(D) THE USACE’S RESPONSES TO CONTRACTORS’ INQUIRIES FOLLOW:
Question #1: Although the bid item is for 32,500 tons of stone under the whole contract including options, the delivery schedule is only for 15,000 tons including options. Please advise.
USACE Response #1: The delivery schedule has been revised to reflect the quantities and delivery locations shown in the bid schedule. See the Amended schedule herein.
Question #2: The delivery schedule includes a delivery to the Chicago Area Stone Dock as a base delivery; however, the bid schedule lists this as an option item. Please advise.
USACE Response #2: Refer to the above USACE Response #1.
Question #3: painting 6 marks - 4” wide by 2’ long (1’ on the top of the deck and 1’ down the side) sufficient? On page 20, paragraph 1.6.2.1 the first paragraph prescribes one method of measuring and the second paragraph suggests an alternate approach.
USACE Response #3: The painting marks proposed in the question above would meet the criteria outlined in section SECTION C, Scope of Work, C.1.6.2.1 GAUGING.
Question #4: How (and where) should we gauge when barges have a rake — since it will not sit 100% level in the case of a semi (box on one end, rake on the other). Considering the specification to that it should be take 4’ from the box end, we would like to propose since the rake is 25’ long and we measure at the end of the rake, we should measure 23’ from the end of the box end to keep the symmetry. Is this acceptable?
USACE Response #4: The proposed method for measuring in Question #4 would be acceptable.
Question #5: Can you provide a more specific gradation requirement for the .25 to 1 ton stone?
Section C.3.2.1 states: The stone furnished shall weigh between 0.25 and 1 ton each and shall be free of fines. Fifty (50) percent of the stones by count shall weigh more than .5 ton each.
USACE Response #5: The stone being free of fines means that the stone shall not have clumps of clay or silt or significant amounts of sand included in the material weighed for payment - i.e. it should be relatively "clean" but needn't be washed. This facilitates inspection of quality of stones and prevents fine-grained materials from masking fractures or discontinuities at the time of inspection.
The stones shall be between 500 pounds and 2,000 pounds in weight. 50% of the stones shall weigh 1,000 pounds or greater. The description "by count" distinguishes that 50% of the stones shall weigh 1,000 pounds or more, as opposed to 50% of the stones by weight weighing 1,000 pounds. An example would be:
10 stones (wt. in pounds)
1. 750
2. 750
3. 750
4. 750
5. 750
6. 500
7. 2000
8. 2000
9. 2000
10. 2000
Average (mean) weight = 1,225 #, and the stone is within the range from 500-2,000 pounds. So it might seem that half are above 1,000 pounds but the individual stone weights are distributed so that 6 of the 10 are below 1,000. So it does not meet the specification.
10 stones (wt. in pounds)
1. 750
2. 750
3. 1100
4. 750
5. 1200
6. 500
7. 1200
8. 1000
9. 1000
10. 2000
Average (mean) wt = 1,025 # and the stone is within the 500-2,000 pound range. Even though the average weight is lower than the example above, 6 of the 10 stones are =/> 1,000 pounds so this group meets the specification.
Question #6: Can a deck barge with 2500 tons of capacity be used to deliver the stone?
USACE Response #6: Yes, a deck barge with 2,500 tons of capacity can be used to deliver the stone.
Question #7: Can we email the bid and a copy of the bid bond for submission and then mail a hard copy?
USACE Response #7: Yes, please refer to Section A, # 5(b) of the Solicitation.
Question #8: Does this project have liquidated Damages associated with it?
USACE Response #8: The Solicitation does not include a liquidated damages provision or the relevant Federal Acquisition Regulation Clause; therefore, liquidated damages "will not" be assessed in this project.
Question #9: If so, what are they?
USACE Response #9: Liquidated damages do not apply to this procurement; please refer to the aforementioned USACE Response at " USACE Response #8."
Question #10: Is there a maintenance/warranty period for the project?
USACE Response #10: Once a contract is awarded from this Solicitation, the contractor will not be required to perform under a maintenance period; thus, a maintenance period isn't applicable to this procurement. With respect to warranties, the standard stone manufacturer's warranty would apply.
This procurement does not require any separate or extended warranty period. That said, under the "Inspection" Clause of the Solicitation (& resultant contract), if non-conforming material is delivered, it must be remedied/replaced.
Question #11: What are the payment terms (i.e. milestones, monthly, upon completion, advanced payment) and is there any retainage?
USACE Response #11: The contractor will be compensated after its invoice is certified as being proper. At such determination, the following applies:
As set forth at paragraph C.1.7 of the Scope of Work, “METHOD OF PAYMENT,” the following is stated:
“Payments for partial completion of the quantities listed within each line item shall be made after satisfactory acceptance of the stone materials at the point of delivery. Partial payment may be allowed for stone that is quarried, inspected, and stockpiled at a loading area ready for shipment to the Government, with a certificate of ownership transfer to the Government. This provision would apply in cases where the delivery of stone is prevented by weather or rough lake conditions. All deliveries are subject to the acceptance of the Government, in accordance with all contract provisions. Payments will be permitted in accordance with FAR 52.232-1.”
Per the Solicitation, the full text of referenced Clauses, such as the aforementioned “FAR 52.232-1” can be read on-line at: http://farsite.hill.af.mil
Question #12: Can you please confirm if SF 24 (see attachment) is an acceptable bid bond template for the required 20% bid bond.
USACE Response #12: The SF 24 form in the inquiry is the most current form being used and is in accordance with the forms located at: https://www.gsa.gov/reference/forms.
