Response to Questions
1. Could you confirm the bid due date is 29 Nov 2022 11:00 am as on both Amendments, the bid due date is NOT extended?
Response: Bid opening is scheduled for 7 December 2022 at 11:00am.
2. Could you confirm if this project is tax‐exempted or not?
Response: See Clause 52.229-3 in the Solicitation
3. Could you provide the proposal submission requirements?
Response: See Amendment 0005
4. Specification Section 33 40 01.00 12 – Corrugated Metal Pipe, Paragraph 1.3 MEAUREMENT AND PAYMENT, states payment will be made at the unit price per linear foot if Optional Work 2 is exercised. Price and payment shall include furnishing all plant, labor, materials, including but not limited to coupling bands, gaskets, base preparation, laying, placement and jointing, tests, embankment materials, base materials, excavation for base materials, control of water, and other work incidental thereto. In paragraph 1.3.2 BASE MATERIALS, the specifications state that payment and measurement for the Sand Fill, Bedding and Separator Geotextile will be made under their respective specification sections (unit price). Can you please confirm that the sand fill, base materials, and separator geotextile fabric will be made under their Unit Price Line Items?
Response: Yes
5. Specification Section 31 23 00.00 12 – Excavation, Paragraph 3.6.1 EXCAVATION, states that “Ninety (90) days prior to final acceptance, the Contractor is to re-survey and excavate the drainage ditches to restore the design sections as shown on the drawings at no additional costs to the Government.” What is the contractor to do with the material in the drainage ditches? Can the material be spread outside the limits of turf establishment, or does the material need to be hauled offsite?
Response: The Contractor must excavate and place the material within the government’s right of way, outside the limits of turf establishment, sloped to drain away from the levee.
6. Specification Section 31 23 00.00 12 – Excavation, Paragraph 3.6.1 EXCAVATION, states that “Ninety (90) days prior to final acceptance, the Contractor is to re-survey and excavate the drainage ditches to restore the design sections as shown on the drawings at no additional costs to the Government.” How is the Contractor to quantify how much debris/sediment will be in the drainage ditches 90 Days prior to final acceptance? This feature of work cannot be accurately quantified or valued during the bidding process. Can this work be covered by an equitable adjustment under CONTRACT CLAUSE entitled “Changes” (FAR 52.243-4)?
Response: No. The contractor should expect to have to redress the slopes and canal bottom along the entire length of the canal and this effort is incidental to the original canal excavation.
7. Will the fill material (sand and any dirt needed) be supplied by the owner or contractor?
Response: Sand fill and clay embankment shall be either from Contractor-furnished borrow area or a Commercial Borrow source. Please see specification section 31 23 00.00 12 Excavation, Paragraph 3.4 Contractor-Furnished Borrow Areas and Commercial Borrow Source and specification section 01100, Paragraphs 11 Aggregate Sources, 12 Stone Sources, and 13 Clay Sources.
8. Should the contractor consider the existing access road acceptable for 2 way traffic in it’s existing condition and configuration?
Response: The contractor is responsible for maintaining the suitability of the access road for their operations. The access road right-of-way is 40 feet wide. The contractor may widen the access road as needed provided they stay within the right-of-way.
9. Will traffic control at the intersection of Highway 61 be the responsibility of the contractor?
Response: Yes
10. Will the Corps be issuing another bid schedule with the added items in Amendment 0003? If not how are we to incorporate these items into the bid?
Response: No, the government estimated quantities will not be incorporated into the bid schedule and are only to assist in contractor’s bids.
11. Note 3 on Dwg. C-003 states that the Contractor is responsible for the maintenance of Access Road B. Note 2 on Dwg. C-009 states each contractor is responsible for their own maintenance, dust control, flagman, street sweeping, etc. of Access Road B. General Provision 01100-22 and Contract Clause 52.236-4 PHYSICAL DATA of the specifications indicate that the contractor for this contract is responsible for maintenance of the shared access road and U S Hwy. 61 until substantial completion of this contract.
Will the maintenance be a shared responsibility or a sole responsibility of the contractor for this contract?
Response: Each contractor is required to have their own equipment and labor to maintain the road.
12. When silt fence is required for a project, there is typically a bid item for payment along with details on the drawings and in the specifications. As there is no reference to silt fence provided, is silt fence required for this project?
Response: No
13. The settlement gage detail shown on Dwg. C-008 shows a riser pipe welded to the plate.
This typically causes issues at the jobsite with levee construction, especially when placed at the centerline of the levee. As levee fill for this project is relatively shallow, plates can be easily located utilizing GPS coordinates and probed for final elevations without the use of risers. Can the riser pipes be changed to optional?
Response: Gages shall be installed as shown on plans.
14. Settlement gage Note 3 at the top of Dwg. C-008 states where gages are placed less than 100 feet apart, the settlement measurement range shall be half the distance between the gages. Shouldn’t “less than 100 feet apart” be changed to “less than 300 feet apart”?
Response: Yes
15. For Piezometer installation shown on Dwg. B-015, will the sand need to be placed up to each of the three (3) locations and, then, stop to allow piezometer installation prior to sand placement at the piezometer locations?
Response: Instruments will be installed after the sand fill is placed at the identified location but prior to clay lift construction. Based on the contractor’s order of work this may require him to stop construction for installation. The Contractor shall construct a clay bridge extending from the sand base to the piezometer at three instrumentation cross section locations as shown on sheet B-015.
16. Is it the intent to install the piezometers at the three locations all within the 17 day period noted?
Response: Yes
17. General Provisions, Item 4 states that the Government and Contractor’s field offices shall be placed within the project right-of-way or limits of construction. Since there are inadequate utilities at the site of construction, can the buildings be located off of the project limits, but, at an approved location within a reasonable distance from the project?
Response: Yes, provided the Government’s office is separate from the contractor’s.
18. The Office of the Under Secretary of Defense has recently issued two memorandums, “Guidance on Inflation and Economic Price Adjustments” and “Managing the Effects of Inflation with Existing Contracts”, concerning Economic Price Adjustment (EPA) clauses. Considering the continued volatility in the economic and labor markets and the duration of this contract (620 calendar days), would the Government consider including an EPA clause in this contract?
Response: No
19. Section 31 23 00.00 12, Paragraph 3.6.1, states that 90 days prior to final acceptance, the Contractor shall re-survey and excavate the drainage to restore to the design sections as shown on the drawings at no additional cost to the Government. How will the Contractor know the date of final acceptance to determine when this required excavation work and re-surveys need to be completed?
Response: This work can begin after all fertilizing and seeding has been completed and will not impact the substantial completion date.
