About this file

This amendment to a solicitation provides clarification regarding the use of multiple dredges on a contract for dredging services on the Mississippi River. The solicitation seeks a self-propelled trailing suction hopper dredge, rented on an hourly basis, to maintain depths in the Mississippi River Southwest Pass and other areas of the New Orleans, Galveston, and Mobile districts. The estimated value is between $5-10 million. The original solicitation allowed additional dredges to be used at reduced pay rates; this amendment specifies that multiple dredges, if needed to meet required start and completion dates, will be paid at the same hourly rates.

SUMMARY OF CHANGES

SECTION SF 30 - SF 30 CONTINUATION

The following have been added by full text:

QUESTION AND RESPONSE

Q.1 Please refer to the paragraph entitled Addition of Plant In Specification Section 35 20 23.23 of the above-referenced solicitation. This specification section contemplates the addition of one or more dredges in addition to the primary dredge. Paragraph 2.1.3 b (2) states in relevant part, “The additional dredge(s) will be paid only for 100% Pay Time. Time classified as 80%, 60%, 48%, 35%, and 21% will be considered 0% pay time and will not be paid for.”

It is our understanding that in the past, this situation occurs most often when a contractor has idle plant capacity, and desires to commit an additional dredge or dredges to a current project – whether or not such addition is advantageous to the Government. The reduction in pay time for the second dredge has historically been considered an ‘inducement’ for the Government to agree to the addition on hopper maintenance dredging contracts, when the addition is nether advantageous nor detrimental to the Government -- from a navigation or channel condition point of view or otherwise.

The current solicitation is different in that in accordance with Amendment 0001, the solicitation will be used to dredge the channel for both maintenance and new construction. Moreover, the amendment stipulates commencement of dredging no earlier than 15 July 2021 and no later than 15 August 2021, and completion of the Base (Item 002) work by 30 November 2021. The amendment also states, “If the hours for the bid lot selected would extend past this required completion date additional hopper dredge(s) must be added to this contract, as described in Section 35 20 23.23 paragraph entitled “Addition of Plant”, to ensure the Item 0002 work is completed by 30 November 2021.”

Since all of the foregoing are in the interest of the Government and none are necessarily in the interest of the low-bid contractor, and the Government wishes to increase competition by giving potential offerors maximum optionality while simultaneously ensuring that its desired start and completion dates are met, we respectfully request that Specification Section 35 20 23.23 Paragraph 2.1.3 b (2) be deleted in its entirety.

That is to say if more than one dredge must be committed to all or part of the project to meet the Government’s requirements, then both should be paid on the same % Pay Time basis.

A.1 At the behest of industry, in order to provide some scheduling flexibility, the use of multiple dredges was permitted on an existing solicitation. No changes will be made to the existing solicitation. Bid opening date and time will remain the same.
