++Items not subject to the requirements of FAR 52.211-18 VARIATION IN ESTIMATED QUANTITY.

00010-5 ED 17-019

**The unit "JOB" as used in this Bidding Schedule is synonymous with the term "Lump Sum" if used elsewhere within these plans and specifications.

Award will be made as a whole to one bidder.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE

AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL

BE DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 4: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;

http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx

NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item, identified in the schedule as OPTIONAL WORK Item, in the quantity and price stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Item by written notice to the Contractor. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.

NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option. (If an option is to be exercised at the time of contract award FAR17.208 shall be used in place of FAR 52.217-5

NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL

WORK. In the event that OPTION WORK items are exercised under the terms of the contract, the time required for completion of the contract will not be adjusted but shall be performed concurrent with the original contract duration of 575 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52-211-10 – APR 1984)”.

EVALUATION OF SUBDIVIDED ITEMS (Mar 1995) - UAI 5152.211-9000.

Item Nos. 0016, 0017, 0018, 0030, and 0036 are subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.

(End of Clause)

VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS (Mar 1995) - UAI 5152.211-9001.

The Variations in Estimated Quantities clause is applicable only to Item Nos. 0016, 0017, 0018, 0030, and 0036.

a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.

b. Where the actual quantity of work performed for Item Nos. 0016, 0017, 0018, 0030, and 0036 are less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause Federal Acquisition Regulation (FAR) 52.211- 18, Variation in Estimated Quantities.

c. If the quantity of work performed under Item Nos. 0016, 0017, 0018, 0030, and 0036 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211- 18, Variation in Estimated Quantities.

Amendment 003 – Contractor Questions OEB 19 – ICS Demo

The follow questions were submitted by various contractors during advertisement. The USACE responses are shown in RED.

1. We would like to request the Gov quantities on the lump sum items on the referenced project.

Quantities will be provided. In accordance with FAR 52.236-4 PHYSICAL DATA (APR 1984), The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor. It is expressly understood that the accuracy of these estimates is in no way warranted and that the furnishing of this information to a bidder will not relieve him of his responsibility to estimate the quantities involved.

2. London ave has some partial scour protection to be sawcut and removed. This is to be replaced after construction of the I-wall cap. Where is this scour protection paid? How is this measured? Is any base course required?

The partial scour protection shown to be removed is NOT to be replaced. Per S-200 and S-203, the area of scour protection removed shall be filled by the I-wall capping with felt paper or similar bond breaker placed between the I-wall capping and the existing scour protection to remain. That specific scour protection demolition is paid for under bid item “London Avenue Canal floodwall Demolition” which is measured per job.

The I-wall pour does not require scour protection type base course. However per S-200 note #5, the Contractor is responsible for providing a stable foundation for the I-wall construction.

3. Where are the floodwall removal items paid for 17th street canal? There are about 271' of cutting existing sheet pile next to the road and removal of plate on top of about 150' of floodwall. The similar items on Orleans and London have a separate line item called floodwall demo. No separate item was provided at 17th.

The removal of the east side I-wall top plate and any sheetpile cut from existing retaining walls shall be paid for under the bid item “17th Street Canal ICS Demolition”.

4. Granular backfill- would the Gov consider changing to Vehicular Truck Measure in lieu of per ton?

No.

5. Sheet C-300- can the scale be added to this drawing sheet?

Yes. Drawing will be amended accordingly.

6. Can the Gov verify the pay quantity for item 0022 and 0023 HPTRM?

2,800 Square Yards is the correct quantity. The Contractor should ensure they are including the mat installed in the anchor trenches as well.

7. What are the limits/locations of the turfgrass sod (pay qty of 4400 sy) in addition to the HPRTM Area (pay qty of 2800 sy)?

The cross levee limits for both are shown on sheet C-400. The HPTRM begins on the floodside 4’ from the top of the levee and ends ~16’ from the levee toe (For reference, the levee toe at 17th street is located at El. 8.0). The turfgrass sod begins at the floodside levee toe and end at the HPTRM anchor trench.

This application of HPTRM and turfgrass sod is shown on C-105 (17th Street) and C-203 (Orleans Ave). At 17th Street, it begins at the west side existing scour protection and ends at station 1241+45 on the Reach 5 Levee. At Orleans Ave, it is approximately 25’ long in distance and is located along the lakefront levee on the west side of the PCCP complex.

8. Can further detailed information be provided on the existing equipment (generators, pumps, engines, etc) (equipment model numbers, manufacturers, size, etc)?

Some, but not all, of the additional information requested will be provided.

9. Bollards- what item are these to be paid under?

Bollards to be removed shall be paid under the location appropriate “ICS Demolition” bid item.

Payment for new bollards shall be distributed under the existing bid item “Asphaltic Pavement”.

10. Please provide a list of machinery currently located at the three sites. For the purpose of this request, machinery includes generator sets, hydraulic power packs, and pumps.

11. Please provide specific machinery information such as models, serial numbers, and engine arrangement numbers.

12. How many hours have been logged on each genset?

The hours of operation vary on all of the equipment. However generally speaking, no pump drive unit diesel engine is over 250 hours and no generator is over 600 hours.

13. Please provide genset and hydraulic power pack maintenance records.

14. Who performed the maintenance on the generator sets and power packs?

Maintenance was performed by USACE. In cases of specialized maintenance, the manufacturer or a manufacturer approved service provider was used.

15. When were the generator sets and hydraulic power packs last operated?

The Gensets automatically start up once per week and run for 20-minutes each. This automatic start-up is still occurring as of today.

The pumps were operated once per month outside of hurricane seasons and once every two weeks during hurricane season. However, the pumps have not been operated since May 2018.

16. Were the gensets and hydraulic power packs winterized in preparation for an extended shut period?

The ICS was required to maintain readiness 365 days a year. No winterization or shut down preparations were performed. See questions 15 for more details.

17. Is the fuel contained in the bulk fuel tanks useable?

The stations were in operation as recent as May 2018. The most recent fuel analysis will be provided.

18. Please provide the date of the last fuel delivery to the bulk fuel tanks.

Fuel delivery to the bulk fuel tanks varied. See question 17 for more details.

19. Has the fuel contained in the bulk fuel tanks and machinery day tanks been stabilized?

The tanks have been treated with biocide. Water was drained from the tank bottoms as needed.

20. Reference Sheet ID’s B-100 to B-142. Is a plan view of the boring locations available for review?

No. Every boring is provided with a Latitude and Longitude location for the Contractor’s use.

21. Reference Sheet ID S-205. In order to understand the Governments expectations, please provide locations and quantities for each fence type illustrated.

Exact silt fencing and security fencing locations and quantities cannot be provided since they are performance criteria based and determined by the contractor’s construction means and methods.

See spec section 01 57 23.00 12 “Storm Water Pollution Prevention Plan” for silt fencing placement details and Spec section 01100 “General Provisions” paragraph 3(h) for security fencing details.

Security fencing is required to prevent access to the ICS structures and the area…
