Core Sampling Report".
48) Will there be a public bid reading for the proposals?
Response: No.
49) Is this project fully funded? Has it been or can it be affected by federal spending freezes?
Response: The Base Work is fully funded. OW1 and OW2 have been submitted as a budget item for the next 2 fiscal years and there is no indication at this time that OW1 and OW2 will not be funded.
50) Given the instability of the marketplace, how long will prices need to be held? Will there be any considerations for material pricing fluctuations due to inflation and/or tariffs?
Response: No. This is typical practice for much larger, and longer duration construction projects that are administered by the New Orleans District. As stated in NOTE 6 in the
Bidding Schedule: All prices bid by the Contractor to secure a responsive bid shall be binding throughout the life of the contract.
51) Does Clause 252.219-7011 - Notification to Delay Performance apply to this project?
Response: No. This amendment will remove Clause 252.219-7011
52) Does Accident Prevention Plan - Fuel Oil Transfer - Floating Plant (EM 385-1-1, Section
19.A.06) apply to this project? It was included in the specifications right before Section
013201.
Response: The "ACCIDENT PREVENTION PLAN (APP) FUEL OIL TRANSFER --
FLOATING PLANT" is not required at this time. The Government Safety Officer reserves the right to require this APP at their discretion after Contract Award.
53) Can schedules produced in Microsoft Project be acceptable in lieu of Primavera P6?
Response: Bid as specified in Construction Solicitation and Specifications DIVISION 01 -
GENERAL REQUIREMENTS SECTION 01 32 01.00 12, PROJECT SCHEDULE, Part 2 -
Products.
54) Section 013526, page 11 - is a confined space entry permit required for this project? There should not be any confined space work on this project.
Response: Yes. Bid as specified in Construction Solicitation and Specifications SECTION
01 35 26, GOVERNMENTAL SAFETY REQUIREMENTS.
55) Section 013526, are the following plans required for this project:
a. Critical Lift Plan
b. Lifts of personnel
c. Barge Mounted Mobile Crane Lift Plan
d. Rescue and Evacuation Plan
e. Hazardous Energy Control Program
f. Lead, Cadmium, and Chromium Compliance Plan
g. Asbestos Hazard Abatement Plan
h. Polychlorinated Biophenyls (PCB) Plan
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
56) Section 013526, page 22, Item 1.15 Radiation Safety Requirements - is this required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
57) Section 013526, page 23, Item 1.16 Confined Space Entry Requirements - is this required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
58) Section 013526, page 24, Item 1.17 Gas Protection - is this required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
59) Section 013526, page 26, Item 3.4 Control of Hazardous Energy - is this required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
60) Section 013526, page 33, Item 3.8 Excavations - is this required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
61) Section 013526, page 33, Item 3.9 Electrical - is this section required for this project?
Response: Government approval is required for submittals with a "G" designation. Other plans may be required during the course of work and will be submitted if necessary.
62) Section 014500.1510 is there any cost associated with using the Resident Management
System?
Response: No, however you will need to ensure you have the appropriate System
Requirements to run the software. See Construction Solicitation and Specifications, DIVISION 01 - GENERAL REQUIREMENTS, SECTION 01 45 00.15 10, RESIDENT
MANAGEMENT SYSTEM CONTRACTOR MODE (RMS CM), 1.4 RMS Software and
1.5 System Requirements.
63) Section 015720.0012, page 4, are the Environmental Protection Plan and the Environmental
Pollution Control Plan required for this project?
Response: Yes. Bid as specified in Construction Solicitation and Specifications SECTION
01 57 20.00 12 ENVIRONMENTAL PROTECTION.
64) Sections 033053.0028, 034116.0828 what testing is required for the infill on the north roof where the exhaust fans are being abandoned and removed?
