The intent of this section is to provide questions & comments received from interested parties on the above solicitation, and our responses to those questions and comments. It is possible that the information below does not reflect 100% of the questions and responses. The questions and comments do not necessarily represent questions received from any particular contractor.

Questions and responses are provided for information only and are not made part of the solicitation. Only a formal amendment (SF30) to the solicitation changes the solicitation.

Changes to any previous responses in this document will be struck-through and new, updated responses will be provided as appropriate.

No. RFP Section Question Response

Does Bid Item 0002 incorporate Reach 1, 3 and 4 as outlined on the plan sheet 13 of 13, file FY15Suisun13of13.cal, as provided in the Solicitation? If so, would the Corps consider a separate bid item for Reach #4 considering the significant different to the in water disposal site from the other reaches as well as the Not In Contract area noted on plans?

Yes, we considered the request. No new CLIN will be added for New York Slough.

2 It does note appear pan sheet 9 of

13 was posted with solicitation in FBO. Could Corps please update FBO solicitation with plan sheet file 9 of 13?

The portion of the channel that is shown on drawing sheet 9 is not included in this contract (NIC) and was therefore, not included in the drawing set.

3 Under the solicitation, W912P7-15-

B-0002, could the Corps please clarify if material removed from Reach #1 as per drawing file FY15Suisun13of13 is paid under Bid Items 0002AA & 0002AB or under Bid Items 0003AA & 0003AB? As per drawing, only Reach #3 is referenced as Bulls Head Channel.

The material in Reaches 1, 3 and 4 will be paid for under Bid Item 0002AA and 0002AB of this solicitation. Only the material in Reach 2 in Bulls Head Channel will be paid for under Bid Items 0003AA and 0003AB.

4 It does not appear that Section 35 20 23

DREDGING, 3.2.5.6 - Weather Delays was included in Section 35 20 23

DREDGING.

What is the question?

6 Section 52.246-21, WARRANTY OF

CONSTRUCTION (MAR 1994), indicates the following:

(a) In addition to any other warranties in this contract, the Contractor warrants, except as provided in paragraph (i) of this clause, that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier.

(b) This warranty shall continue for a period of 1 year from the date of final acceptance of the work. If the

Government takes possession of any part of the work before final acceptance, this warranty shall continue for a period of 1 year from the date the Government takes possession.

Please clarify if a guarantee is required for dredging work after an area has been accepted by the USACE as complete.

The question correctly copied the clause. What is the question?

A bid guarantee is required for the whole project, and not parts of the project.

7 It is requested that a clamshell bucket also be allowed for use.

See amendment coming soon.

8 SECTION 35 20 23, DREDGING 3.2.6.1

Overflow, Spillage and Leakage, state the following:

Scow overflow is allowed only during dredging operations while scow is being filled to its allowable capacity. Spillage and leakage of any and all dredge material or water is prohibited outside of areas specifically authorized for dredging in accordance with the project plans, specifications and permits. Any material that is spilled, escapes, leaks, sloughs, or is lost or misplaced outside of Dredged Material Management site(s) at any time during operations, to include but not limited to dredging, loading or transporting, shall be retrieved and deposited in accordance with the project plans, specifications and permits.

Based on the permits provided, it appears that decanting is only allowed if there is an approved monitoring plan that has been approved by the RWQCB. It is our understanding that a decanting monitoring plan may have been prepared by the USACE and submitted to the RWQCB for review. It is requested that the monitoring plan be provided to the Contractor to be sure that all costs associated with the monitoring can be estimated prior to bid time, unless the USACE is providing all services associated with monitoring.

See Appendix 2 regarding water quality monitoring requirements for material that is more than 80 percent sand.

Please provide the reference to the FAR section that covers the required insurance for the project.

In addition, we have seen that the ACOE SF District has conducted additional Hydrographic Surveys for the Suisun Bay Channel and New York Slough Channel that should have been posted to their Hydro Survey website for public access and downloading. While there is a listing of the various recent survey sheets for both of these Channels, only Sheet 1 from the 15- 22 July 2015 - Suisun Bay Channel Survey is actually downloadable.

It would be greatly appreciated if you could advise the SF ACOE Hydrographic Survey team that their surveys are not accessible through their website so that they could correct this situation allowing us to view these survey files. We have attached the listing of these surveys for which only Sheet 1 is accessable.

The survey data was posted on July 30, 2015.

11 Since our various questions have yet to be answered with regard to allowing decanting and overflow of water as well as the need to correct the Pricing Schedule due to the incorrect identification of the dredge depths as we pointed out in our message to you on July 23, it would seem appropriate for a third Amendment to be issued for this Solicitation and another potential postponement of the due date.

Please advise as to when we might expect Amendment 3 to be issued. The sooner this could be done the better to allow us sufficient time to incorporate the modifications made within the Amendment, and to acknowledge the Amendment within the bid documents that we have already prepared for this project

See answer to question no. 8.

12 As a follow-up to our July 23, 2015 message the error on the Pricing Schedule that needs to be corrected is summarized below

Within the Pricing Schedule - Section 00 10 00 Item No. 0003 - Dredging, Bulls Head Channel STA 62-00 FFP - Dredging Bulls Head Channel STA 62+00 to STA 88+00 -38-ft (MLLW plus 1-ft of Paid Overdepth with disposal at SF-16.

The continuing Item No. 0003AA requires that the Contractor bid on the Required Dredging to -35-ft MLLW FFP Required Dredging to -35-ft MLLW as Bull Head Channel

Contract Drawing 3 shows "ADVANCED MAINTENANCE DREDGING TO -38' from Station 62+00 to 88+00.

It is again requested that the Pricing Schedule for Item No. 0003AA be corrected to reflect the intended dredge depth of -38-ft as indicated in Item 0003 and within Contract Drawing 3.

See amendment coming soon.
