RFI # SPEC SECTION/DRAWING RFI QUESTION RESPONSES

1 Topic: Commencement, Prosecution, and Completion of Work Drawing: N/A Section: 00 72 00 Subpart: 52.211-10 Specification Language:

FAR 52.211-10 COMMENCEMENT, PROSECUTION,

AND COMPLETION OF WORK (APR 1984), states the following” The Contractor shall be required to (a) commence work under this contract within one (1) calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120 days after the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.” Please clarify the duration is 120 calendar days or working days.

120 calendar days

Period of Performance changed to 129 calendar days with AM0001.

2 Topic: Disposal Site Drawing: N/A Section: 35 20 24 Subpart: 3.6.2.10.1 Specification Language: "...all ocean disposal operations, including transport to and discharge at SF-DODS, must cease by midnight of November 30 in any year. The Contractor is prohibited from disposing dredged material at the SF- DODS after November 30 without authorization from the Contracting Officer or delegated representative"

The contract specification designated that material from reaches 11-13 are suitable for disposal at SF-DODS, yet the contract also specifies that dredged material is prohibited from disposal at SF-DODS after November 30 without authorization from the Contracting Officer. What date does the USACE expect the NTP to be issued? Will authorization to take material to SF-DODS be given on this project. If so, to what date will the contractor be authorized to take material to SF-DODS.

Estimated NTP date is around 09 December 2024.

Yes, Contractor is authorized to take material to SF-DODS after November 30 accordance with the 2015 Biological Opinion. The following paragraph is included on page 537 of the specification:

"Projects may plan work for the period outside the work window (December 1 through May 31) provided the project mitigates for its impacts by placing dredged material at a beneficial re-use site, such as tidal wetlands restoration site. If a project is unable to place all material dredged outside the work window at a beneficial re-use site, the LTMS Program measures allow for an equivalent volume of dredged material to be placed at a beneficial re-use site from a project conducted within the work windows during the following season."

The contractor shall complete the dredging work including reaches 11 through 13 within the performance period specified for the project.

3 Topic: Herring Observers Drawing: N/A Section: 01 57 19.99 43 Subpart: 1.3 and 3.1 Specification Language: "The contractor shall provide to the Government herring observer resumes no later than 12 November in any year if dredging is expected to occur after November 30."

Herring observer resumes are due at the time of quote on November 12th, 2024. Can you advise as to whether resumes should be included with the quote package? Or will environmental consultants be able to submit resumes beyond this deadline? Would resumes that were approved for FY23 be considered acceptable for work if additional approvals were required?

Resumes for the herring observer due date is extended from November 12th to November 15th. Please see AM0001.

Resumes approved for FY23 herring observers are considered acceptable for FY24 work.

4 Topic: Disposal Site Drawing: N/A Section: 35 20 24 Subpart: 3.6.2.10.1 Specification Language: "The Contractor is prohibited from disposing dredged material at the SF-DODS after November 30 without authorization from the Contracting Officer or delegated representative."

We would like clarification on our last RFI (RFI#2 above).

The response stated that “the contractor is authorized to take material to SF-DODS after November 30th in accordance with the 2015 Biological Opinion,” citing the opinion on page 537 of the solicitation. Yet the opinion states that “dredging projects may plan work for the period outside the work window (Dec 1 through May 31) provided the project mitigates for its impacts by placing dredged material at a beneficial re-use site.” To our knowledge, SF- DODS is not considered beneficial reuse site.

Additionally, Section 35 20 24 – Aquatic Disposal states “The Contractor is prohibited from disposing dredged material at the SF-DODS after November 30 without authorization from the Contracting Officer or delegated representative.” (Page 320 of the solicitation). We wanted to reiterate our question, will the contractor have authorization to dispose material in SF-DODS after the November 30th date as outline in the LTMS and Contract Specifications? If the contractor will be authorized to take material to SF-DODS past the November 30th date, to what date can the contractor expect that authorization to lapse?

As stated in our response to RFI 2, "… If a project is unable to place all material dredged outside the work window at a beneficial re-use site, the LTMS Program measures allow for an equivalent volume of dredged material to be placed at a beneficial re-used site from a project conducted within the work window during the following season."

Placement at SF-DODS after November 30 is authorized, and mitigation will be achieved with a separate project conducted during the following season as described in the bold text above.

As stated in our response to RFI 2. Yes, Contractor is authorized to take material to SF-DODS after November 30. There is no lapse date.

AM0001 issued to delete paragraph 3.6.2.10.1 Restriction on Disposal Timing from Section 35 20 24.

The intent of this section is to provide questions & comments received from interested parties on the above solicitation, and our responses to those questions and comments. It is possible that the information below does not reflect 100% of the questions and responses. The questions and comments do not necessarily represent questions received from any particular contractor.

Questions and responses are provided for information only and are not made part of the solicitation. Only a formal amendment (SF30) to the solicitation changes the solicitation.

Changes to any previous responses in this document will be struck-through and new, updated responses will be provided.
