About this file

This document contains an amendment to a solicitation as well as responses to contractor questions regarding a federal contract opportunity for the operation and maintenance of dispersal barrier facilities in Romeoville, Illinois.

The amendment provides responses to contractor inquiries, confirms the bid opening date has not changed, and identifies the point of contact for any further questions. Key details include that diesel fuel will be furnished by the government for generator load testing, facility documents will be made available after award, and electricity onsite is also government-furnished. The responses clarify that safety training requirements only apply as relevant to electrical/mechanical work, and the government will be responsible for ensuring the safety of any third-party visitors.

The related federal contract opportunity is for dispersal barrier facilities operation and maintenance services at the USACE Chicago Sanitary and Ship Canal dispersal barrier facility in Romeoville. Requirements include providing 24/7 operators, annual bridge crane and generator inspections/testing, and general maintenance. The NAICS code is 561210 with a $41.5M small business size standard. Bids are due by January 29, 2021. The solicitation and this pre-bid amendment provide details for interested contractors to submit proposals for this requirement.

SUMMARY OF CHANGES

C. CONTRACTOR’S INQUIRIES: By this Amendment, the Chicago District, USACE responds to Contractor’s inquiries as follows. –PLEASE NOTE: The USACE's responses are provided in bold, black text and follows the Contractors inquiries.

3.9.1

Previous Contractor question:

When a LOTO is needed a third party can not be in the LOTO area if they are not under the same contract as the contracted work under this solicitation does not give control over a third-party contractor and therefore can not be expected to keep someone that may or may not be a competent third party contractor from danger. If the liability falls on the contractor holding the contracted work it is not possible to have additional non contracted third-party contractors in the LOTO area while following APP, HECP, OSHA, NFPA70e requirements at the contract holders risk. We do understand the goal but the government needs to acknowledge where the liability falls if the third-party contractor is in the same space that is under LOTO.

Previous USACE response:

Refer to EM385-1-1 Section 12 - 12.B02 paragraph b. identifies that coordinating with all site personnel is necessary to assure a safe program

Current question from Contractor trying to clarify what was being asked:

By this statement is USACE saying that any contractors that are not part of the contracted work in a LOTO area are to be notified that the work area is restricted, ie. off limits, to them until the LOTO work is finished?

Understood. To clarify will any third-party contractors that USACE brings into the facility while work is being performed under this contract by following the same requirements outlined in this contract? To further clarify the third-party contractor, visitors and guests will perform their self-verification and validate that the equipment is off zero volts, and safe to be around for their visit. As expected when following the safety requirements laid out in APP, LOTO, and HECP based on OSHA and EM 385-1-1. Please confirm that the contractor is not responsible for verifiying that the government's visitors or third-party contractors are competent and capable for the USACE tours and/or work outside of this award?

In the past, we have witnessed firsthand contractors reaching into 480v panels while hot during USACE tours and reported as required but this does not keep dead people from not being dead after an incident has been allowed to happen by government personnel previously.Do the qualifications found in 3.12.12 apply to the above question?

Prime contractor is responsible for subcontractors. Government administers the contract with prime contractors.

Previous contractor question about 3.12.12

Need to confirm that all subcontractors will be required to have the same safety training to be onsite as everyone else. Snowplow, crane certification company, road treatment company, IR scan contractor, and chiller contractor.

Including the following EM 385-1, NFPA 70e NFPA 70, OSHA 30, and the rest of the safety requirements that are in the solicitation. Requiring those costs to be in each Clinn pricing for the activities. This question has been asked previously but not answered. It adds a significant amount of cost to each client with the training requirements and it's not clear if a snowplow driver needs to be NFPA70e trained. Common sense would say it is not likely but the solicitations say all contractors and subcontractors need to have the following training.

Previous government response:

Paragraph 3.12.12 describes experience for working on electrical and mechanical systems.

3.12.12 All contractor and all associated sub-contractors hired to maintain, troubleshoot, repair, and/or upgrade related mechanical and electrical systems and components, or other specialized equipment and systems, as defined by this contract, shall have a minimum of five (5) years of experience maintaining, troubleshooting, repairing, and upgrading advanced facilities similar to the Barriers. The specific experience, qualifications, and applicable licenses of all proposed subcontractors shall be submitted to the COR for review and acceptance within 10 business days after the award of the contract.

3.12.12

Current question from Contractor trying to clarify what was being asked:

Do the qualifications of 3.12.12 apply to the question above? The circular reference you provided in the last RFIs referring us back to 3.12.12 when asking if the snowplow operator or the dust control contractor and the parking lot subcontractor need to have 70E training did not answer the question does the government want all contractors to meet the same qualifications across the board regardless of the work they are doing? Please answer specifically rather than referentially.

As previously stated; paragraph 3.12.12 describes experience for working on electrical and mechanical systems. For clarification, snow removal is not an electrical for mechanical system.

3.20.6.1

Is diesel fuel for generators in support of the annual load test a material requirement? Or will the government be using this as an opportunity to burn stored fuel and topping off with new fuel at the government's expense?

MTU suggests that USACE provide information previously requested from the equipment nameplate since the information provided to date has not made clear which specific generator is included in this solicitation. Note that the nameplate is found on the generator. The model and serial number are required. Please photograph the data plate on the equipment and provided it to bidders so that this feature of work can be priced properly. Including the Job Numbers, as the government has done for the annual chiller, generator info would be helpful for clarifying the specific generator for pricing purposes.

Please understand that the government providing this information to bidders after business hours on Friday doesn't provide adequate opportunity for bidders to properly price this feature of work correctly with a limited amount of time in the following week prior to bids being due.

Diesel fuel is a government furnished item

General questions:

1. Will the operator dead man switch remain operational on-site throughout the contract? The redundant safety measures are not a requirement for this contract. However, the winning Contractor is required to implement all necessary safety requirements and precautions to ensure a safe working environment.

2. Are all the Blast panels tested and certified by USACE or an approved testing lab/facility? Facility documents will be available upon award in coordination with COR

3. Please identify the power supply for the onsite climate-controlled storage. Electricity is a government furnished item

4. We are requesting an extension until we can share the answers with our sub-contractors. The Bid Opening Date and Time is unchanged. Bids are due prior to 1:00 p.m. (Central Time) on February 3, 2021.
