PART 1 GENERAL

ER 415-1-17 (2012) Construction Contractor Performance Evaluations

1.2 PROJECT DESCRIPTION

The work includes the underwater relocation of debris objects in the MOTCO areas.

1.2.1 Requirements

a. Relocate 16 debris objects in Area B to the relocation area as stated in Section 00 10 00 PRICING SCHEDULE and Plan Sheet C-102 for acceptance.

b. The relocation area is located near Area B and is shown on Plan Sheet C-102.

c. The environmental window is from 1 August to 30 November.

d. If option CLIN 0003 is exercised, then the contractor shall relocate 8 debris object from Area B to the relocation area as stated in Section 00 10 00 PRICING SCHEDULE and Plan Sheet C-102.

e. If option CLIN 0004 is exercised, then the contractor shall relocate 1 debris object from Area C to the relocation area as stated in Section 00 10 00 PRICING SCHEDULE and Plan Sheet C-103.

f. If a debris object cannot be lifted per the specified constraints, cannot be found in the location shown on the plan sheets or breaks apart during the debris relocation operations, then contractor shall notify the Contracting Officer or designated representative immediately.

g. Minimize interference with the use of MOTCO areas. MOTCO Traffic:

The MOTCO areas are used by MOTCO police and fire boats and ships with drafts up to 32 feet, which may cause some interference with contract operations. The Contractor shall conduct the work in such a manner as to obstruct navigation as little as possible, and in the event the Contractor's plant so obstructs the MOTCO areas as to make difficult or endanger the passage of any vessels, the plant shall be promptly moved on the approach of any vessel to such an extent as may be necessary to afford a practicable passage. W912P724B0006 plant may also be based on the determination of the docking pilot if vessel traffic requires it.

h. The contractor shall coordinate with the Contracting Officer's Representative (COR) regarding the schedule of the MOTCO transport ships that could moored at the MOTCO piers during the debris relocation operations.

1.2.2 Constraints

a. The debris objects must be relocated while remaining underwater. At no point shall the objects surface.

b. The debris objects shall not be dragged or pushed along the bottom of the MOTCO areas to the relocation areas.

c. The contractor shall not cut holes or weld in the debris objects during the debris relocation operations.

d. Magnets shall not be used during the debris relocation operations.

1.3 MEETINGS

1.3.1 Preconstruction Conference

After award of contract, a preconstruction conference will be held at such time and location as determined by the Contracting Officer or delegated representative for purposes of discussing and developing mutual understanding between the Contracting Officer or delegated representative and the Contractor's Representatives regarding the terms, conditions, and requirements of the contract. Members of the conference from the Government will include the quality assurance staff, the Contracting Officer or delegated representative, the Government environmental manager,safety, and construction staff. Members from the Contractor shall include the chief hydrographic surveyor, site safety health officer, and the quality control staff. The discussion will include, but will not be limited to, the following:

-Contractor supervisory and quality control project staff

-Correspondence procedures

-Accident Prevention Plan

-Environmental Protection Plan and Pollution control program

-Quality Control and Hydrographic Surveying

-Project scheduling and payment procedures

-Resident Management System (RMS-QC)

-Other subjects that may be of interest to the contracting parties

-Schedule of Weekly Meeting

1.4 CONTRACTOR PERFORMANCE EVALUATIONS

The Contractor's performance shall be evaluated using the Construction

Performance Assessment Reporting System (CPARS) in accordance with Subpart

36.201 (Evaluation of Contractor Performance) of the Federal Acquisition Regulation and ER 415-1-17 . The Contractor may access, review, and comment on the evaluation for a period of 60 days. Accessing and using CPARS requires Public Key Infrastructure (PKI) certification. The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. This certification is purchased from an External Certificate Authorities (ECA) vendor. Contractor access to CPARS is required for Contractor to participate in the performance evaluation process. PKI certification is the sole responsibility of the Contractor. Current information about the PKI certification process and known PKI vendors can be found at the following link:

1.5 PERMITS

The Contractor shall obtain and comply with all licenses and permits required by Federal, State, and local laws, codes, and regulations unless otherwise specified in these contract documents.

a. The following permits have been obtained by the Government and are attached to these specifications:

(1) Department of the Army Nationwide Permit (NWP) 22 - Removal of Vessels - File Number SPN-2023-00434

(2) San Francisco Regional Water Quality Control Board Project NOA

(3) Cultural Resources Treatment and Discoveries Plan

The Contractor shall comply with these requirements and provisions in these contract specifications included in Sections TEMPORARY ENVIRONMENTAL

CONTROLS 01 57 19.

1.6 PUBLIC SAFETY

1.6.1 General

The Contractor shall provide guard personnel as required to provide protection in the interest of public safety. Whenever the Contractor's operations create a condition hazardous to the public, he shall furnish at his own expense and without cost to the Government, such guards as are necessary to give adequate warning to the public of any dangerous conditions to be encountered, and he shall furnish, erect, or maintain such lights, signs and other devices as are necessary to prevent accidents and to avoid damage or injury to the public. Flagmen and guards, while on duty and assigned to give warning to the public that the debris relocation is being accomplished, and of any dangerous conditions to be encountered as a result thereof, shall be equipped with appropriate safety equipment and a red flag. Signs, flags, lights, and other warning and safety devices shall conform to applicable city, county, and state requirements. Should the Contractor appear to be negligent in furnishing adequate warning and protective measures, the Contracting Officer or delegated representative will direct attention to the existence of a hazard, and the necessary warning and protective measures shall be furnished and installed by the Contractor without additional cost to the Government. The installation of any general illumination shall not relieve the Contractor of his responsibility for furnishing and maintaining all devices necessary to

W912P724B0006 provide protection to all parties concerned. As part of the best practices, the contractor is highly encouraged to hold a safety meeting, open to the general public, at a venue frequented by the boating community to proactively inform and receive feedback from the public of the upcoming debris relocation work and task timelines.

1.7 PUBLIC UTILITIES AND PRIVATE IMPROVEMENTS

The Contractor shall take care to preserve and protect any existing utilities or features improvements from injury or damage during construction operations. All damages shall be promptly repaired or replaced by the Contractor. The Contractor shall notify the Contracting Officer or delegated representative immediately if any utility or structure has been damaged by the Contractor. The Contractor shall assume full responsibility for reimbursing the owners for any damage to their properties, utilities, or improvements, or interference with their services caused through the debris relocation operations. The Contractor is not relieved from the responsibility set forth in "FAR 52.236-3, Site Investigation and Conditions Affecting the Work" except as provided above.

1.8 SAFETY OF STRUCTURES

The Contractor shall use reasonable and proper care in the execution of the work to assure the stability of piers and other structures lying on or adjacent to the site of work, insofar as they may be jeopardized by the debris relocation operations and on account of moving or mooring of equipment. The Contractor shall make good all damages resulting from the moving and mooring of equipments and from debris relocation operations insofar as such damages may be caused by variations in locations.

1.9 MARINE GEOPHYSICAL SURVEY

A geophysical survey was conducted in 2023. The survey report is attached at the end of the specifications package.

HYDROGRAPHIC SURVEY

PART 1 GENERAL

1.1 INTRODUCTION

This section provides procedural, technical, and quality requirements for hydrographic surveying to be performed under this contract. Unless otherwise indicated in this contract, each required service shall include field-to-finish effort performed in accordance with the standards and specifications in EM 1110-2-1003.

1.1.1 Payments

Work included in this section of the specifications for which no specific contract line item is included in the Pricing Schedule of the contract shall be considered an associated subsidiary obligation. No separate payment will be made for associated subsidiary obligations.

1.2 TECHNICAL CRITERIA AND REFERENCE STANDARDS

All parties shall comply with the procedures, standards and quality control criteria in EM 1110-2-1003 in performing hydrographic surveys for this contract.

1.3 WORK TO BE PERFORMED

The types of surveys to be performed under this contract are listed in the paragraphs below.

1.3.1 Before-Relocation Survey

A survey to be done before the debris relocation begins will be referred as a Before-Relocation (BR) Survey. The BR Survey used for volume computations will be selected by the Government. The Government will perform a BR survey for each area of the entire project. 208 khz multi-beam survey equipment shall be used for all BR Surveys. The

Government will provide the Contractor copies of the BR Survey data files.

The Government may elect to use the Contractor survey as the BR Survey.

1.3.2 After-Relocation Survey

A survey to be done after the debris relocation is completed will be referred as an After-Relocation (AR) Survey. 208 khz multi-beam survey equipment shall be used for all AR Surveys. The AR Survey used for volume computations will be selected by the Government. The Government may elect to use a Contractor Survey as the AR Survey. Government will perform AR Surveys as soon as practicable after receipt of a Request for Government Survey. The Government will provide the Contractor copies of the AR Survey as soon as practicable after the completion of the survey.

1.3.2.1 Request for Government Survey

The Contractor shall notify the Government 3 working days in advance of completing the debris relocation. The Contractor shall submit in writing a Request for Acceptance Survey in Attachment 2 at the end of the Specification package

1.3.3 Quality Control (QC) Surveys

Surveys conducted by the Contractor will be referred to as Quality Control or QC Surveys. QC Surveys shall be conducted at least once per week during weeks in which there is debris relocation. All raw and edited survey data shall be submitted to the Government. When directed by the Contracting Officer Representative, the Contractor shall perform QC surveys and provide cross-sectional views of the edited, tide-level adjusted survey data to the Government on site. The Contractor shall provide print outs of the cross-sectional plots on site.

1.3.4 Progress Payment Survey

The Contractor shall conduct QC Surveys for progress payments. Surveys conducted for the purpose of progress payments will be referred to as Progress Payment Surveys. The Government shall be informed about Contractor surveying activities, including provisions for onsite Government observers. The Government will have the option of accompanying the Contractor on these surveys.

1.3.5 Quality Assurance (QA) Survey

The Government may perform QA surveys to assure the quality of the debris relocation operations, and the quality of the Contractor's QC surveys.

1.4 SUBMITTALS

Government approval is required for submittals with a "G" designation.

Submittals not having a "G" designation are for information only. The following shall be submitted in accordance with the submittal requirements of these specifications.

1.5 EQUIPMENT DATA

Prior to the start of debris relocation operations, Contractor shall submit data on the surveying equipment. Typical information shall, as a minimum, include the name, model, and year of manufacture of the electronic equipment, the electronic frequencies of the horizontal positioning and depth finding equipment, and the manufacturer's stated positioning accuracy and capability of the equipment proposed for usage.

The vessel/equipment that performs a survey shall be recorded in the Survey QC Log, Attachment 1 at the end of the Specification package.

1.6 SOFTWARE

Prior to the start of debris relocation operations, the Contractor shall submit data on the surveying software. Use site design or survey software in the integrated hydrographic survey system. Provide the government the software, software license, and any other entity necessary to allow the government full access in reviewing the raw and unedited data described in paragraph 1.7.2.

1.7 SURVEY DOCUMENTATION SUBMITTAL

A Survey Documentation Submittal shall be submitted by the Contractor for every survey. The report shall include the items such as: scope of work, tidal data, general site plan map, line designation map, calibration procedures used, horizontal and vertical accuracies, and any other pertinent information to describe the purpose, methods, and results obtained.

Survey procedures, data collection equipment, methods and densities, and equipment calibration for this work shall follow the criteria given in EM 1110-2-1003 for class of survey specified in task orders to this basic contract.

Survey QC Log (Attachment 1): The Contractor shall complete a Survey QC Log for all Contractor-performed surveys. The Survey QC Log shall be completely filled out. The Survey QC Log shall be included with the electronic submission and a copy shall be attached to the Daily (QC) Report.

The Basic Survey Documentation Submittal shall also include the following:

1.7.1 Survey Report : The survey report shall include the results of surveys conducted before and after the debris relocation work.

1.7.2 Electronic Copies of Surveys : Contractor shall provide a full electronic copy of every survey. Electronic copies shall include point files (.XYZ format), results of calculations (TIN Report), and a plot of the soundings. All raw, unedited data, along with all files and associated data used for editing, along with a copy of the survey documentation, updated as necessary, shall be submitted in RMS to the Government. All

W912P724B0006 electronic survey data shall contain a string of information in the title that clearly identifies the contents of the data. The string shall uniquely identify the project and reach. The Contractor shall provide a description of any changes that have been made to the originally submitted survey documentation. Contractor may use web-base secure "sharepoint" file server systems, such as DoD SAFE, to transmit survey data files electronically to the Government.

3.1 SURVEYING PROCEDURES

3.1.1 Horizontal Positioning Procedures and Accuracies

The Contractor and Government vessel positioning systems and/or modes utilized on this contract shall conform to the allowable horizontal positioning criteria in EM 1110-2-1003, based on the class of survey required. The Contractor may be required to demonstrate to the Government that his positioning system, mode, and/or procedures are capable of meeting the accuracy requirements in EM 1110-2-1003.

3.1.1.1 Positioning

Positioning shall be accomplished by a fully integrated and automated hydrographic survey system utilizing a standard to the industry Differential Global Positioning System (DGPS) with a manufacturer's stated positional accuracy of one (1) meter or less. DGPS corrections shall be obtained from the same geostationary satellite station or base station for all surveys. Alternately, Real Time Kinematic (RTK) Differential GPS may be used to obtain accurate, real-time horizontal positioning.

3.1.2 Reference Horizontal Control Data

Unless otherwise indicated, the Government will provide sufficient existing project control from which hydrographic surveys may be extended.

This control shall be presumed to meet the accuracy requirements in EM 1110-2-1003. When hydrographic surveys are required to be controlled from particular existing monuments, this will be noted in the drawings furnished. All horizontal and vertical monuments are known to be in-place as of the date shown on the drawings. Descriptions for each point are in the contract drawings. The Contractor's field representative shall immediately notify the government's Contracting Officer Representative if existing control points have been disturbed.

3.1.3 Vertical Reference Datum

Tide Monitoring. The Contractor shall provide an approved tidal level monitoring system. This system shall be adjusted to correspond with the documents. Real Time Kinematic (RTK) Differential GPS may be used to obtain accurate, real-time elevations (depths) without observing tidal data.

3.2 CONTRACTOR SURVEY CERTIFICATION

3.2.1 Contractor Representative

Contractor may provide a representative on board the Government survey vessel for all BR and AR surveys. Contractor representative shall be knowledgeable of hydrographic surveying procedures, techniques, equipment, calibration methods and accuracy limitations. Contractor representative shall observe and review, the adequacy and accuracy of the survey for payment purposes and for the potential existence of collusion, fraud or obvious error in the data. The onsite review shall include a comparison of the Government survey data and the Contractor survey data for the same area.

3.2.2 Survey Certification

Immediately upon completion of a BR or AR survey, Contractor representative shall attest to an acceptable survey by signing the Certification of Government Survey, Attachment 2 to this section. This certification will be based on the Contractor representative onsite review of the survey and determination that the survey contains no evidence of collusion, fraud or obvious error.

3.2.3 Unacceptable Survey

In the event the Contractor representative observes (and quantifies) specific documentary evidence of collusion, fraud or obvious error, the Government survey will be immediately rerun. Likewise, in the event the Government observes specific documentary evidence of collusion, fraud or obvious error, the Contractor will immediately rerun the survey. The resurvey will be run over the full debris relocation area and will supersede previously run surveys in their entirety. If the resurvey is unacceptable, the Contractor shall meet with the Government to expeditiously resolve issues causing rejection of the survey.

3.2.4 Reinstating Unacceptable Survey

Contractor may certify a survey previously judged unacceptable; however, Contractor shall reassess/reevaluate within 24 hours after the unacceptable survey was performed and prior to the initiation of a resurvey based upon identified collusion, fraud or obvious error.

GENERAL

This project requires Unexploded Ordnance (UXO) qualified personnel to perform Munitions and

Explosives of Concern (MEC) construction support in the Port of Chicago Explosion Area. The Port of

Chicago Explosion Area Munitions Response Area (MRA) contains two Munitions Response Sites (MRS);

the Terrestrial Explosion Area and the Port of Chicago Water Explosion Area. Provide MEC detection and response actions within the Port Chicago Explosion Area MRA/MRS that are applicable to the project.

Both the Water Explosion Area MRS and the Terrestrial Explosion Area MRS have a “moderate to high” probability risk rating and have not been completely cleared of Munitions of Explosive Concern (MEC).

The area in both MRS' where no MEC clearance operation have taken place, remain at a “moderate to high” probability risk rating, and unless stated otherwise, the contractor must assume the moderate to high probability rating applies.

Select areas have had MEC clearance operations completed in advance of construction projects or portions of a construction project. These portions, if cleared to the full depth of construction work, can proceed with a “low” probability risk rating with USACE Ordnance and Explosive Safety Specialist (OESS) approval.

All MEC Support will be in accordance with the requirements of the U.S. Army Corps of Engineers

(USACE)Explosives Safety and Health Requirements Manual EM 385‐1‐97, EM 200‐1‐15, Department of

Defense Explosive Safety Board (DDESB) Technical Paper (TP) DDESB TP‐18, DDESB TP‐16, and the

MOTCO Explosive Safety Submission, and MOTCO Explosive Safety Submission Amendment with applicable amendments. Provide all necessary MEC coordination and communication with USACE and

MOTCO.

Smoking is only allowed at MOTCO’s designated smoking areas. There are only 3 authorized areas within the MOTCO MRS. Additionally, no smoking is permitted within 50 feet of potential ordnance or explosives.

Divers within the MOTCO MRA have the potential to come in contact with MEC during constructions support. The divers must be either DDESB TP‐18 qualified MEC Divers, or the area must be cleared to depth of work by qualified MEC Divers prior to non MEC divers entering the area.

All diving must comply with EM 385‐1‐1, and EM 385‐1‐97. Contact the Sacramento Designated Dive

Coordinator (DDC) as soon as possible after the contract is awarded for checklists that must accompany submittals.

PROJECT PLANNING

Set‐up and planning as follows:

Prepare the MEC construction support Work Plans (WP) and the Stand Operating Procedures (SOP) to supplement the Prime Contractor’s WP. Provide MEC APP/SSHP IAW EM 385‐1‐97 and EM 385‐1‐1. For clearances Provide Work Plans and SOP’s IAW EM 200‐1‐15.

If the contractor is to use diving operations to support the work, they are to submit Dive Operation Plan, Safety Management Plan, Emergency Response Plan, Equipment Certifications, Diver qualifications per

Section 1.7 Special Qualifications of this document, SOPs/WP, and completed SPK diving submittal checklists.

Acquire information including:

a. Historical data.

b. Utility maps.

c. After Action Reports for the recent MRS munition response actions.

d. Record drawings of MEC clearances in their work area provided with a low probability risk rating.

e. Any other pertinent background information.

f. Furnish MEC detection and response capabilities prior to intrusive activities within the MRS, and

UXO Construction Support.

g. Obtain federal, state, and local permits and approvals required to perform the MEC construction support work and MEC demilitarize operations.

Provide After Actions Review (AAR) report of MEC Response Action (Disposal, MDAS, demilitarize, and clearance) within 30 days of the completion of the operation.

The MEC and/or Diving sub‐contractor must be allowed to directly communicate with USACE OESS/DDC to ensure rapid safe communication.

PROJECT MANAGEMENT

Provide project oversight and coordination to ensure that the project schedule is maintained and that project submittals and field work are completed in accordance with project requirements.

MEC SUPPORT NOTIFICATION

Notify the Government a minimum of [30] days prior to the start of MEC construction support operations. Deliver MEC support work notifications to the USACE Sacramento District Designated

Ordnance and Explosives Safety Specialist (OESS), the Alternate OESS, and the MOTCO Safety Officer.

Provide DDESB TP‐18 qualification certificates to OESS 10 days prior to work starting.

All related and required submittals need to be accepted before ANY MEC support work begins and

No cutting, welding, or modification of Large Object Debris that causes damage is permitted per Spec 01

11 00.

Divers in contact with the subsurface mudline must be UXO qualified until the area is cleared of explosive hazards to the depth of work.

The UXOQCS and UXOSO may be ‘dual‐hatted’ with other responsibilities if there are less than 15 personnel on site with OESS approval. If combined, this person is to remain on‐site at all times during field operations.

All equipment operators of Load Handling Equipment (LHE), Earth Moving Machinery (EMM), or riggers to be certified by the Contractor on Eng Form 6209 as per EM 385‐1‐1.

All workers, tradesman, and project delivery team that will work within the MEC project site are to have documented MEC safety, awareness, and recognition training to include the 3R training. Training will be provided prior to work on site by a UXOT or OESS.

MEC Construction Support

Large Object Debris relocation:

If Large Object Debris will remain below the water line then the crew and equipment do not need UXO protective safety measures listed in the ESS (2020) Frag Data Sheet.

If Large Object Debris is to breach the water surface then UXO protective safety measures are required as wells as qualified UXO personnel, and all other documentation needed for UXO construction support listed in this specification.

If Large Object Debris is remaining below the waterline and UXO/MEC is discovered by Remote Operated

Vehicle or UXO qualified divers the UXO/MEC does not need to be recovered or demilitarized. Mark the approximate location, photograph with fiducial, and identify if possible by nomenclature. UXO/MEC will be recovered and demilitarized during dredging operations. Notify OESS of discovery and document in daily report and after actions report.

If Large Object Debris is being moved, at no time should a occupied vessel be over the large object, unless cleared by UXO divers or ROV. If an explosion was to occur directly beneath the vessel it could cause catastrophic damage to the vessel/personnel.

If a UXO is intertwined with underwater large object debris, report to OESS and Project team to decide a path forward with the following information if possible:

a. Determine UXO type.

b. Determine fuzing.

c. Determine if acceptable to move and if capable of being separated from large object debris.

MEC clearance to depth of work is the process of a TP‐18 qualified UXOT searching for MEC with a magnetometer, or if too close to other ferrous objects a visual and/or tactile hand clearance of the area needs to be performed. The clearance needs to be completed in one‐foot lifts as the excavation/jetting proceeds below the mud line to the final depth where the work must be performed, such as rigging straps under an object. The area only needs to be cleared where the work is being performed, not the entire length and depth of the object.

During clearance to support work, if a MEC item is discovered, if possible, relocate the work to another location. If work must occur in the location of the MEC item photograph, determine UXO type, and fuzing. Item will be evaluated per Contractors Work Plan to determine if the item is acceptable to move.

If acceptable to move relocate the item out of the work area (item to remain underwater), mark the location, and report to OESS. If item cannot be moved, report to OESS who will coordinate with Navy

EOD.

Contractor generated hazardous waste is materials that, if abandoned or disposed of, may meet the definition of a hazardous waste. These waste streams would typically consist of material brought on site by the Contractor to execute work but are not fully consumed during the course of Contractor work activities. Examples include, but are not limited to, excess paint thinners (i.e., methyl ethyl ketone, toluene), waste thinners, excess paints, excess solvents, waste solvents, excess pesticides, and contaminated pesticide equipment rinse water.
