Notes:

*QUANTITY IS AN ESTIMATED AMOUNT, SEE SECTION 00700, FAR 52.211-18.

1. To be considered responsive, prices must be submitted on all individual items within the Bid Schedule. Failure to do so may be cause for rejection of bids.

2. If a modification to a price based on unit price is submitted which provides for a lump sum adjustment to the total estimated price, the applications of the lump sum adjustment to each unit price in the Pricing

Schedule must be stated. If it is not stated, the bidder/offeror agrees that the lump sum adjustment shall be applied on a pro rata basis to every unit price in the Pricing Schedule.

3. Bidders must complete and submit attached “Dredging Plant and Equipment

Schedule”, forms Page 1 and Page 2 as part of their solicitation package for bid evaluation. Failure to do so may cause the bid to be considered nonresponsive. The Contractor shall demonstrate that all necessary equipment will be available and committed to this contract.

4. The term "Job", which appears on the Pricing Schedule (Section 00 10

00) under “Unit” for BASE ITEM, Bid Item No. 0001 shall be considered as a

Lump Sum. The Variation in Quantity contract clause, FAR 52.211-18, shall not apply to BASE ITEM, Bid Item No. 0001.

5. BASIS of AWARD: The contract will be awarded in accordance with FAR

52.214-19 Contract Award – Sealed Bidding – Construction. Additional foreseeable costs to the Government resulting from dredging with disposal at SF-DODS will be considered in evaluating the bid amount provided for the base and options of Alternative 1. Please see Section 00 21 00, paragraph 2.5 for an explanation. The lowest total evaluated bid amount as between Alternative 1 and Alternative 2, inclusive of the total option price, will be considered for award as the most advantageous to the

Government; however, the awarded contract price will not include the price adjustment that reflects the Government’s additional foreseeable costs.

6. Options will be evaluated for award purposes in accordance with FAR

52.217-5. Exercise of the options will be in accordance with FAR 17.207.

The Government projects that notice of option exercise will be provided to the contractor within the contract performance period. Notice to Proceed for Option 12 will be issued so "in water" work may begin on 1 August of

2016 and for Option 23, so that "in water" work may being on 1 August of

2017. Dredging under Option 1, and Option 2, and Option 3 is not limited to a single fiscal year.

7. The Government reserves the right to direct the Contractor to place dredged material at an environmentally acceptable alternate disposal site prior to 1 December 2015, including the possibility of disposal at the

Government–furnished deep ocean disposal site (SF-DODS) in accordance with the Change Clause FAR 52.243-4.

8. To the extent disposal operations continue after 30 November, disposal of the dredged material will be in accordance with Technical

Specifications, Section 01 11 00.00.10 Summary of Work, Para 1.5.2 Time

- End of Document –

2.5 EVALUATION OF ALTERNATIVE 1 BID FOR AWARD. Alternative 1 with disposal of dredged material at the Government–furnished deep ocean disposal site

(SF-DODS) creates additional foreseeable costs to the Government in aquatic placement area monitoring and scow inspection. These additional foreseeable costs to the Government will be considered in evaluating Alternative 1 base bid, in accordance with FAR 14.201-5(c), and will be applied as an adjustment to Alternative 1 bid price. The adjusted base bid amount for Alternative 1 will be evaluated for award. This adjustment, however, will not be included in the awarded contract price. The award will be for dredging with disposal at one of the two advertised Alternatives. The Alternative with the lowest total evaluated amount will be considered most advantageous to the

Government.

Two hypothetical examples are provided to the bidders:1

HYPOTHETICAL 1:

Bidder A bids $2,250,000.00 for Alternative 1 comprised of: $500,000.00 for the Base, $500,000.00 for Option 1, $500,000.00 for Option 2, and $750,000.00 for Option 3. Bidder A bids $6,200,000.00 for Alternative 2 comprised of:

$1,700,000.00 for the Base, $1,500,000.00 for Option 1, $1,000,000.00 for

Option 2, and $2,000,000.00 for Option 3. The Alternative 1 bid is adjusted to include foreseeable costs to the Government attendant to disposal at SF-

DODs as follows: $838,212.00 is added to the Alternative 1 Base bid and

$2,097,859.00 is added to the sum of Alternative 1 Option 1, Option 2, and

Option 3 bids ($93,135.00 for Option 1, $977,914.00 for Option 2, and

$1,026,810.00 for Option 3). The addition of the foreseeable costs results in an increase of Bidder A’s total bid for Alternative 1 by $2,936,071.00. The adjusted evaluated total for Alternative 1 of $5,186,071.00 is the amount considered for award. No adjustment is made to the bid for Alternative 2.

Bidder B bids $3,500,000.00 for Alternative 1 comprised of: $750,000.00 for the Base, $750,000.00 for Option 1, $1,000,000.00 for Option 2, and

$1,000,000.00 for Option 3. The same adjustment amount of $2,936,071.00 is made to the Alternative 1 bid of Bidder B. The adjusted evaluated total for

Alternative 1 of $6,436,071.00 is the amount considered for award. For

Alternative 2, Bidder B bids $5,500,000.00 comprised of: $1,000,000.00 for the Base, $1,000,000.00 for Option 1, $1,500,000.00 for Option 2, and

$2,000,000.00 for Option 3. No adjustment is made to Bidder B’s Alternative 2 bid. The table below summarizes the bids for this hypothetical.

PART 1 GENERAL

1.1 CONTRACT ADMINISTRATION

1.1.1 Unit for Payment

Payment will be at the contract unit price per cubic yard, multiplied by total cubic yards of the Allowable (Paid) Overdepth Prism and Required Dredge

Prism. For dredge prism definitions, see Section 35 20 23 DREDGING. Include a bid unit price per cubic yard of dredging based on the quantity as specified or indicated.

1.1.2 Estimated Quantities

The total estimated Base quantity of dredged material, and the Optional quantity in the Base year to provide a depth of -50-ft plus 1-ft of payable overdepth, and the estimated Optional quantities of dredged material in each additional year to provide a depth of -50-ft plus 1-ft of payable overdepth volume from the Oakland Inner and Outer Harbor are volume calculations bounded by the Required Dredge Prism and the Allowable (Paid) Overdepth Prism as defined in Section 35 20 23 1.5.2 DREDGING.

The computations for the estimated quantities for the Base and Option 1 work were calculated using Standard Hypack TIN to LNW, Contour Method, and then projected to the estimated before-dredge survey date for each reach. The projected shoal rates for each reach are based on historical survey averages.

The estimated quantities for the Option 12 and Option 23 work are based on the calculated quantities for the Base work. The projected shoal rates for each reach are based on historical survey averages.

The estimated quantities shown in the Bid Schedule do not include available side slope material outside of the channel toes; however, the Contractor will be paid for the volume of dredge material removed above the side slopes based on the difference between the Before-Dredge and After-Dredge Surveys, and will be paid at the unit price for project depth dredging.

Contractor may dredge box cuts to capture anticipated material that sloughs into channel dredging prism. See Typical Dredging Section detail on Drawing

Sheet G1 and Sketch 1.1.2 of this Section for allowable box cut details. All box cuts are made at the Contractor’s risk. All sloughed material from the

Side Slopes above the neat line of the side slopes will be paid at the unit price for project depth material.

1.1.3 Payable Quantity

The payable quantity is the difference between the available material shown in the Before-Dredge surveys and the quantity remaining found in the After-

Dredge surveys. For Before-Dredge and After-Dredge Surveys, see Section 01 32

23 HYDROGRAPHIC SURVEY. For dredging prisms, see definitions, Section 35 20

23 DREDGING. Payable quantities shall only be computed for the required

Dredge Prism, the Allowable (Paid) Dredge Prism, and the Side Slopes above the neat line of the side slopes.

1.1.4 Anticipated Dredge Quantities

After the Before-Dredge survey has been performed for each reach, the

Contractor will be responsible for all shoaling during the execution of the dredging in each reach and this should be reflected in the Contractor’s bid proposal. Any difference in the bid quantities that occur as a result of shoaling or the configuration of the shoaling following the issuance of the solicitation and before the Before-Dredge survey is performed shall be resolved solely in accordance with the provisions of the FAR Clause 52.211-

18, Variations in Estimated Quantities.

1.1.5 Unit Price

In the event there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid. If the bidder file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/01%2032%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/01%2032%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/35%2020%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/35%2020%2023.doc

3.1.1 Mobilization and Demobilization, CLINS 0001, 00034, and 00056

a. Measurement and payment for mobilization and demobilization will be considered complete and full compensation, and will be paid at the

Contract lump sum price, for the effort and cost to transport to and from the job site(s) all necessary serviceable Contractor plant including related equipment, fuel, supplies, and personnel required for its operation for all work associated with contract CLINS 0002, 0003, 00045, and 00067. Plant subject to pre-work safety inspection requirements will not be considered "mobilized" until such equipment is determined to be in compliance by the Government.

b. Payment for mobilization and demobilization will be made in accordance with DFARS 252.236-7004, PAYMENT FOR MOBILIZATION AND DEMOBILIZATION

(DEC 1991), Section 00 72 00 Contract Clauses.

3.1.2 Dredging and Placement of Materials, CLINS 0002, 0003, 00045, and

00067

a. Measurement and payment for the bid item referenced in the title above will be considered complete and full compensation for the effort and cost to excavate the entire dredging pay areas to not less than the

"required dredging depth" as shown on the drawings, will be paid at the unit price (cubic yard of dredged material) for this item.

b. The Government will determine cubic yardage quantities for payment by taking before-dredge and after-dredge surveys. Measurement shall be made as stated in paragraph 3.2 QUANTITY SURVEYS.

3.2 QUANTITY SURVEYS

a. The Government will determine cubic yard quantities for payment by taking before-dredge and after-dredge surveys utilizing electronic depth sounding and horizontal positioning equipment. Sounding depths used for determination of pay quantity volumes will generally be derived from surveys utilizing 208 kHz multi-beam acoustic methods.

However, the Government reserves the right to take soundings by any method, including: leadline, or trigonometric leveling (total station)/differential leveling; the same method will be used for the before and after survey of a given reach. As required, data from land surveys will be obtained and incorporated into the volume computation.

The dredging pay area is defined by intersection of the maximum dredging pay depth and the dredging pay slope as shown by the

Section 01 22 00.00 10 Page 5

Descriptive Sketch in 1.1.2. The number of cubic yards calculated as being payable shall be the difference between the most recent before-dredge and after-dredge surveys of the dredging pay area or applicable acceptance area. Any material removed from outside the maximum dredging prism will not be considered for payment. Accuracy(ies) will be in accordance with stated quality control values in USACE

Hydrographic Surveying Manual EM-1110-2-1003 (April 2004 Change 1

b. Government Equipment. The following survey equipment will be used by the Government Survey Crew during the collection of sounding data:

Reson 7125 Multi-beam dual frequency a 208khz transducer

Reson T20P Multi-beam dual frequency a 208khz transducer

Trimble DSM232 DGPS Receiver

Trimble HPB450 450 MHz radio modem

Applantix POSMV 320 heave compensator

Note: The Government will be available at the request of the

Contractor to run check surveys between the Contractor's and

Government's survey vessels prior to the start of work.

c. Cubic yard volumes will be computed by comparing the Government's before-dredge and after-dredge soundings against the channel design template. The Government intends to use Hypack software to compute pay volumes using the Triangulated Irregular Network (TIN) surface volume computation method. Computed pay volumes will be the difference between the TIN to CHANNEL computation of the after-dredge survey, and the TIN to CHANNEL computation of the before-dredge survey. No adjustments will be made for infill material from any cause during construction in any reach.

d. Actual material removed from the side slope is considered payable as long as it is within the maximum dredging pay prism as determined by the before-dredge hydrographic survey data. The maximum dredging pay prism assumes side slopes projected upward from the maximum payline depth at slopes shown on the Contract drawing, regardless of whether it is found to be representative of the actual side slope conditions after dredging (see Descriptive Sketch in 1.1.2).
