Section 35 20 23, Paragraph 5.8
Regarding Section 35 20 23, Paragraph 5.8 Overflow, Spillage, and Leakage. If the contractor elects to use a Hopper Dredge, will they be allowed to overflow for an amount of time specified by the contracting officer in order to optimize production?

5.8 Overflow, Spillage and Leakage

5.8.1 Misplaced Material. Any dredged material that escapes, sloughs, or is lost at any time while dredging, loading, transporting, or which is deposited in an area other than that designated on the Plans shall be redredged or retrieved, and material shall be deposited where directed by the Contracting Officer, at the Contractor's expense.

5.8.2 The Contractor’s Spill Response Plan shall include monitoring of overflow, spillage and leakage.

5.8.3 The Contractor shall remove all material spilled outside the project limits at no cost to the Government.

Both the Consistency Determination (CD) and the Waste Discharge Requirements (WDR) allow 15 minutes of overflow for hopper dredge operations. The allowance is action specific and not project specific, meaning that it would apply on any project where a hopper dredge is used. The documents do not specify which projects may or may not use a hopper dredge. Both documents are worded such that the overflow is per excavation cut. We have clarified this with the agencies and their intention and interpretation is that after 15 minutes of overflow the dredge will transit to the disposal/placement site and unload.
