USACE responses to Contractors’ Questions During Advertisement. Questions presented in black, responses in red.

1. Is this project sales tax exempt? If the project is sales tax exempt can the government provide a sales tax exemption certificate?

No.

2. Will the Government provide comprehensive written badging requirements for the project if badging is required?

No security badges will be required as entrance into secured facilities are not a part of this project.

3. Where will the designated parking area be for workers accessing the construction site?

Contractor shall use the two provided staging areas as he/she requires to complete the project. This can include parking for workers.

4. Will the Corps of engineers provide the train track bridging equipment or does the contractor need to supply it?

The Government will not be providing any equipment or material as part of this contract.

5. If the contractor needs to supply the bridging equipment, will the Corps provide a detail or preferred product to use for the train track bridging?

Contractor shall refer to contract drawings S-510, S-511, and S-512 for falsework plan, sections, and details.

6. The fly closes every day and has locked access. Will the contractor be able to access the site?

The contractor will be granted full and unencumbered access to the construction site through the right of entry provided by the Government.

7. Spec Section 01100, General Provisions

a. Para. 18(j), Inspection Services

i. Please clarify which rates & terms are applicable to this contract - the ones specified under this paragraph, or the ones located in Appendices under section 01 53 00.02 12, Railroad Work.

See amendment for clarification.

ii. Please clarify how partial days will be paid for railroad services due to weather & other shutdowns.

See amendment for clarification.

b. Para. 3, Safety Provisions

W912P8-16-B-0026, Amendment 0003

i. Please clarify if the SSHO is a stand-alone position, or if the SSHO can have collateral duties.

The SSHO may not have collateral duties. IAW EM 385-1-1, 01.A.17, the SSHO is a full-time responsibility, and he must be present at the site at all times work is being performed.

c. Para. 20, Access Plan

i. Please provide height & width restrictions, i.e. overhead power lines, for equipment & materials entering & traversing thru Audubon park access route.

See amendment for clarification on obtained clearances. Contractor should verify clearance requirements and coordinate with the necessary facility owners based on proposed access plan.

ii. Please clarify if the contractor will be allowed to mobilize cranes and other large equipment via the south entrance closest to work area, as long as traffic control is utilized for safety?

See amendment for clarification.

8. If access will not be allowed via south entrance, please provide contact information for temporary utility and structure relocations for large equipment access via Magazine Street entrance.

Width restrictions for the Audubon Park access road will be dictated by existing conditions at the site. Height restrictions for the Audubon Park access road will be dictated by existing conditions at the site. Power line clearance guidance is given in Section 11 of EM 385-1-1.

Sec 01100, paragraph 20, Access Plan, requires the contractor submit for review and approval a plan for mobilization and demobilization routing and locations of large equipment while on the job site. Sec 01100, paragraph 9(f) provides the Audubon Nature Institute point of contact as well as all other needed POCs. Sheet C-101 of the drawing set shows the government furnished access route to the job site.

9. Spec Section 01 45 04.00 10, Contractor Quality Control

a. Para. 3.4.2, CQC Manager

i. Please clarify if the superintendent can act as the CQC Manager.

The superintendent may not act as the CQC Manager. Sec 01 45 04.00 10, paragraph 3.4.2 states that the CQC Manager may not have any other duties than quality control.

10. Spec Section, 01 53 00.02 12, Temporary Retaining Structures:

a. Para. 3.4, Piezometers

i. Please clarify how many piezometers are required for this contract.

See amendment for clarification.

11. Spec Section, 01 53 00.03 12, Railroad Work:

a. Para. 1.8.3, Redundancy of Equipment

i. Please clarify the intent of this clause.

The intent of this clause is to provided NOPB assurance that this Construction project will not impact nor delay their daily (night time) track use, other than scheduled/coordinated track closure windows. Equipment or material within the NOPB ROW must be removed prior to the track scheduled use. See amendment for paragraph revision.

ii. Is it intended for the contractor to have a spare crane, spare pile hammers, and other spare equipment onsite?

The Government does not dictate Contractor means and methods. The contractor is responsible for knowing what equipment he/she will need on hand to meet the requirements of the specifications.

b. Para. 1.9.2, Contractor Responsibilities

i. Please clarify if all temporary pilings are to be cutoff and left in place under paragraphs (2) & (3).

See amendment for clarification.

ii. If so, please provide a cutoff elevation for:

1. Pipe Piles See amendment for clarification.

2. Sheet Piles See amendment for clarification.

12. Spec Section 01 55 26.00 12, page 3, Paragraph 1.5 states “During construction River/Riverview Dr will dead end at the limits of construction shown on the contract plans.

In doing so, River/Riverview Dr will have to temporarily become a two way street from Magazine to the limits of construction.”

See amendment for clarification.

13. HP14x73 pile schedule shown on S-102 extends to a total of 1989 LF of piling for the payment length. The bid item qty is 1,566 please advise.

The wrong version of S-102 was previously uploaded. See amendment for clarification.

14. Can the Gov takeoff qtys be provided?

Government does not provide computed quantities. Any discrepancies should be mentioned specifically so that we can investigate.

15. Wage rates provided are LA20150015- Highway. Typically, we see the “Heavy” wage rates on similar projects. Can you verify that this is the correct wage rate determination?

See the amendment for the correct wages rates.

16. Railroad questions(section 1100 and 01 53 00)-

a. The payment for line item 002AA and 002AB states that the day rate is based off of an 8 hr day. The “railroad flagging policy- NOPBR” provided states that the 8 hr day will be from

6:30 to 2:30. Inevitably, contractors will work longer than this. How will contractors be compensated to reimburse the railroad for the overtime? Would the Gov consider adding an overtime hourly rate line item?

An 8hr day is the standard language that the government uses for contracts of this nature.

There have been no issues with this approach previously.

b. 01 53 00.03 12; 1.1 Scope “the following items of work shall be performed by the Contractor and/or by the labor forces of the NOPB Railroad”. Can the Government clearly define what is the responsibility of the Contractor and what is the responsibility of the NOPB railroad (some items in this specification are not clear)? Ie. Will NOPB be performing labor as mentioned in the scope or materials only? Further, can the Gov clearly define what materials the railroad is providing?

See Amendment for clarification.

c. 01 53 00; 1.9.1- “the railroad companies will be reimbursed by the Contractor and will furnish all plant, materials, equipment and labor to perform the following work…” Please clarify how this will work. Will the Government provide an allowance for the railroad cost for the contractor to include in its bid?

No allowance. Turn in invoices to Contracting Officer for reimbursement per Amendment.

d. 1.9.2 item 7- contractor shall obtain all required permits of the railroad company. Typically, the Gov would get all ROW permits prior to letting the project. What permits has the Government not yet obtained that the contractor will need to obtain? The design guidelines and permit cost provided seem to deal with pipelines, which is not applicable in this case.

Government will provide ROW permit and no such pipeline permit is required.

e. S-510 precast sill. Can additional details be provide on the concrete sill (dimensions, resteel requirements, etc)? Is this a fabricated sill by a manufacturer or is the contractor to precast?

Is this to be supplied by NOPB?

Incorrect drawing uploaded. See Amendment for clarification.

17. 02 41 00 demolition- 3.1.4 states that pavement may be used in the discharge basin as rip-rap if approved by the KO. Where is the discharge basin located?

See amendment for clarification.

18. What is the required coating length on the sheet piles and hpiles?

19. See amendment for clarification.

20. Does the TRS items to remain require coating?

No coating requirements for temporary structures

21. Sheet C-502 lists 6” asphalt base material min under the asphalt parking lot. Please clarify if this is required to be a material allowed under surfacing (such as aggregate base) or a hot mix asphalt base.

Crushed Stone

22. In speaking w/ the LB foster representative, it appears all references to PZC 12 sheet piling must be a typo. Please clarify that this should be PZC13 as there is no PZC12.

See amendment for clarification.

23. Spec Section 01 53 00.03 12 page 4 " Track Work" states "Track work performed by the railroad company will be paid at the contract job price for "Track Work, NOPB" Price and payment shall constitute full reimbursement to the Contractor for all plant, equipment, labor and materials supplied by the Railroad Company to prepare subgrade, place ballast, and install rails and ties, for permanent tracks upon completion of each floodgate monolith, as well as adjusting existing tracks to accommodate the temporary falsework." There is no way to quantify what costs the railroad will be billing for this work. On previous USACE RR gate jobs (WBV 77 and WBV 79) this was a fixed dollar allotment on the bid item, set by the USACE and RR. Please Advise.

I have reviewed the specifications for WBV 75 and WBV 77 (I do not see a project WBV 79). In these specifications I see a note below the bid schedule regarding reimbursable work which I have added to this amendment. However, I do not see where a fixed dollar amount was established for this bid item. On WBV 77, which involved crossing 3 active tracks with a different railroad company, the contractor was instructed to estimate $500,000 for bidding purposes. No such assumed estimate has been established for this contract. Per the amendment, the Contractor shall contact the NOPB POC. And based on his/her means and methods, using the rates/quotes from NOPB, establish a bid estimate.

24. Will the roles of Flagman, Watchman and Inspection be done by the same person or will a separate person have each role?

See Addendum for Flagging requirements after Section 01 53 00.03 12. Requirements stated in Section 01100 have been revised in the amendment.

25. In previous USACE RR jobs (WBV 77 and WBV 79), the concrete sill beam has been precast to minimize down time for the RR and eliminate cure time. On drawings S-512 and S-510, it calls out a precast sill beam. On drawing, S-301 Sec. B it appears to be cast in place. Please Advise.

Some outdated details were uploaded. See amendment for clarification. Precast was used on other jobs as there did not seem to be a reasonable way to implement a cast-in-place sill.

With high early strength concrete, and coordinated track closure, a cast-in-place sill is the preferred application for this project. We cannot pre-approve design concepts; however, all reasonable Contractor designs will be evaluated.

26. What is the length of the coating on the sheet piles?

See amendment for clarification.

27. What is the length of the coating on the H-piles?

See amendment for clarification.

28. The quantities for H-pile and Tension Connectors listed on the Bid Schedule do not match the quantities shown on DWG S-102.

See amendment for clarification.

29. Detail D on DWG S-512, showing the Deflector Angle and Plate Detail is missing. Please provide the missing detail for these fabricated items.

See amendment for clarification.

30. Bid item # 0020 Ping, Steel Sheet Piles PZC-12 SSP is no longer available! We would recommend offering PZC-13 SSP as the alternate option. A spec sheet is attached for reference.

See amendment for clarification.

31. Bid item #0021 Steel H-piles. Estimated quantity looks somewhat lower than the actual takeoff of the drawings. (1,998 LF) See amendment for clarification.

32. Sht S-301 shows bent bottom seal plate & 4 x 4 x 3/8 bottom corner angle only (No vertical corner angles.) Sht S-508 shows vertical corner angles.

Embed angles are required at all locations that the rubber seal makes contact in the closed position. S-508 shows embed angles along the vertical face of each column. S-301shows the horizontal embed plate for the bottom seal.

33. Sht S-308 shows adjustable fascia plate assembly @ bottom seal. Sht S-509 shows 8 x 6 x 1/2 angle @ bottom seal Drawing revised. Fascia plate assembly on S-303 is correct.

34. Sht S-508 "Details 1 & 2" show a 1 3/4" diameter bulb on seal. Sht S-508 "Detail - Gate Seal" shows a 2 3/8' diameter bulb on seal See amendment for clarification.

35. Some drawings show 2 1/2" x 2 1/2" x 5" stop bars (4 places). Other drawings show 1 7/8 x 1 7/8 x cont. stop bar See S-508 for stopbar size and location. All locations should be consistent with S-508.

++Items not subject to the requirements of FAR 52.211-5001 VARIATION IN ESTIMATED QUANTITY.

Award will be made as a whole to one bidder.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED

TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE

DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR

AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized

W912P8-16-B-0026 00010-5 Ed 15-007 representative. NOV 14).

The Variations in Estimated Quantities Subdivided Items clause is applicable only in Item No 0002.

a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.

b. Where the actual quantity of work performed for Item No. 0002 are less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment in contract price shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity .

c. If the quantity of work performed under Item No. 0002 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were

Wage Rates Page 5 prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

Wage Rates Page 6

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:

Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

Wage Rates Page 7

The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.

3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:

Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

4.) All decisions by the Administrative Review Board are final.
