1.1 CONTRACT ADMINISTRATION

1.1.1 Unit for Payment

Payment will be at the contract unit price per cubic yard, multiplied by total cubic yards of the Allowable (Paid) Overdepth Prism and Required

Dredge Prism. For dredge prism definitions, see Section 35 20 23 DREDGING.

Include a bid unit price per cubic yard of dredging based on the quantity as specified or indicated.

1.1.2 Estimated Quantities

The total estimated quantity of dredged material to provide a depth of -35-ft plus 1-ft of payable overdepth from the Pinole Shoal Channel is a volume calculation bounded by the Required Dredge Prism and the Allowable (Paid)

Overdepth Prism as defined in Section 35 20 23 1.5.2 DREDGING.

The computations for the estimated quantities were calculated using Standard

Hypack TIN to LNW, Contour Method, and then projected to the estimated before-dredge survey date for each reach. The projected shoal rates for each reach are based on historical survey averages.

The estimated quantities shown in the Bid Schedule do not include available side slope material outside of the channel toes; however, the Contractor will be paid for the volume of dredge material removed above the side slopes based on the difference between the Before-Dredge and After-Dredge Surveys, and will be paid at the unit price for project depth dredging.

Contractor may dredge box cuts to capture anticipated material that sloughs into channel dredging prism. See Typical Dredging Section, Drawing Sheet G1 and Box Cut Volume Calculation Sketch 1.1.2 in this Section paragraph for allowable box cut details. All box cuts are made at the Contractor’s risk.

All sloughed material from the Side Slopes above the neat line of the side slopes will be paid at the unit price for project depth material.

Section 01 22 00.00 10 Page 3

1.1.3 Payable Quantity

The payable quantity is the difference between the available material shown in the Before-Dredge surveys and the quantity remaining found in the After-

Dredge surveys. For Before-Dredge and After-Dredge Surveys, see Section 01

32 23 HYDROGRAPHIC SURVEY. For dredging prisms, see definitions, Section 35

20 23 DREDGING. Payable quantities shall only be computed for the required

Dredge Prism and the Allowable (Paid) Dredge Prism.

1.1.4 Anticipated Dredge Quantities

After the Before-Dredge survey has been performed for each reach, the

Contractor will be responsible for all shoaling during the execution of the dredging in each reach and this should be reflected in the Contractor’s bid proposal. Any difference in the bid quantities that occur as a result of shoaling or the configuration of the shoaling following the issuance of the solicitation and before the Before-Dredge survey is performed shall be resolved solely in accordance with the provisions of the FAR Clause 52.211-

18, Variations in Estimated Quantities.

1.1.5 Unit Price

In the event there is a difference between a unit price and the extended total, the unit price will be held to be the intended bid. If the bidder shows only the total price but fails to enter a unit price, the total file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/01%2032%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/01%2032%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/35%2020%2023.doc file://Spn-fs4sfo.spd.ds.usace.army.mil/cespn/BRANCH_FOLDERS/ENGINEERING/Civil_Design/Oakland2012_Inner&Outer_O&M/35%2020%2023.doc

Section 01 22 00.00 10 Page 4 divided by the estimated quantity will be held to be the intended unit price.

1.1.6 Mobilization and Demobilization

The Bid Items for Mobilization and Demobilization shall include all costs associated with the work of the contract identified and described in 3.1.1 and 3.1.2.

Not Used

3.1 MEASUREMENT AND PAYMENT

3.1.1 Mobilization and Demobilization, CLIN 0001

a. Measurement and payment for mobilization and demobilization will be considered complete and full compensation, and will be paid at the

Contract lump sum price, for the effort and cost to transport to and from the job site(s) all necessary serviceable Contractor plant including related equipment, fuel, supplies, and personnel required for its operation for all work associated with contract CLIN 0002. Plant subject to pre-work safety inspection requirements will not be considered "mobilized" until such equipment is determined to be in compliance by the Government. For bidding purposes, the designated point of mobilization shall be Pinole, California.

b. Payment for mobilization and demobilization will be made in accordance with DFARS 252.236-7004, PAYMENT FOR MOBILIZATION AND DEMOBILIZATION

(DEC 1991), Section 01 72 00 Contract Clauses.

3.1.2 Dredging and Placement of Materials, CLIN 0002

a. Measurement and payment for the bid item referenced in the title above will be considered complete and full compensation for the effort and cost to excavate the entire dredging pay areas to not less than the

"required dredging depth" as shown on the drawings, will be paid at the unit price (cubic yard of dredged material) for this item.

b. The Government will determine cubic yardage quantities for payment by taking before-dredge and after-dredge surveys. Measurement shall be made as stated in paragraph 3.2 QUANTITY SURVEYS.

3.2 QUANTITY SURVEYS

a. The Government will determine cubic yard quantities for payment by taking before-dredge and after-dredge surveys utilizing electronic depth sounding and horizontal positioning equipment. Sounding depths used for determination of pay quantity volumes will generally be derived from surveys utilizing 208 kHz multi-beam acoustic methods.

Section 01 22 00.00 10 Page 5

However, the Government reserves the right to take soundings by any method, including: leadline, or trigonometric leveling (total station)/differential leveling; the same method will be used for the before and after survey of a given reach. As required, data from land surveys will be obtained and incorporated into the volume computation.

The dredging pay area is defined by intersection of the maximum dredging pay depth and the dredging pay slope as shown by the

Descriptive Sketch in 1.1.2. The number of cubic yards calculated as being payable shall be the difference between the most recent before-dredge and after-dredge surveys of the dredging pay area or applicable acceptance area. Any material removed from outside the maximum dredging prism will not be considered for payment. Accuracy(ies) will be in accordance with stated quality control values in USACE

Hydrographic Surveying Manual EM-1110-2-1003 (April 2004 Change 1

Edition). At the request of the Contractor, the Government will provide the survey line files by which surveys are run.

b. Government Equipment. The following survey equipment will be used by the Government Survey Crew during the collection of sounding data:

Reson 7125 Multi-beam dual frequency a 208khz transducer

Reson T20P Multi-beam dual frequency a 208khz transducer

Trimble DSM232 DGPS Receiver

Trimble HPB450 450 MHz radio modem

Applantix POSMV 320 heave compensator

i. Note: The Government will be available at the request of the Contractor to run check surveys between the

Contractor's and Government's survey vessels prior to the start of work.

c. Cubic yard volumes will be computed by comparing the Government's before-dredge and after-dredge soundings against the channel design template. The Government intends to use Hypack software to compute pay volumes using the Triangulated Irregular Network (TIN) surface volume computation method. Computed pay volumes will be the difference between the TIN to CHANNEL computation of the after-dredge survey, and the TIN to CHANNEL computation of the before-dredge survey. No adjustments will be made for infill material from any cause during construction in any reach.

d. Actual material removed from the side slope is considered payable as long as it is within the maximum dredging pay prism as determined by the before-dredge hydrographic survey data. The maximum dredging pay prism assumes side slopes projected upward from the maximum payline depth at slopes shown on the Contract drawing, regardless of whether it is found to be representative of the actual side slope conditions after dredging (see Descriptive Sketch in 1.1.2). No payment will be made for material removed from outside the slope projection shown on the

Contract drawings. (NOTE: The bidders are responsible for calculating the quantity of non-pay yards that may be removed outside the pay template and shall adjust his bid accordingly.)

e. All Contractor-owned equipment including all attendant plant and anchor lines must be removed from the acceptance area prior to the initiation of a survey. If Contractor owned equipment remains in the acceptance area at the time of survey, the survey will be cancelled and the

Section 01 22 00.00 10 Page 6

Contractor shall be liable for the full daily rate for a Government survey crew shown in paragraph QUANTITY SURVEYS sub item k., below.

f. The Government will conduct before-dredge surveys in order to identify and designate areas of shoaling to be dredged within the overall dredging pay areas. The Government will conduct after-dredge surveys to determine final acceptance of dredging pay areas or sections thereof. The Government may conduct periodic progress surveys at all work locations. If the Contractor chooses to do additional surveys the

Contractor shall notify the GQAR in advance of any surveys conducted by the Contractor, and the GQAR will have the option of accompanying the

Contractor on these surveys. All surveys conducted by the Contractor shall be in accordance with the USACE Hydrographic Surveying Manual EM-

1110-2-1003 (2004 Edition).

g. If a survey is completed by the Contractor, the Contractor shall furnish the originals of all field notes, sounding plots, and electronic survey data described in Section 01 32 23 HYDROGRAPHIC

SURVEY, Para. 1.3.3 QUALITY CONTROL (QC) SURVEYS, along with all other records relating to the survey or to the layout of the work, to the

Government, who may consider them to the extent necessary to determine the amount of progress payments. The Contractor shall retain copies of all such material furnished to the Government.

h. The typical cross sections shown on the Contract drawing(s) represent the anticipated before-dredge condition prior to start of work and are not necessarily derived from the latest available survey data. All survey requests must be submitted a minimum of three calendar days prior to the date on which the survey is required.

i. Generally the survey will be performed within three calendar days of the desired survey date and the complete layout or after-dredge package

(electronic survey data, layout chart, quantity computations, etc) will be available two business days thereafter. However, personnel and equipment availability may dictate that surveys are occasionally performed later than three days after the request. The Contractor can expect the final post-dredge survey chart to be available within three calendar days after the soundings are complete. The Contractor shall be given verbal notification of acceptance within 24 hours of the post-dredge survey. The Contractor is to expect this time in his schedule and is to remain mobilized until the results of the after-dredge survey are known, and acceptance of the work area has been made.

Determination of acceptance of work will be based on this after-dredge survey chart and will be made within the two calendar days stated above.

j. The Contractor is responsible for requesting Government before-dredge and after-dredge surveys of all work areas. All Contractor requests for Government surveys shall be made by submission of a Hydrographic

Survey Request Form (see 01 32 23, HYDROGRAPHIC SURVEY, Attachment 2).

The request shall be submitted to the Government representative(s) identified at the pre-construction conference. The Contractor's dredge including all attendant plant and anchor lines must be clear of the acceptance area(s) before a survey is made. The Government Survey periods stated above are contingent on weather and sea conditions.

Section 01 22 00.00 10 Page 7

k. In the event it becomes necessary to reschedule a request for survey, the Contractor shall notify the Government at least one calendar day prior to the first day of the scheduled survey period. Failure to provide such notification shall make the Contractor liable for half the daily rate for a Government survey crew. If the survey party mobilizes to the site before the survey is cancelled, the Contractor shall be liable for the full daily rate for a Government survey crew of $5,000.

l. Should more than one sounding or sweeping operation by the Government over an area be necessary by reason of work for the removal of shoals disclosed at a prior sounding or sweeping, the cost of such second and any subsequent sounding or sweeping operation will be charged against the Contractor at the rate of $5,000 per day for each day in which the

Government plant is engaged in sounding or sweeping and/or is enroute to or from the site or held at or near the said site for such operations.
