The following items are applicable to this modification:
SUMMARY OF CHANGES
A. BID OPENING DATE AND TIME: The Bid Opening Date is NOT EXTENDED by this Amendment, therefore, bids are due by 1:00 p.m. (Central Time) on 28 August 2017. Detailed information regarding the submission of bids is located at Section 00100 of the Solicitation document – See “IMPORTANT BID NOTES.”
B. WAGE DETERMINATION: This Amendment encloses the Wage Determination, General Decision IL18, dated 4/7/2017, which was inadvertently omitted from the Solicitation package posted to the Federal Business Opportunities Website on July 28, 2017.
C. CONTRACTOR’S INQUIRIES: By this Amendment, the Chicago District, USACE responds to Contractor’s inquiries
(SEE THE FOLLOWING PAGE).
D. POINT OF CONTACT: The Point of Contact (POC) for this Amendment is Ericka Hillard at 312‐846‐5378; email ericka.d.hillard@usace.army.mil.
USACE’S RESPONSES TO CONTRACTOR’S INQUIRES FOLLOW:
Question 1: What is difference between Work of Base Bid Item 0001AD and Work of option Items nos. 0003‐0006 and 0009‐0012?
USACE Response Q1: The difference between work items under the Base Bid vs the Options are quantity increases. Option items 0003‐0006 correspond to additional quantity for the Base work. Option items 0009‐ 0012 correspond to Option item 0002, adding additional quantity.
Question 2: Is work difference quantity only, are option in addition to base bid work, or are options portions or the same work?
USACE Response Q2: The work of any bid or option item stands alone – the Contractor must accomplish all quantities awarded under each bid or option item. When options are awarded, they will result in additional quantity being executed under the contract because the options are an extension of the base work.
Question 3: If option work differs qualitatively from Base Bid work, what is difference? Do option items placement area priorities indicate different placement areas? If so, where is option placement area?
USACE Response Q3: The option work is an extension of the base work. In accordance with Solicitation Section 00100, paragraph 2a:
Options that are prioritized, if exercised, will be awarded in sequential order beginning with Group 1 Options (wherein, any item in that group may be exercised).Under this scenario, Group 1 Options would be awarded prior to all other options; then, Item 0003; thereafter, Item 0004, Item 0005 and Item 0006, etc. – With respect to the bonding option items, they will be exercised based on the group wherein contained.
‐‐Therefore, based on the aforementioned, priority numbers indicate the sequence of how option items are to be awarded. The OPTIONAL PLACEMENT AREA is located on sheet CS‐101.
Question 4: What is difference between Work of Base Bid Item 0001AD and Work of option Item 0002AE?
USACE Response Q4: This difference is the quantity and the year the work is intended to be complete.
Question 5: What is relation between option Items 0007 and 0013 and option Items nos. 0003‐0006 and 0009‐ 0012? Is this same work at different placement area?
USACE Response Q5: Bid items 0003‐0006 and 0009‐0012 reflect additional quantity options, for their respective years the work is anticipated to be complete. Bid items 0007 and 0013 are the disposal of dredged material at the optional placement area.
Question 6: Is the bid guarantee to be based on the entire aggregate for all items including options, or on the Base Bid items intended as the initial award?
USACE Response Q6: In accordance with Solicitation Section 00100, FAR Clause 52.228‐1 (c): The amount of the bid guarantee shall be 20 percent of the bid price or $3M, whichever is less.‐ Therefore, the bid guarantee shall be in 20% of your TOTAL AMOUNT OF YOUR BID, TO INCLUDE ALL BASE AND OPTION ITEMS.
Question 7: Will USACE accept offers or voluntary alternate bid involving use of auger/ suction equipment?
USACE Response Q7: No. The means of dredging must me mechanical, as specified in 35 20 23.13.
Question 8: Has a Government pre‐dredge survey been conducted? Are results available?
USACE Response Q8: http://navigation.usace.army.mil/Survey/Hydro# contains the surveys from previous years. The most current on the website is from April of this year. A pre‐dredge survey will not be conducted until approximately 30 days prior to work beginning.
Question 9: The Contractor is required to have a current certification from the DQM at time of offer, or can a system be installed upon award of contract?
USACE Response Q9: The contractor is only required to have the certification prior to work beginning and must use the system at all times while performing work for the contract. 35 21 23.13
Question 10: FBO Synopsis states, “To be considered small for purposes of this procurement, a firm must perform at least 40 percent of the volume dredged with its own equipment or equipment owned by another small dredging concern.” If prime contractor is using equipment owned by another small dredging concern, does equipment owner need to be registered as Federal contractor at time of offer? At time of performance?
USACE Response Q10: In accordance with Solicitation Section 00700, FAR Clause 52.219‐3(c): Offers are solicited only from HUBZone small business concerns. Offers received from concerns that are not HUBZone small business concerns will not be considered. Therefore, to be eligible to compete for this acquisition, your firm must meet the business size standards to place a bid. The eligibility must be met prior to submitting a bid, which occurs prior to awarding the contract or at the start of performance.
Question 11: Section 00700 ‐ Contract Clauses, 52.219‐3 NOTICE OF HUBZONE SET‐ASIDE OR SOLE SOURCE AWARD. Is this contract considered to be work under paragraph (3) General construction? (i) At least 15 percent of the cost of contract performance to be incurred for personnel will be spent on the HUBZone prime contractor's employees; or paragraph (4) Construction by special trade contractors. (i) At least 25 percent of the cost of contract performance to be incurred for personnel will be spent on the HUBZone prime contractor's employees?
USACE Response Q11: Paragraph (3) applies.
Question 12: Section 00700 ‐ Contract Clauses, 52.219‐3 NOTICE OF HUBZONE SET‐ASIDE OR SOLE SOURCE AWARD. Where paragraphs (3) and (4) reference “percent of the cost of contract performance to be incurred for personnel”, does this include direct labor only, or does this include all personnel, including administration, supervision, testing, and direct labor?
USACE Response Q12: In accordance with Title 13 of the Code of Federal Regulations, Part 125.6, the definition for “Cost of contract performance incurred for personnel” is as follows:
Direct labor costs and any overhead which has only direct labor as its base, plus the concern’s General and Administrative rate multiplied by the labor cost.
Question 13: For bid item number 0007 and 0013, the below information is listed. Can you confirm whether or not this must be provided with the bid or is this for reference only and to be provided if awarded?
The Contractor shall provide the following rates to aid in supporting payments for this line item: Overhead %_________; G/A%__________, and profit%__________
USACE Response Q13: In accordance with Solicitation Section 00010, at the extended descriptions of the respective bid items, it states: The Contractor shall provide the following rates to aid in supporting payments for this line item: Overhead %_________; G/A%__________, and profit %__________. Therefore, yes, the bidder shall complete those fields as a part of the bid pricing schedule. Any bidder failing to enter these rates required by the relevant line items may have its bid rejected for being non‐ responsive to the essential elements of the Solicitation.
Question 14: Specification Section 01 57 20.01 03 – Environmental Protection Attachment 1 – Illinois Environmental Protection Agency. The 401 Certification included in the solicitation states that it covers the Waukegan Approach Channel and Advanced Maintenance Area. If the Outer Harbor Contract Item 0002AF is exercised/awarded will the water quality monitoring and sediment sampling requirements as stated in the current 401 permit be required by the contractor or will this be completed under a separate contract?
USACE Response Q14: The current 401 permit does not allow dredging in the outer harbor. At this time, there are no additional testing requirements. Water quality monitoring and sediment sampling apply to the approach channel. However, there is no water quality monitoring for this contract.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
