Award will be made as a whole to one bidder.

NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED

TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE

DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR

AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss

00010-9 Ed 13-005 the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 4: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor. The Government will exercise Optional Work 1 no sooner than 100 calendar days and no later than 200 calendar days after Notice to Proceed of this contract. The Government will exercise Optional Work 2 no sooner than 300 calendar days and no later than 500 calendar days after notice to proceed of this contract. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.

NOTE 5: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement.

Evaluation of options will not obligate the Government to exercise the option(s).

**If an option is to be exercised at the time of contract award in accordance with FAR 17.208, FAR clause 52.217-4 shall be used in place of FAR clause 52.217- 5.

NOTE 6: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF

OPTIONAL WORK. In the event that OPTION WORK items (Items 0099 through 0132) are exercised under the terms of the contract, the time required for completion of the contract will not be adjusted but shall be performed concurrent with the original contract duration of 1,500 calendar days established for the BASE WORK items specified in the Contract Clause entitled

“COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52-

211-10 – APR 1984)”.

SECTION 00130 – PROPOSAL EVALUATION CRITERIA

GENERAL

1.1 SCOPE

In accordance with FAR 15.304, the following factors will be considered in evaluating the non-cost aspects of the proposals. Narrative color descriptors have been selected to highlight the strengths and weaknesses of each Offerors proposal for each evaluation factor, paragraph 1.3 (items (1.) through (4.) below). In evaluating a contractor's proposal, evaluators must document the proposal's strengths and weaknesses. Using succinct, clearly stated narratives, evaluators will indicate the impact to the Government of the strengths and/or weaknesses, providing supporting facts and rationale. If the proposal exceeds the Government's expectations in relation to the evaluation criteria/standards, it forms the basis for "strength." If the proposal is below the Government's expectations in relation to the evaluation criteria/standards, it forms the basis for "weakness." A final narrative summary shall be employed when evaluating proposals in accordance with Section 00130 of the Request for Proposals.

This is a Request for Proposal (RFP). Proposals will be evaluated by a Source Selection Evaluation Board (SSEB) comprised of representatives of the Corps of Engineers. Award will be made to that Offeror, determined by the Government, who can accomplish the requirements set forth in the RFP in a manner most advantageous to the Government considering both cost and non-cost factors. The Government reserves the right to award this Contract to other than the lowest price Offeror after consideration of all factors.

The Government intends to evaluate proposals and award a contract without discussions. Therefore, Offerors shall submit their best terms from a cost or price and technical standpoint as Offerors may not be afforded an opportunity to revise their proposals.

1.2 SOURCE SELECTION USING THE TRADE-OFF PROCESS

The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical merit/quality and allows the Government to accept other than the lowest priced offer or other than the highest technically rated offer. The award decision will be based on a comparative assessment of proposals against all source selection criteria in the solicitation.

00130 - 2

1.3 EVALUATION FACTORS

1. Evaluation Factors:

TECHNICAL NON-COST FACTORS:

1. Past Performance

2. Technical Approach

3. Key Personnel and Project Management Plan

4. Small Business Participation Plan

COST FACTOR:

5. Price

1.4 RELATIVE IMPORTANCE OF PRICE TO THE TECHNICAL EVALUATION

FACTORS

The Government is concerned with striking the most advantageous balance between Technical Merit (i.e., quality and timeliness) and cost to the Government (i.e., price).

Where competing technical proposals are determined to be substantially equal, price could become the controlling factor.

EVALUATION CRITERIA

The Government will evaluate each of the four (4) non-cost factors and rate the proposals. Non- cost factors are not all equal in importance. The following terminology is used to describe the relative importance of each non-cost factor:

(1) SIGNIFICANTLY MORE IMPORTANT. This factor is of greater value than other factors. It is approximately twice as much as the next valued factor.

(2) SIGNIFICANTLY LESS IMPORTANT. This factor is approximately one-half (1/2) the value of the factor rated ahead of it.

(3) APPROXIMATELY EQUAL. The value is nearly the same as another factor;

any difference is slight and unimportant.

00130 - 3

Factors 1 and 2 are approximately equal in importance and are significantly more important when compared to Factor 3. Factor 4 is significantly less important than Factors 1, 2, and 3. Factors 1, 2, 3, and 4, when combined, are significantly more important than Factor 5, cost or price.

Factor 5, which is Price, may become more significant in contributing to the source selection decision if competing proposals offer approximately equal Past Performance and Technical Approaches and due consideration is given to Key Personnel and Project Management Plan and Small Business Participation Plan

(SBPP).

EVALUATION APPROACH

All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB). The overarching evaluation approach for all factors is as follows:

a. Adequacy of Response. The proposal will be evaluated to determine whether the Offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the RFP. The proposal will be evaluated to determine the extent to which each requirement has been addressed in the proposal in accordance with the proposal submission section of the

RFP.

b. Feasibility of Approach. The proposal will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable.

The proposal will be evaluated to determine the extent to which successful performance is contingent upon proven devices and techniques. The proposal will be evaluated to determine the extent to which the Offeror is expected to be able to successfully complete the proposed tasks and technical requirements within the required schedule.

1.5 DEFINITIONS:

1. Adverse past performance is defined as past performance information that supports a less than satisfactory rating from sources where the information is from other than formal rating systems such as "PPIRS or FAPPIS." (A best practice can be to discuss adverse past performance which caused a rating to be lowered to Satisfactory, or possibly Good.)

2. Best Value is the expected outcome of an acquisition that, in the

Government’s estimation, provides the greatest overall benefit in response to the requirement.

3. Clarifications are limited exchanges between the Government and

Offerors that may occur when award without discussions is contemplated.

00130 - 4

4. Communications are exchanges, between the Government and

Offerors, after receipt of proposals, leading to establishment of the competitive range.

5. Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.

6. Discussions are negotiations conducted in a competitive acquisition.

Discussions take place after establishment of the competitive range.

7. Due Diligence (Industry) - The process followed by prospective contractors to fully understand the government requirement in order to submit a complete, responsive proposal to the Government which will result in a successful acquisition. Methods may include such activities as conducting site visits, attending industry days, one-on-one sessions with the acquisition teams, pre- proposal conferences and responding to draft requests for proposals.

8. Due Diligence (Government) - The process followed by the

Government acquisition team to ensure all prospective contractors are as informed of the Government requirement and method of acquisition as possible in order to receive a reasonable number of competitive proposals from industry. Methods may include such activities as providing for site visits, conducting industry days, one-on-one sessions with interested vendors, pre-proposal conferences and sending draft requests for proposals to industry.

9. Evaluation Findings are the written observations/judgments regarding the individual merits of the proposal against the solicitation requirements.

10. Evaluation Notice (EN) is the PCO’s written notification to the Offeror for purposes of clarifications, communications, or in support of discussions.

11. Large Business means businesses determined other than Small

Business based upon industry size standards/NAICs codes. Includes:

Large businesses, State and Local Government and non-profit companies. May also include: public utilities, educational institutions, and foreign-owned firms.

12. Minor or Clerical Error is a minor informality or irregularity that is merely a matter of form and…
