Contractor must mobilize and be at the specified location within 5 hours of notification by an Authorized Government Representative. The emergency callout limitation is $40,000. A numbered task order will be issued by the

Contracting Officer on the first business day after appropriate funds are made available, and the emergency callout will be converted to the appropriate project for contractual, invoicing, and payment purposes.

5. Diving Conditions

Divers may be expected to encounter conditions that affect the ease or safety of operations. Some conditions that may be encountered are reduced or zero visibility, cold water, night dives, dangerous animals (such as poisonous snakes), unpredictable currents, and confined spaces which are considered penetration dives (such as diving in valve tunnels or the girder systems of gates). Generally, water depths for dives vary from 6 feet to 60 feet. Occasionally, dives may be to depths in excess of 60 feet, and any special requirements for these dives will be addressed in the task order. See paragraph 16 “Payments”, sub-paragraph i, for payment guidelines.

6. Diving Equipment

All diving equipment shall be provided and used by the Contractor, including any special equipment, which may be required for a given dive. All maintenance to be performed on diving equipment must be performed during non-duty hours. All diving equipment must be delivered to the job site in a ready-to-operate condition, with the exception of loading fuel in the compressors. Any loss of time on a job due to the Contractor’s equipment failure shall be omitted from the invoice. See paragraph 16 “Payments”, sub-paragraph d, for payment guidelines.

a. Normal Equipment

Consumables and normal equipment, which are usually required for each dive, shall be provided at no additional cost to the Government and shall be in the Contractor’s own inventory, or belong to the individual diver, as appropriate. Examples include, but are not limited to, acetylene, oxygen, two-way communications between supervisor and divers, GPS, air compressors and ancillary equipment providing 4.5 cubic feet per minute at all depths, bailout bottles or other secondary air supplies, diving harnesses, helmets, wet or dry suits, hoses, fuel, knives, hand and/or power tools, tool boxes, boarding ladders, duct tape, rope, etc. Despite the provision of bailout bottles as normal equipment, the use of SCUBA for normal operations or emergencies shall not be allowed without the prior approval of the New Orleans District Diving Coordinator. Divers using direct source surface-supplied air (SSA) shall be provided with a primary air supply of at least 4.5 cubic feet per minute to each diver at the maximum depths and a backup air supply in compliance with Section 30.D.05 of EM

385-1-1.

Direct source air compressors shall be used and equipped specifically for their intended use. They shall have a suitable approved means to regulate the pressure and a low air pressure alarm in the system. In addition, they shall have a Carbon Monoxide (CO) monitor with alarm in the following situations:

(1) The compressor is powered by an internal combustion engine.

(2) Compressors used in close proximity to internal combustion engines that may/will be running during dive operations (boat motors, generators, cranes, etc.). Air intake pipes shall be placed away from/upwind of the exhaust source.

(3) Fueling a compressor during operation shall not be allowed.

b. Special Equipment

Special pieces of diving equipment may be required on individual task orders as specified by the Contracting Officer. Special equipment is that equipment which is identified separately in the Bidding Schedule under

CLINs 0001AN “3x2 Water Jet Pump and Associated Equipment”, 0001AP “4x3 Water Jet Pump and Associated Equipment”, 0001AQ

“Underwater Cutting and Welding Equipment”, 0001AR “Dive Boat at a

Minimum of 30’ in Length”, and 0001AS “Underwater Video and Still

Camera and Associated Equipment”, which shall be provided by the

Contractor as indicated in the task order, at the cost set forth in the Bidding

Schedule. The Contractor will get paid for this equipment at the rates set forth in the Bidding Schedule whether the equipment is in the Contractor’s own inventory or is being rented. This equipment includes a 3x2 water jet pump and all associated equipment (hoses, connectors, nozzles, etc.), 4x3 water jet pump and all associated equipment (hoses, connectors, nozzles, etc.), underwater cutting and welding equipment, a dive boat measuring a minimum of 30 feet in length including fuel, and underwater video and still camera and associated equipment. Underwater welding and burning must be limited to SSA mode only, and equipment configuration and procedures must be in accordance with Section 30.B.08 of EM 385-1-1 and the US

Navy Underwater Cutting & Welding Manual, S0300-BB-MAN-010. The dive boat must meet U.S. Coast Guard regulations for passenger and equipment load and must have enough space to accommodate a

Government Dive Inspector. The boat operator must be a member of the dive team and must have a boat operator license. Special equipment does not have to be in the Contractor’s own inventory, but it must be able to be at the dive location in good operating condition within 5 hours of notification. If the Contractor purchases any equipment for use in which the Contractor seeks full reimbursement, the Contractor must receive approval by the Contracting Officer in writing prior to the purchase. Upon completion of the task order, the purchased equipment will be transferred to the Government.

c. Other Equipment and Costs

Other equipment may be required to accomplish the work and not otherwise be identified in the Bidding Schedule. This equipment would be paid for under CLIN 0001AV “Other Equipment & Costs not otherwise identified in this Schedule”. This equipment includes, but is not limited to, an underwater thickness gauge, air wrench, air lift, diving barge, tug/tender boat, support vessel, crane, and a decompression chamber. The

Contractor must provide the equipment’s brand/model # and a cost estimate for the equipment within 2 hours of notification for an emergency dive and within 48 hours of notification for a non-emergency dive.

Equipment and costs under this line item require the Contracting Officer’s approval in writing prior to the dive team mobilizing to the dive site. If the equipment is being rented, the Contractor must provide a receipt from the rental company.

7. Government Inspection

a. Pre-Dive Inspection

An equipment inspection will be held jointly by the dive supervisor and the Government Dive Inspector at the beginning of the dive. The form entitled “Contract Surface-Supplied Air (SSA) Diving Operation Quality

Assurance Checklist” shall be used for this inspection (see Enclosure 1).

Inspection reports shall include, as a minimum, the following:

1. The phase of work underway during the inspection. If others are performing other work in conjunction with the diving services, the phase work for these other activities shall be included.

2. The locations or areas where the safety inspections were performed.

3. The results of the safety inspections, including the nature of deficiencies observed and corrective actions taken.

4. The date and time of the inspection.

5. The signatures of the personnel responsible for the contents of the inspection report.

b. Pre and Post Dive Safety Meetings

The dive supervisor is responsible for holding a daily pre and post dive safety meeting (see Sections 30.A.19 through 30.A.21 of EM 385-1-1).

The meetings must be documented on the daily time log as being completed. As stated in paragraph 14 “Record Keeping”, the Contractor must submit pre and post dive safety meeting forms within 24 hours after the completion of each day’s dive, and each member of the dive team, the

MVN dive inspector, and the USACE representative on site (if present) must sign attendance for both meetings.

c. Post Dive Survey

Following each dive, the District Dive Coordinator (DDC) or the

Government Dive Inspector will independently complete a post dive survey which rates the Contractor’s job performance. The form entitled

“Post Dive Survey” will be used for this evaluation (see Enclosure 2).

8. Safety

a. Safety Indoctrination

The Contractor shall be responsible for initiating and maintaining a safety and health program that complies with the safety and health references described below. The program shall include initial indoctrination and continuing training for all employees who shall work under this contract.

b. Safety and Health References

Equipment and procedures shall comply with:

1. US Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, latest edition.

2. OSHA Regulations, 29 CFR Part 1910, Subpart T.

3. Current US Navy Diving Tables in U.S. Navy Diving Manual Volume

I, NAVSEA 0994-LP-001-9010.

4. Safety resources of the Association of Diving Contractors International

(ADCI).

5. These specifications, whichever is the most stringent for the particular application.

c. Required Safety Equipment for Non-Divers

Except for the diver in the water and the stand-by diver, all personnel on the dive team must wear safety equipment (flotation aids, hard hats, hearing/eye protection, etc.) as required by EM 385-1-1. The stand-by diver is exempt from the requirements but is required to wear a hard hat.

When no divers are in the water, all dive team personnel must wear the required safety equipment without exception.

9. Diver Qualifications

a. Medical Fitness to Dive

The Contractor must ensure that all divers are medically fit to dive (see

Section 30.A.09 of EM 385-1-1). Divers must receive an annual diving physical according to ADCI or similar standards preferably by a hyperbaric physician (MD or DO) or other licensed physician knowledgeable in the physiology of diving. A “Fit to Dive” statement that each diver has been medically examined within the previous 12 months and has been determined fit and approved to dive must be signed and signature stamped by the examining physician. After any serious diving-related injury or illness, such as an over-pressurization injury and/or decompression illness, divers must be re-examined by a hyperbaric physician and be re-certified as “Fit to Dive”. In addition, the dive supervisor must verify the divers’ health and well-being at the dive site before allowing the diver to enter the water.

b. First Aid, CPR, and Emergency Oxygen Systems Certification

Each dive team member must have current certification in first aid and cardiopulmonary resuscitation (CPR) from the American Red Cross

(ARC), the American Heart Association (AHA), or from an organization whose training adheres to the standards of the International Liaison

Committee on Resuscitation, or from a Licensed Physician (LP).

Additionally, each dive team member must have current certification in the use of emergency oxygen systems, and, if provided on the dive site, the use of Automated External Defibrillators (AEDs). All classes must contain a hands-on component and cannot be taken online. Evidence of this will be a photocopy of the certificates. The certificates must state the date of issue and length of validity. Training in the use of emergency oxygen systems shall be specific to underwater diving and shall meet the requirements of a nationally recognized training organization such as

Divers Alert Network (DAN), Professional Association of Diving

Instructors (PADI), National Association of Underwater Instructors

(NAUI), the YMCA, or other recognized sources (see Section 30.A.08 of

EM 385-1-1).

c. Experience and Qualifications

The Contractor must provide evidence that each dive team member has training and experience consistent with the performance requirements of the scope of work (see Sections 30.A.05 through 30.A.07 of EM 385-1-1).

Training documentation must be in compliance with the OSHA Diving

Standards 29 CFR 1910.410 and must show that the dive team members have successfully completed training to the appropriate level. A copy of all dive-related training certificates shall be required. Proof of certification (a diploma and/or official transcript) as a commercial working diver from an accredited commercial dive school and other dive-related training certificates (e.g. chamber operator, saturation diver, etc.)

must be required as proof of a dive team member’s certification and/or experience. An ADCI card may be substituted as proof of training for divers demonstrating more than five (5) years of diving experience within the six (6) years preceding commencement of dive operations. As a minimum, each diver, stand-by diver, and dive team supervisor must have at least one (1) year of commercial experience in the applicable position.

Divers must have completed at least four (4) working dives using the particular diving techniques and equipment to be used under the contract.

Divers must demonstrate that at least one out of the four dives was performed in the last nine months. Dive tenders must have previous experience and training as a dive tender. If divers are required to perform rigging duties, they must be a qualified rigger and meet the personnel qualifications listed in Section 15.B of EM 385-1-1.

10. Dive Teams

See Appendix G of EM 385-1-1 for manning levels of dive teams.

a. Four-Man Dive Team

A four-man dive team may be used whenever a penetration dive is not anticipated. The Contractor may provide additional personnel for his own convenience, at no additional cost to the Government. A four-man dive team consists of one dive supervisor, one diver, one stand-by diver, and one tender. Assignments may be rotated among the certified divers, if desired, in order to limit bottom time for any given diver for safety reasons. If such rotation is to occur, this fact must be stated in the diving operations plan.

b. Five-Man Dive Team

A five-man dive team consists of one dive supervisor, one diver, one stand-by diver, and two tenders and may be used whenever a penetration dive is not anticipated. A five-man dive team may also be used whenever diver bottom time is limited by water depth. The Contractor may provide additional personnel for his own convenience, at no additional cost to the

Government.

c. Six-Man Dive Team

A six-man dive team consists of one dive supervisor, two divers, one stand-by diver, and two tenders and is required whenever a penetration dive is anticipated.

A six-man dive team may also be used whenever diver bottom time is limited by water depth. The Contractor may provide additional personnel for his own convenience, at no additional cost to the Government. However, if the

Government agrees additional personnel are required but not to where two four-man dive teams are required, then the rate for additional individuals will be as stated in paragraph 16 “Payments”, sub-paragraph f.

d. Stand-By Diver

The designated stand-by diver must wear his normal equipment (except helmet) and be prepared to enter the water whenever the primary diver is in the water. Due to the heat conduction properties of a wetsuit and considering south Louisiana’s extreme heat indexes, the Contractor must provide a shade producing apparatus to shield the dressed-out diver from direct sunlight but still allow him to be in an emergency response mode.

The stand-by diver is not allowed to work as a tender or have any other duties while the primary diver is in the water. If the stand-by diver is required to enter the water, the dive supervisor may act as a tender.

11. Required Availability of Dive Teams

The Contractor must be capable of providing up to two full dive teams on the same day, in the event one of the below scenarios occur. Therefore, the

Contractor must always have two six-man dive teams available for use under this contract.

a. There may be instances where two dives are required on the same day, each at a different location.

b. The nature of diving operations under certain task orders may be such that

24-hour operations are required to where shift diving becomes necessary.

The Contractor must provide two dive teams for such operations, each to work a 12-hour shift. No dive team personnel may work two or more consecutive shifts, including the dive supervisor. The second shift may use the same equipment used by the first shift. If separate equipment is used for the second shift, then an additional equipment inspection must be performed.

12. Hurricane Season

The Government will issue task order(s) as necessary for dive teams to conduct emergency preparations prior to a major storm threatening a New Orleans District navigable waterway. Diving operations may be required one to two days prior to a storm event reaching the area. Diving services to be performed for storm preparedness include, but are not limited to, clearing debris from around and/or under gates and ensuring proper closure of gates at navigation locks and hurricane structures.

13. Documentation Required for Work

a. First Aid, CPR, and Emergency Oxygen Systems Certification

All members of the dive team must be certified to administer first aid and

CPR. Dive team members must also have current certification in the use of emergency oxygen systems.

b. Safe Practices Manual

The Contractor must submit one copy of the Contractor's Safe Practices

Manual to the New Orleans District Diving Coordinator for review and acceptance. The manual must include the requirements stated in Section

30.A.15, items a-k, of EM 385-1-1. This manual will be retained by the

District Diving Coordinator and will not be returned.

c. Dive Operations Plan, Activity Hazard Analysis, and Emergency

Management Plan

Following the issuance of the task order, the Contractor must submit a

Dive Operations Plan, Activity Hazard Analysis (AHA), and Emergency

Management Plan to the District Dive Coordinator for review and acceptance (see Sections 30.A.16 through 30.A.18 of EM 385-1-1). These documents must be submitted within two hours of notification for an emergency dive and at least two business days prior to the start of a non-emergency dive. The Dive Operations Plan must include detailed information about the specifics of the dive and at a minimum must include the requirements stated in Section 30.A.16 of EM 385-1-1. The AHA must be detailed to address all of the activities that the Contractor is being requested to perform (see Section 30.A.17 of EM 385-1-1), and the

Emergency Management Plan must include the requirements stated in

Section 30.A.18 of EM 385-1-1. The Contractor must not begin a dive until approval of these documents from the District Dive Coordinator is received in writing. In addition, these documents must be at the dive site while diving operations are being performed. If for any reason the dive mission is altered after approval, the Contractor must revise and resubmit these documents to the District Dive Coordinator for review and acceptance prior to continuing the operation. The revisions may include differences in time, date, dive team members, work methods/tools used, and other changes that do not affect overall risk. This review may be conducted electronically or verbally and confirmed in writing after completion of the dive operation (see Section 30.A.22 of EM 385-1-1).

14. Record Keeping

A record of all dives must be kept. An electronic copy of all dive logs, time logs, Job Hazard Analyses (JHA) or Job Safety Analyses (JSA) forms, a pre-dive safety meeting form, and a post-dive safety meeting form must be submitted to the COR and the District Dive Coordinator within 24 hours after the completion of each day’s dive. The dive logs must be in accordance with Section 30.A.24 of EM-

385-1-1. The daily time logs must include the arrival time at the dive site, the completion time of the dive, the time at which the dive team is leaving the dive site, the time that the pre and post dive safety meetings occurred, and on the bottom of each time log it shall be noted as dive complete and no incidents to record. In addition, a completion report shall be prepared following all inspection dives, which includes a description of the condition of all items surveyed or inspected. Clear, readable sketches shall be prepared to supplement the text descriptions. The reports and sketches must be submitted electronically to the

COR and District Dive Coordinator within 48 hours after the completion of the dive. All documents, reports, and sketches must be submitted electronically and be clearly legible.

15. Per Diem

Per diem is the allowance for lodging and meals. Per diem will only be paid if the

Contractor incurs lodging costs (stays overnight in hotel) and meets one of the triggers listed below. In addition, the Contractor must submit a hotel receipt showing all nights that lodging costs were incurred. Per diem will be paid for under

CLIN 0001AJ “Per Diem 4 Man Dive Team”, CLIN 0001AK “Per Diem 5 Man

Dive Team” or CLIN 0001AL “Per Diem 6 Man Dive Team”, whichever is applicable, and will include costs for lodging and meals in accordance with the Joint

Travel Regulations.

The Contractor must meet one of the triggers listed below and must provide a hotel receipt in order to receive payment for per diem. The days of per diem paid to the

Contractor will match the amount of nights that lodging costs were incurred. The mileage stated in the below triggers is the mileage travelled by vehicle and is the shortest route from the approved mobilization location to the dive location.

a) If the required dive location is greater than 75 miles from the approved mobilization location and the dive team must report to the location at

7:00 a.m. or earlier, then per diem will be allowed for the day prior to the dive.

b) If the dive location is greater than 75 miles from the approved mobilization location and the dive team work time plus commute time is greater than 12 hours, then per diem will be allowed for that day.

c) If the dive location is greater than 50 miles from the approved mobilization location and the dive team is required to perform consecutive day dives at the same location, then per diem will be allowed with the exception of the demobilization day (unless the case in paragraph b above applies).

d) If the Contracting Officer deems it necessary in order to accomplish a particular mission not covered in the above cases, per diem may be paid.

This must be approved by the Contracting Officer in writing prior to the

Contractor incurring lodging costs.

16. Payments

a. Payment will be made at the applicable contract unit price(s) for the services described in each task order.

b. The hours stated on the bid schedule reflect the hours that the entire dive team will work. For example, under CLIN 0001AD “4 Man Dive

Team”, each of the 96 hours is how much the four-man dive team will get paid per hour as a whole team (not per person).

c. Payment for mobilization and demobilization will be made based on the number of round-trip miles between the approved mobilization location and the task order dive site. For a job that takes more than one day, mobilization will only be paid for the first day and demobilization the last day. For jobs requiring a second-shift dive crew, mobilization and demobilization will be paid for each crew. Payments for mobilization and demobilization shall include all work necessary to transport the crew and equipment. Demobilization will begin upon the dive team(s) release by the Government's representative.

d. Payment to the Contractor for hours worked each day will begin when the dive team arrives at the dive location, provided that all dive team members and all required equipment are at the site. Payment will not begin earlier than 15 minutes prior to the reporting time. If any required equipment is brought to the site late, payment will not begin until the equipment arrives at the dive site. If any equipment is determined to not be in good working order, such as bailout bottles not being properly filled, payment will not begin until all equipment is in compliance.

Payment to the Contractor will stop when the dive team departs the dive location. The arrival and departure times will be determined as shown on the Contractor-submitted time logs and through confirmation by a

Government representative. The dive team will be paid a minimum of 8 hours except in the case where the dive team or equipment arrives late to the site or when the Contractor’s equipment failure causes the job to be delayed resulting in idle/lost time on the job site. In such cases, the amount of time lost will be deducted from the invoice. If the lost time occurs during the first 8 hours, that amount of time will be deducted from the first 8 hours line item. If the lost time occurs during overtime, that time shall be omitted from the Contractor’s invoice. If it is determined that the Contractor is negligent during diving operations which causes the dive to last longer than reasonable or causes the divers to come out an additional day to complete the task, the extra time that wouldn’t have been needed if the Contractor was performing at an acceptable level will be at no additional cost to the Government.

e. If the Contractor works more than 8 hours in one day, the Contractor will be paid at the applicable overtime cost set forth in the Bidding

Schedule under CLINs 0001AE, 0001AG, and 0001AI. Payment submitted to the Contractor for overtime will be to the nearest half hour in excess of the…
