About this file

This document contains an amendment to a solicitation and a mitigation purchase agreement related to a federal contract opportunity. The amendment provides answers to contractor questions, clarifies that the solicitation is for brackish marsh credits rather than bottomland hardwood credits as stated in error, and explains that transferring credits is a condition of payment rather than occurring after payment. The mitigation purchase agreement outlines the purchase of brackish marsh habitat credits by the U.S. Army Corps of Engineers from a mitigation bank sponsor to compensate for unavoidable habitat losses from construction of the Terrebonne Non Federal Levee project in Louisiana, including the payment amount, responsibilities of both parties, and requirements for the bank sponsor to achieve mitigation success according to the established mitigation banking instrument.

SUMMARY OF CHANGES

(End of Summary of Changes)

The following items are applicable to this modification:

AMENDMENT 0001

Question 1. Section 3 indicates that the Chef Menteur Bank’s AAHU/acre score is 9.21 (in the table). We do not believe this is correct – we believe our current score is 0.18 AAHU’s per acre.

Could you kindly clarify whether there is a typo in the table, and if so, what the updated table should be?

Response 1. Yes, it is a typo in the table. The updated amount should read .22 AAHU/Acre in the table.

Question 2. In the Purchase Agreement, section 2 indicates bottomland hardwood credits. Can you please confirm, is this a typo (we believe it should say brackish marsh credits), and if so, can you kindly send a revised Purchase Agreement.

Response 2. Yes, it is a typo in the Mitigation Purchase Agreement. The Mitigation Purchase Agreement should state Brackish Marsh (BM) and the agreement will be corrected and provided.

Question 3. In the Purchase Agreement, Section 4, can you please confirm that the intent here is that once the USACE pays the mitigation bank sponsor, then the bank sponsor will debit the credits in RIBITS and transfer them to the USACE? Or is transferring the credits a condition of being paid?

Response 3. Section 4 of the Mitigation Purchase Agreement does not address conditions of payment. This information is stated in the solicitation under 6. DELIVERABLE. Transferring of credits is a condition for payment.
