1 Topic: Eelgrass Light Monitoring Section: 00 10 00 Subpart: Pricing Schedule

Note: Unit is square yardage (SY)
Section: 01 57 19.86 43 Subpart: 1.5 Measurement and Payment for Light Monitoring; 1.5.2 Measurement Note Language: The total quantity of light monitoring will be measured based on the square yardage that dredging is performed within the 250-meter boundary zone surrounding eelgrass.
Will the Government please further define the intended measurement and payment for CLIN0016 Eelgrass Light Monitoring (Reaches 5 through 9; Reaches 11 through 13)? For example, will the measurement be based on the actual dredge coverage, or some other method for calculating the area.
The measurement of light monitoring will be based on the square yardage that dredging in Reaches 5 through 9 and Reaches 11 through 13 is performed within the 250-meter boundary zone surrounding eelgrass. See Section 01 57 19.86 43.
2 Topic: SF-DODS Operations Section: 01 11 00 Summary of Work Subpart: 1.1.1 Requirements Note Language: Material to be dredged from Reaches 11 through 14 is suitable and shall be taken for placement at the Government-furnished site SF-DODS or at a Contractor-furnished upland beneficial reuse site.
Section: 01 57 19.99 43 Herring Spawning Observers Subpart: 1.3 Special Environmental Requirements Note Language: Any material dredged after November 30 in any year (if approved by the Government) shall be placed at an upland beneficial reuse site benefitting the aquatic species, as directed by the Government.

For all other locations, a proponent may plan a project that performs work outside the work window (e.g., from December 1 through May 31) if the project mitigates for potential impacts by placing the dredged sediment at a beneficial reuse site that NMFS agrees will provide aquatic habitat benefits, such as tidal wetlands restoration. (For the purposes of this consultation only the portion of the material that is dredged between December 1 and May 31 is required to be placed at the beneficial reuse site.) If a project is unable to place all of the material dredged outside the work window at a beneficial reuse site (e.g., due to equipment constraints or site availability), absent additional consultation, the project proponent will be required to provide an equivalent volume of material, deemed suitable for the purpose by DMMO, to a similar beneficial reuse site from a dredging project conducted inside the work window (June 1 to November 30) and not otherwise planned to go to a reuse site benefitting aquatic habitat. […] The placement of a like volume of dredged material at a beneficial reuse site must occur within 12 months of the end of the previous work window (i.e. November 30th).
The above language in the Biological Opinion listed under 1.3.4.1 Environmental Work Windows appears to provide justification for the Government to authorize the Contractor to take material to SF-DODS after November 30th.
This interpretation was confirmed by the Government for a past iteration of the project via RFI (W912P725B0001, RFI #2). What date does the Government anticipate NTP to be issued? Will the Government please confirm if authorization will be given for the Contractor to take material to SF-DODS after November 30th.
The Government anticipates NTP after an acceptable performance and payment bonds are received which usually happen around 3-4 weeks after bid opening. Contractor is authorized to take material to SF-DODS after November 30 in accordance with the Biological Opinion.
3 Topic: Herring spawning observer requirements Section: 01 57 19.99 43 Herring Spawing Observers Subpart: 3.1 Herring Spawning Observers Note Language: The biologist(s) must have a Bachelor of Science in Biology and experience with fish in the San Franciscy Bay.
Are other scientific degrees also acceptable, such as marine science or environmental science? And is there any wiggle room for a person without a biology degree but with fish spawning experience to be used?
An applicable degree with the word 'biology' in the title is acceptable (e.g., marine biology). Non-biology degrees are not acceptable. Prospective monitors may have an upcoming opportunity to gain experience to meet the requirement through a training with CDFW, USACE will send correspondence if a training gets scheduled.
4 Topic: FAR 52.223-2 Reporting of Biobased Products Under Service and Construction Contracts Section: 00 72 00 General Conditions FAR Clause 52.223-2
Upon careful review, the Contract does not set forth any minimum biobased content percentage for any product within any Biobased Product Category. Because the Contract will not involve the use of biobased products in USDA-designated product categories at https://www.biopreferred.gov or 7 CFR part 3201, we respectfully request that you remove FAR 52.223-2 from this Contract.
FAR 52.223-2 will not be removed.
