The w ork includes maintenance dredging of the San Rafael Creek to -6-ft (MLLW) plus 1 ft of paid overdepth and San Rafael ATF to -8-ft (MLLW) plus 1 ft of paid overdepth and transporting of the dredged material to the Governmentfurnished site SF-10 and SF-DODS.

This requirement is a small business set-aside. It w ill be issued as an Invitation for Bid (IFB) w hich w ill result in the aw ard of a single Firm Fixed Price contract.

The Contractor shall furnish all plant, labor, material, equipment, etc., necessary to perform all work in strict accordance with the terms and conditions set forth in the contract to include all attachments thereto.

The term "Job", which appears on the Pricing Schedule (Section 00 10 00) under “Unit” for Bid Item No. 0001 shall be considered as a Lump Sum. The Variation in Estimated Quantities contract clause, FAR 52.211-18, shall not apply to Bid Item No. 0001.

BASIS of AWARD: The contract will be awarded in accordance with FAR 52.214-19 Contract Award – Sealed Bidding – Construction. Award will include BASE plus OPTION. OPTIONS will be evaluated based on FAR 52.217-4 Evaluation of Options exercised at the time of contract award.

The Government reserves the right to direct the Contractor to place dredged material at an environmentally acceptable alternate disposal site in accordance with the Change Clause FAR 52.243-4.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 1 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 134 calendar days later.

The time stated for completion shall include final cleanup of the premises.

PART 1 GENERAL

1.1 PROJECT DESCRIPTION

The work includes maintenance dredging of the federal navigation channel in San Rafael Creek and Across the Flats, which cannot begin before 1 June in any year.

1.1.1 Requirements

a. Dredge the San Rafael Creek Channel to -6-ft MLLW and the San Rafael Across the Flats to -8-ft MLLW for acceptance.

b. The environmental window is from 1 June to 30 November. The environmental window is from 1 June to 30 November. The period of performance allotted for this project is expected to allow for the completion within the environmental window. If the Contractor determines and documents that completion cannot be accomplished within the window the Contractor shall notify the COR in writing, and the Contracting Officer or delegated representative will make a determination if dredging past the window is allowed. The Contracting Officer or delegated representative shall approve or deny the extension in writing.

c. The contractor shall place dredged material from Reaches 0, 1, 2 and 3 at the Government-furnished in-bay disposal site SF-10.

d. If optional bid item 0004 is exercised, then the contractor shall place dredge material from reach 4 at the Government furnished ocean disposal site (SF-DODS).

e. The Contractor shall attend a meeting with the USEPA Region 9 representative prior to the start of dredging operations regarding the use of the Government-furnished deep ocean disposal site SF-DODS unless the Contractor has attended a similar meeting within the previous 3 years.

f. Scow Certification is required for ocean disposal operations. The Contractor shall complete the Scow Certification Checklist and have it certified by the Government.

1.1.2 Constraints

a. Hopper dredging is prohibited for this project.

b. Regular working hours for reaches 3 and 4 (San Rafael Creek) are between 7 a.m. and 7:00 p.m., Monday through Saturday. Regular working hours for reaches 0, 1 and 2 (San Rafael Across the Flats) are 24 hours a day, 7 days a week.

1.2 MEETINGS

1.2.1 Preconstruction Conference

After award of contract, a pre-dredging conference will be held at such time and location as determined by the Contracting Officer or delegated representative for purposes of discussing and developing mutual understanding between the Contracting Officer or delegated representative and the Contractor's Representatives regarding the terms, conditions, and requirements of the contract. Members of the conference from the Government will include the quality assurance staff, the Contracting Officer or delegated representative, the Government Environmental Manager and construction staff. Members from the Contractor shall include the Project Superintendent, SSHO, QC Rep and the quality control staff. The discussion will include, but will not be limited to, the following:

-Contractor supervisory and quality control project staff

-Correspondence procedures

-Accident Prevention Plan

-Environmental Protection Plan and Pollution control program

-Quality Control and Hydrographic Surveying

-Project scheduling and payment procedures

-Resident Management System (RMS-QC)

-Other subjects that may be of interest to the contracting parties

-Schedule of Weekly Meeting

1.2.2 USACE Command Safety Meeting

Prior to dredge operation commencing, a "USACE Command Safety Meeting" must be scheduled and be held on a project dredge vessel. Attendees for this safety meeting will be the Contractor's management, the District Engineer, the Construction representative, and other personnel that play an active role on the project.

1.2.3 Weekly Meetings

Weekly construction/survey/coordination/progress meetings shall be held between the Contractor, Contracting Officer or delegated representative, and Government personnel. Provide weekly progress meeting agenda at least one day before the scheduled meeting. Minutes of the weekly meeting shall be prepared by the Contactor's CQC Manager and submitted to the Contracting Officer or delegated representative within 24 hrs.

1.3 CONTRACTOR PERFORMANCE EVALUATIONS

The Contractor's performance shall be evaluated using the Construction Performance Assessment Reporting System (CPARS) in accordance with Subpart

36.201 (Evaluation of Contractor Performance) of the Federal Acquisition Regulation and Engineering Regulation 415-1-17. The Contractor may access, review, and comment on the evaluation for a period of 60 days. Accessing

SECTION 01 11 00 Page 3 June 13, 2022 and using CPARS requires Public Key Infrastructure (PKI) certification.

The certification is a Department of Defense requirement and was implemented to provide security in electronic transactions. This certification is purchased from an External Certificate Authorities (ECA) vendor. Contractor access to CPARS is required for Contractor to participate in the performance evaluation process. PKI certification is the sole responsibility of the Contractor. Current information about the PKI certification process and known PKI vendors can be found at the following link: http://www.cpars.gov/.

1.4 PERMITS

The Contractor shall obtain and comply with all licenses and permits required by Federal, State, and local laws, codes, and regulations unless otherwise specified in these contract documents. The Government has provided the requirements of the 2020-2024 Water Quality Certification in accordance with the Clean Water Act, the requirements of the 2020-2024 Coastal Zone Management Act (CZMA)Consistency Notification and the LTMS Biological Opinion and Essential Fish Habitat consultation. The Contractor shall comply with these requirements and provisions in these contract specifications included in Sections 01 57 19.01 43 TEMPORARY ENVIRONMENTAL CONTROLS FOR DREDGING IN SAN FRANCISCO BAY and 35 20 23 DREDGING. The Water Quality Certification, CZMA Consistency Notification, and Site Use Conditions for Ocean Disposal are available upon request.

1.5 PUBLIC SAFETY

1.5.1 General

The Contractor shall provide guard personnel as required to provide protection in the interest of public safety. Whenever the Contractor's operations create a condition hazardous to the public, he shall furnish at his own expense and without cost to the Government, such guards as are necessary to give adequate warning to the public of any dangerous conditions to be encountered, and he shall furnish, erect, or maintain such lights, signs and other devices as are necessary to prevent accidents and to avoid damage or injury to the public. Flagmen and guards, while on duty and assigned to give warning to the public that the dredging is being accomplished, and of any dangerous conditions to be encountered as a result thereof, shall be equipped with appropriate safety equipment and a red flag. Signs, flags, lights, and other warning and safety devices shall conform to applicable city, county, and state requirements. Should the Contractor appear to be negligent in furnishing adequate warning and protective measures, the Contracting Officer or delegated representative will direct attention to the existence of a hazard, and the necessary warning and protective measures shall be furnished and installed by the Contractor without additional cost to the Government. The installation of any general illumination shall not relieve the Contractor of his responsibility for furnishing and maintaining all devices necessary to provide protection to all parties concerned. As part of the best practices, the contractor is highly encouraged to hold a safety meeting, open to the general public, at a venue frequented by the boating community to proactively inform and receive feedback from the public of the upcoming dreging work and task timelines.

1.6 PUBLIC UTILITIES AND PRIVATE IMPROVEMENTS

The Contractor's attention is directed to the possible existence of

SECTION 01 11 00 Page 4 June 13, 2022 pipelines or public utilities or private improvements shown or not shown on the drawings which may be buried within the limits of the work or adjacent thereto. The Contractor shall take care to preserve and protect any such improvements from injury or damage during construction operations.Utilities or improvements, whether buried or not, which cannot be determined to exist through visual inspection by the Contractor, if inadvertently damaged by the Contractor's operations, shall be promptly repaired or replaced by the Contractor, and an equitable adjustment in the amount due under the contract will be made as provided in the contract.

The Contractor shall notify the Contracting Officer or delegated representative immediately if any utility or structure has been damaged by the Contractor. The Contractor shall assume full responsibility for reimbursing the owners for any damage to their properties, utilities, or improvements, or interference with their services caused through the dredging operations. The Contractor is not relieved from the responsibility set forth in "FAR 52.236-3, Site Investigation and Conditions Affecting the Work" except as provided above.

1.7 LAYOUT OF WORK

The Contractor shall lay out his work from Government established monuments and gages as shown on the drawings and shall be responsible for all measurements in connection therewith. The Contractor shall furnish, at his own expense, all templates, platforms, equipment, markers and labor as may be required in laying out any part of the work from the gages established by the Government. Contractor is responsible for the execution of the work to such lines, grades and gages as may be established or indicated by Government. Contractor shall maintain and preserve all monuments and other marks established by Government until authorized to remove them. Contractor shall check the accuracy of monuments as the Government does not guarantee their accuracy.

1.8 SAFETY OF STRUCTURES

The Contractor shall use reasonable and proper care in the prosecution of the work to assure the stability of piers and other structures lying on or adjacent to the site of work, insofar as they may be jeopardized by the dredging operations and on account of moving or mooring of equipment. The Contractor shall make good all damages resulting from the moving and mooring of his equipment and from dredging operations insofar as such damages may be caused by variations in locations and/or depth of dredging below that ordered by the Contracting Officer or delegated representative.

DEPTH PAY (Surface Diving):

SATURATION DIVING:

The standby rate shall apply until saturation starts. The saturation diving rate applies when divers are under pressure continuously until work task and decompression are complete. The diver rate shall be paid for all saturation hours.

DIVING IN ENCLOSURES:

Where it is necessary for Divers to enter pipes or tunnels, or other enclosures where there is no vertical ascent, the following premium shall be paid: Distance traveled from entrance 26 feet to 300 feet: $1.00 per foot. When it is necessary for a diver to enter any pipe, tunnel or other enclosure less than 48"" in height, the premium will be $1.00 per foot.

WORK IN COMBINATION OF CLASSIFICATIONS:

Employees working in any combination of classifications within the diving crew (except dive supervisor) in a shift https://sam.gov/wage-determination/CA20220007/9 6/59 are paid in the classification with the highest rate for that shift.
