SUMMARY OF CHANGES
A. BID OPENING DATE AND TIME:
The Bid Opening Date is EXTENDED to September 21, 2018 from September 19, 2018, and the Bid Opening Time has changed from 4:00pm (Central time) to 2:00pm (Central Time). In this respect, Bid packages are due PRIOR to 2:00 p.m. (Central Time) on September 21, 2018. Detailed instructions regarding the submittal of Bids is located at Section 00 22 13 of the Solicitation document – SEE “IMPORTANT BID NOTES.”
B. REVISED SOLICITATION SECTION 00 10 00 (BID SCHEDULE):
The below bid item has been revised. Theefore, the government is providing a revised bid schedule (Section 00 10 00 – Solicitation Contract Form). Therefore, Bidders shall remove and replace the previously issued respective Section with the Revised Section 00 10 00 enclosed hereunder. Bidders shall provide their prices on the Revised Bid Schedule.
CLIN 0009: The quantity has been increased by 60.00 from 40.00 to 100.00
C. REVISION to SOLICITATION SECTION 00 70 00 – CONDITIONS OF THE CONTRACT The following Federal Acquisition Regulation Clause has been incorporated by full text as follows:
52.236-16 Quantity Surveys (Apr 1984)
(a) Quantity surveys shall be conducted, and the data derived from these surveys shall be used in computing the quantities of work performed and the actual construction completed and in place.
(b) The Government shall conduct the original and final surveys and make the computations based on them. The Contractor shall conduct the surveys for any periods for which progress payments are requested and shall make the computations based on these surveys. All surveys conducted by the Contractor shall be conducted under the direction of a representative of the Contracting Officer, unless the Contracting Officer waives this requirement in a specific instance.
(c) Promptly upon completing a survey, the Contractor shall furnish the originals of all field notes and all other records relating to the survey or to the layout of the work to the Contracting Officer, who shall use them as necessary to determine the amount of progress payments. The Contractor shall retain copies of all such material furnished to the Contracting Officer.

D. REVISED PROJECT DRAWING SHEET:
The below sheet has been modified. The revised sheet is enclosed hereunder and replaces the previously furnished, respective sheet.
(a) Sheet C-121: Revisions were made to the aggregate base course.
E. REVISED SPECIFICATIONS SECTIONS:
The below revised specification sections are enclosed hereunder and replaces the previously furnished, respective specification sections.
(a) SECTION 01 10 00, GENERAL PROVISIONS:
i) Para 1.16.1.2, IDOT Traffic Control Authorization (BT 725): A sentence was added: “Lane closures will only be permitted for 14 days”.
(b) SECTION 01 22 00.00 10 PRICE AND PAYMENT PROCEDURES:
ii) Para. 1.3.5.1 – The payment paragraph was revised to clarify the payment procedures for refilling of holes from clearing and grubbing activities within and outside the levee footprint.
iii) Para. 1.3.9, 1.3.12.1, 1.3.13.1, 1.4.1.1, 1.4.2.1, 1.4.3.1, 1.4.4.1, 1.4.5.1, 1.4.6.1: these payment paragraphs were revised to provide clarification on work included or excluded for payment.
(c) SECTION 31 00 00, EARTHWORK:
i) Para 1.2.6 – This paragraph was added to define/clarify the requirements for topsoil stripping.
ii) Para. 1.2.7 – Paragraph was added to define/clarify the requirements for subsoil stripping.
(d) SECTION 31 05 19, GEOTEXTILE
i) Para. 2.1.1, Geotextile– The geotextile thickness was revised from 160 mil to 65 mil.
(e) SECTION 32 92 19, SEEDING:
i) Para. 2.1.2, Temporary Cover Crop – Para. 2.1.2 will not be applicable for the restoration areas and will be removed. Cover crop mix is already included with the IDOT seed mix specified for the restoration areas.
(f) SECTION 34 11 00, RAILROAD TRACK AND ACCESSORIES, Para. 1.5.3: “For each railroad” was added to clarify that the two additional days of work after sheet pile installation applies for each railroad.
F. CONTRACTOR’S INQUIRIES: By this Amendment, the Chicago District, USACE responds to Contractor’s inquiries (SEE THE FOLLOWING).
Question 1. Geotextile Sec 31 05 19 Is there another spec available for this product? We have not been able to locate a 6oz non-woven fabric that has a thickness of 160 Mil.
USACE Response Q1: Thickness of Geotextile will be revised to 65 Mil by way of this amendment – Specification Section 31 05 19, Para. 1.3.12.1.
Question 2. Item NO 0007AB – Subsoil stripping & Stockpiling - QTY 32,190 Cubic Yards Where is this material being stripped from? Doing a takeoff on the drawings and cannot quantify this item. Is there any details or cross sections showing where this material is being stripped (excavated) from?
USACE Response Q2: Intended material is all excavated subsoil (i.e. excluding topsoil) as noted on plans including material associated with root ball removal, benching, temporary fill removal, etc. Applicable details include but are not necessarily limited to 2/C-123 and 5/C-124. Note that root ball removal as required in this contract is more extensive than typical grubbing of trees would require. For all bid items for which specific quantities are listed, bidders are expected to bid on the basis of the specified quantity.
Question 3. Item NO 0024AB – Subsoil stripping & Stockpiling - QTY 6,140 Cubic Yards Where is this material being stripped from? Doing a takeoff on the drawings and cannot quantify this item. Is there any details or cross sections showing where this material is being stripped (excavated) from?
USACE Response Q3: This item is for all options work in the area that is identified on C-101, south of the northern limit of IDOT Right of Way. For additional information, refer to Item 2 Response.
Question 4. Sheet C-123
Detail 2 shows “Strip Existing Levee surface” is this the pay Item NO 0007AA Topsoil Stripping & Stockpiling?
USACE Response Q4: Stripping existing levee surface includes topsoil stripping (Items 0007AA & 0022AA) and subsoil stripping (Items 007AB & 0022AB), as per Detail 2/C-123 (Note 3) and Detail 5/C-124. Additionally, “Strip Existing Levee surface” may include deteriorated gravel from existing paths or other items as defined in Section 31 11 00 1.1.3 to be done under bid items 0007AB and 0022AB. By way of this amendment, Para.
1.3.12.1 was added to clarify the intent of topsoil stripping.
Question 5. Sheet C-121
Note on drawing says “Demo & replace full depth asphalt parking lot see note 2 & 4” Detail 3 shows asphalt thickness but no stone thickness.
Does the stone base get removed and replaced or just the asphalt in Item NO 0018 Asphalt Paving?
USACE Response Q5: Provide 8” Aggregate Base Course. Stone base is included in Item 0018. This is clarified on sheet C-121 by way of this amendment.
Question 6. Rail Training
Will there be rail training required by BNSF, CN or any other agency?
USACE Response Q6: The railroads and other agencies providing access and right-of-way may require safety orientation and other training. Information on required training is usually available on the website of respective agencies. For example, information on BNSF required training can be found at http://bnsfcontractor.com/. However, upon of final agreements with the railroad and if training is required, associated costs for trainings will be covered under Bid Item 0027.
Question 7. Bid Items 0007AB and 0024AB are to strip and stockpile 32,190 and 6,140 cy of subsoil, respectively.
In our examination of the plans and specifications, we don't find any cut(s) that would amount to this volume.
Please clarify location(s) of the 38,330 cy of subsoil to strip.
USACE Response Q7: Refer to response to Item 2.
Question 8. Several bid items including stockpiling of topsoil and/or subsoil; however, the space set aside for Construction Staging Lay Down and Operations at the existing parking lot is not large enough for all these activities.
Can stockpiles be located elsewhere in the work area? Where?
USACE Response Q8: It is expected that a limited amount of material may be stockpiled on the land side of the levee within the designated work limits and within the staging and operations area indicated on C-121.
Contractor shall not stockpile material outside of the work limits including the staging area. The intent is that the Contractor shall work on no more than 100 feet of the levee at any one time as stated in Specification Section 31 23 19, Flood Water Control.
Question 9. The plans show several areas of Temporary Measures Fill to be excavated. What Bid Item includes this work?
USACE Response Q9: Temporary measures fill to be excavated is included in bid items #0007AB and
#0022AB.
Question 10. Bid Items 0008, 0025, and 0041 for Steel Sheet Pile are unit prices with unit given as square foot.
However, Section 01 22 00, 1.3.6 Sheet Pile and subpargraphs give the units variously as square foot, linear foot, and square yard. Please clarify unit of measure.
USACE Response Q10: The unit of measure is square foot. The paragraph was revised to show square foot for unit of measure per Amendment 0001.
Question 11. What permits will the Contractor be required to secure for this work?
USACE Response Q11: The necessary State permits have been obtained for this project. Refer to Section 01 57 20 for the IEPA 401 permit. The Contractor will be required to apply for an IDOT permit to complete work within IDOT ROW. Information for the permit application was provided in Section 01 10 00, General Provisions per Amendment 0001.
Question 12. Will there be any requirements for water rescue for work within a certain distance of the water's edge?
USACE Response Q12: Apart from all applicable laws, requirements for water rescue are the responsibility of the Contractor based on Contractor means and methods.
Question 13. Will Longshoreman's insurance be required because of proximity of work to the waterway? What limits apply?
USACE Response Q13: No, Longshoreman's insurance will not be required for this project. There's no marine work on navigable waters required for the project. Only the types of insurance included in Specification Section 01 10 00 are required.
Question 14. Will Railroad insurance by required for optional work at the railroads? If so, what limits apply? Also, please provide the following for each rail line if RR insurance is required:
* Start and end mile posts for the work
* Daily number of passenger train movements
* Daily number of freight train movements
USACE Response Q14: Insurance requirements for the railroads are provided in Specification Section 01 10 00, paragraph 1.14. However, if final work agreement with the railroads requires additional insurance, optional CLIN 0027 will be exercised to cover the costs for additional insurance as specified in Specification Section 01 22 00.00 10, Para 1.3.13.
Question 15. Per the bid form, Item # 0007AB, states the General Contractor is to strip and stock pile 32,190 cubic yards of onsite material. Where will this quantity of on-site material be obtained? Borrow pit?
USACE Response Q15: This quantity refers to existing Levee subsoil to be excavated and does not need to be obtained. Refer also to Item 2 response. Suitable/satisfactory soil material from the excavated material can be reused for levee fill under Item 0007AC. Any unsuitable soil material shall be disposed of under appropriate items. Disposal of unsuitable soil, excludes roots and other vegetative matter, and can be paid under Item 0023.
Question 16. What location can be utilized for stockpiling the 32,190 cubic yards of material?
USACE Response Q16: Refer to item 8 response.
Question 17. Please confirm the 32,190 cubic yards of on-site material will meet the requirements of the specification.
USACE Response Q17: This has to be determined after excavation. Materials suitable for fill and meeting the contract requirements, resulting from excavation under Items 0007AB and 0022AB, may be used, and will be paid for under Items 0007AC and 0022AC (for Options work). Exceptions would be material that may correspond to the options for unsuitable and contaminated materials.
Question 18. We believe after the clearing and grubbing has been completed there will be no usable topsoil that will meet the specification. How will topsoil be paid if there is no usable topsoil on site?
USACE Response Q18: Any imported topsoil is intended to be paid from bid items #0007AE and #0022AE.
Question 19. What permits will need to be obtained by the General Contractor?
USACE Response Q19: The necessary State permits have been obtained for this project. Refer to Section 01 57 20 for the IEPA 401 permit. The Contractor will be required to apply for an IDOT permit to complete work within IDOT ROW. Information for the permit application will be provided in Section 01 10 00, General Provisions.
Question 20. What permit costs will be incurred by the General Contractor?
USACE Response Q20: In Solicitation Section 00 70 00, the applicable FAR clause is FAR 52.236-7, Permits and Responsibilities, wherein describing, the cost for permits is the responsilibility of the Contractor.
Question 21. Is railroad protective insurance covered in the $15,000 allowance in bid item 0040?
USACE Response Q21: See Response to Item 22.
Question 22. Does the General Contractor required to provide railroad protective insurance?
USACE Response Q22: Insurance requirements for the railroads are provided in Section 01 10 00, paragraph
1.14. However, if final work agreement with the railroads requires additional insurance, optional CLIN 0027 will be exercised to cover the costs for additional insurance as specified in Section 01 22 00.00 10, Para 1.3.13.
Question 23. Please provide a further description/explanation of “Temporary Measures Fill to be Excavated” as shown on the plans and described in Spec Sec. 31 00 00 3.5.1. Is this material to be excavated, re-worked and re-compacted? If that is what is done with this material what pay item is it to be included under? If the material deemed to be “Unsuitable”, will the removal and off-site disposal of the material be paid under the Allowance Unit Price #0036? If deemed unsuitable, how will the import and placement of suitable material be paid for? Under #0007AD?
USACE Response Q23: Majority of excavated materials, including the “Temporary Measures Fill” may be suitable for reuse on the site. Unsuitable material removal and disposal will be paid under the separate bid item #0023. All imported Levee Fill is intended to be paid under bid items #0007AD and #0022AD.
Question 24. Per specification section 32 92 19, paragraph 1.5.1, seeding should occur May thru July. With the project starting in the spring as stated at the prebid, the General Contractor will not be able to apply seeding May thru July. This will cause the project to not be completed in 390 days. Please extend the duration out to include time for seeding.
USACE Response Q24: With the exception of the seeding windows, there is no contract requirements to start construction work in the spring. The contract performance period considered the seeding windows. Upon the issue of contract Notice to Proceed (NTP), the Contractor will be required to submit a construction schedule to meet to meet the project requirement in accordance to Section 01 10 00, General Provisions.
Question 25. In section 1.2.4.1 Payment for Demolition and Removal it states "aggregate road over levee" Our question is there is no existing road shown on the plans for removal, is there an existing aggregate road for removal?
USACE Response Q25: Existing aggregate road is not apparent on most of existing levee. Any existing deteriorated aggregate road encountered shall be demolished and removed to accommodate proposed work.
Payment would be under the subsoil excavation items, Bid Items 0007AB & 0022AB.
Question 26. What areas can be used for stockpiling in the work zone, It seems the top of the levee and also the embankment is not allowed per the specs. Is the area adjacent to the levee available for stockpiling of material?
USACE Response Q26: Refer to item 8 response.
Question 27. During Site visit there was a pipeline that was noticed between Sta 34.00 & 35.00, on the drawings it shows a gas line. Is there more information for this gas line? Is it a Nicor line or a pipline of some sort ? Is there any special Insurance required for working by the pipleine and or under the high power lines?
USACE Response Q27: Information on gas lines is limited to what is shown in the contract documents.
However it is known that Kinder Morgan and Nicor gas lines exist within project limits, possibly on ComEd property. Contractor will be expected to meet any special insurance requirements of the agencies providing the right-of-way and the utility owners. Special Insurance required will be paid under Bid Item 0027.
Question 28. Will there be a lane closure on 47th street allowed for work North of 47th street which would be base work? And if so is this to be paid out of traffic control allowance?
The traffic control allowance item specifies for optional work only south of 47th street.
USACE Response Q28: No lane closure will be allowed for work north of 47th Street, for the base contract work. Contractor is expected to complete all of the base work utilizing only the access from Joliet Road as specified.
Question 29. Per the FBO.gov website in the description of the project it states “The magnitude of cost for construction is between $5M and $10M” , In the Solicitation it states “The Estimated Magnitude of Construction is between $1M and $5M”, Which Value is correct for this project ?
USACE Response Q29: The solicitation document is the formal Invitation for Bids. Therefore, it governs over the FBO notice. In that respect, and as stated at block #10 on page 1 of the Invitation for Bids, the estimated magnitude of construction is between $1M and $5M.
Question 30. Seeding SEC 32 92 19 Temporary Cover Crop Seed 2.1.3 (Erosion Control) There is no rate given for the cover crop. All other seed is specified in pounds per acre. Is there a specific rate for this item?
USACE Response Q30: The IDOT seed mix specified in Section 32 92 19 includes adequate cover crop for the restoration areas. Therefore, Para. 2.1.3 is not applicable for the restoration areas and will be removed from the Section. Temporary erosion and sediment controls shall be in accordance to Section 01 57 20.01 03.
Question 31. Section 34 11 00 Sheet Pile Installation 1.4.2 – The amendment states “The Contractor must complete the work within each railroad right of way within the time specified (8 Hours). Does this mean there is 8 hours for each railroad right of way or 8 hours for both rail road right of ways?
USACE Response Q31: The 8 hour timeline is for each railroad ROW as stated in Section 34 11 00, Para.
1.5.2.
Question 32. Section 34 11 00 Post sheet pile Installation 1.4.3 – It states that we will have 2 additional days to do off track work, IS this work limited to 8 hour days? If additional days are needed what costs will become the contractors? Is this two additional days per railroad, so 4 days?
USACE Response Q32: The two additional days applies for each railroad (total of 4 days). Section 34 11 00, para 1.5.3 is revised for clarification by way of this amendment.
Question 33. Is there a known source for imported fill material? Has the Army Corp contacted any local sources that would meet your import specifications?
USACE Response Q33: There are sources for imported fill that meets our specification. However, the Government cannot release this information and leave out other possible sources.
Question 34. C-121 and C-122 Fence; requires 2 sections of fence 50’ long each; Item No 0009 quantity is only 40 LF. What is the correct quantity for this item?
USACE Response Q34: Lineal feet of chain link fence for Bid item 0009 is revised via this amendment to 100'.
Question 35. Section 31.00.00 Earthwork, 3.4.1 directs to “Strip the area within the limits of the levee foundation to remove heavy growth of grasses, weeds, other vegetation, and surface soils to a depth not to exceed 12 inches as shown on the drawings.” Section 01 22 00, 1.2.5.1 states that “Refilling of holes resulting from clearing and grubbing operations…will be considered…incidental under the above item”. Is the clay material needed for refilling of holes incidental to clearing and grubbing or is the material to be paid for Items 0007AC or 0007AD?
USACE Response Q35: The clay material needed for refilling of holes within the levee footprint will be paid under 0007AC, 0007AD, 0022AC, & 0022AD as appropriate. Refilling of holes outside of the levee footprint will be paid under the clearing and grubbing bid items. Paragraph 1.3.5.1 was revised for clarification by way of this amendment.
Question 36. C-103, Spillway Removal, is the contractor required to remove the buried spillway structure between station 13+50 and 17+40?
USACE Response Q36: Refer to Sheet C-129 for existing buried spillway demolition requirements.
Question 37. Bid Schedule, Is item 0025 base bid or option item?
USACE Response Q37: Bid Item 0025 is an Option Bid Item.
Question 38. The job seems to be mainly a filling operations per the cross-sections drawings. There is very little cut areas shown The item 0007AB Subsoil Stripping & Stockpile 32,190 Cy Yd.
Where is this taking place. Are we removing and re-compacting the entire levee?
USACE Response Q38: Refer to item 2 response.
Question 39. The 100’ limit added in Amendment No.1, for disturbing the levee would exponentially increase the cost of this project as it would add 31 mobilizations to every crew both general and subcontractor on this project?
USACE Response Q39: The 100’ maximum levee disturbance is necessary to maintain the levee for flood protection.
Question 40. Can tree removal and steel sheeting be done in one mobilization. If temporary erosion control is in place can topsoil re-spread be done over the entire job?
USACE Response Q40: Per Section 31 23 19, the contractor’s shall sequence construction to maintain levee protection during construction.
Question 41. Can we stock pile stripped material on site if erosion control measures are in place around stockpile?
USACE Response Q41: Refer to item 8 response. Erosion control measures for stockpiles must be in accordance to section 01 57 20.01 03.

Which line item does placement of topsoil get paid under? It seems to be in multiple items.

GENERAL PROVISIONS
PART 1 GENERAL

The publications listed below form a part of this specification to the extent referenced. The publications are referred to in the text by basic designation only.

1.2 CERTIFICATES OF COMPLIANCE
Any certificates required for demonstrating proof of compliance of materials with specification requirements must be executed in two copies.
Each certificate must be signed by an official authorized to certify on behalf of the manufacturing company and must contain the name and address of the Contractor, the project name and location, and the quantity and date or dates of shipment or delivery to which the certificates apply. Copies of laboratory test reports submitted with certificates must contain the name and address of the testing laboratory and the date or dates of the tests to which the report applies. Certification shall not be construed as relieving the Contractor from furnishing satisfactory material, if, after tests are performed on selected samples, the material is found not to meet specific requirements.
1.3 RESPONSIBLITY OF THE CONTRACTOR
The Contractor shall be responsible for the professional quality, technical accuracy and the coordination of all designs, drawings and specifications furnished by the Contractor under this contract. The Contractor shall, without additional compensation, correct or revise designs, drawings and specifications.
Neither the Government's review, approval or acceptance of, nor payment for, any of the services required under this contract shall be construed to operate as a waiver of any rights under this contract or of any cause or action arising out of the performance of this contract, and the Contractor shall be and remain liable to the Government in accordance with applicable law for all damages to the Government caused by the Contractor's negligence in connection with designs, drawings and specifications, furnished under this contract.
The rights and remedies of the Government provided for under the contract are in addition to any other rights and remedies provided by law.
1.4 SUBMITTALS
Government approval is required for submittals with a "G" designation;
