About this file

This document is an amendment to a solicitation for the Pajaro PL 84-99 Site 3 Repair project. The amendment revises specification sections to provide additional requirements for biological surveys, fish relocation, and the timing of in-water construction work. Specifically, it adds language on incorporating raptor perch deterrents on project fencing and notifying the contracting officer of biological surveys 72 hours in advance. It also modifies the allowed timing for in-water work to be between June 1 and September 30, provides more details on dewatering and fish removal requirements, and specifies a two-tiered approach using fish herding and capture/relocation to be overseen by a qualified fisheries biologist.

Pajaro River PL 84-99 Site #3 PAJPL8499SITE3 Amendment 0004

j. The Contractor shall incorporate raptor perch deterrents on all fencing in the project area to minimize raptor predation on listed species.

k. The Contractor is responsible for notifying the Contracting Officer 72 hours in advance of performing biological surveys to allow sufficient time for Government Environmental Planner to also attend the survey.

3.1.5 Contact Information

The Contractor shall report all sightings of ESA-listed species to the Contracting Officer.

3.1.6 Aquatic Species

For construction of the project features that extend into the water where South-Central Coast California Steelhead or Tidewater Goby may be present, the Contractor shall perform construction activities only between June 1 and September 30 unless otherwise approved by the Contracting Officer.

Within this window, work below the water line shall be performed under dewatered conditions. Refer to the project specific Dewatering Plan for detailed requirements for in-water work. Allowed in water work includes installation or removal of a sheet pile wall, knockdown dredging, and dewatering the area behind the sheet pile wall. Dewatering cannot begin before fish are removed from the area to be dewatered.

3.1.6.1 Fish Relocation

A two-tiered approach must be used to minimize the adverse effects on fish from the in-water construction work. The two approaches are the following:

1) fish relocation through herding and 2) fish capture and relocation.

Ideally, only the first approach should be used as it is the easiest to implement and is expected to have the lowest impact to fish. It is possible that a combination of the methods may be necessary during the in-water work. The two methods are discussed in detail below.

3.1.6.1.1 Fish Relocation Through Herding

If fish relocation needs to be performed, a qualified fisheries biologist must oversee the work at all times. The qualified fisheries biologist must first be approved by the Contracting Officer via resume submittal which shows experience with surveying fish to genus and species and relocating fish using seining and transport via buckets.

1. A qualified fisheries biologist must first survey the area to be dewatered to determine if fish are present. If fish are present and the water depths and substrate allow for seining, an appropriately sized seine that covers the width of the area must be used and the seine pull must begin as close to the shore on one side as is feasible and pulled to the opposite side to ensure the majority of the fish are captured in the seine net. A minimum of three seine pulls must be performed.

a. Seining With an Opening in the Sheet Pile Wall:

The seine may be pulled through an opening of the sheet pile wall which should be of sufficient width so as to not injure fish as they are pulled through the opening, and then the seine net should be held in place blocking the sheet pile opening to ensure no fish reenter the area to be dewatered behind the sheet pile wall, and must be held in place blocking the entire sheet pile opening until a temporary block net can be installed.
