The following items are applicable to this modification:
SUMMARY OF CHANGES
AMENDMENT PARTICULARS:
A. BID DUE DATE AND TIME: The due date and time for bids for the referenced Solicitation (Invitation for Bids, No. W912P6-16-B-0013) IS NOT CHNAGED by this Amendment; therefore, bids are due by 2:00 PM (CDT) on 23 September 2016. However, the receipt of BIDS remains contingent upon the USACE-Chicago District’s receipt of the 401 Water Quality Certification Permit, a Finding of No Significant Impact (FONSI), and a Consistency Determination under the Coastal Zone Management Act, which is anticipated on 21 September 2016. Bidders will be notified of the receipt via an Amendment.
B. USACE RESPONSES TO CONTRACTORS QUESTIONS:
Question 1. The insurance requirements (general liability, auto, employers) are far above what small businesses such as ours generally carry. Can these requirements be changed to match typical limits required for projects of this $1m-$5m magnitude? We will not be able to bid the project otherwise.
USACE Response 1. The insurance requirements must remain at the current limits due to the nature of the work to be performed.
Question 2. What is the established fish window referenced in section 35 30 00 paragraph 1.3.4.2? Will that be determined in permits before the bid?
USACE Response 2. The USACE is currently coordinating a fish window that covers a period of time from December 15 through March 15th that will be in effect during the project in years 2016, 2017, and 2018. Final window dates will be available with the 401 water quality certification, which will be provided under the Amendment notifying prospective bidders of the USACE’s receipt of the permits.
Question 3. In coordinating with our blasting subcontractor, he pointed out the most urgent issue--that blasting is estimated by the square foot since the number of holes to drill and set charges in is much more time consuming than the actual cubic yards removed. Since the precise bedrock elevation is unknown, we don’t know if this is a $2 million project or an $8 million project. It depends entirely on how many square feet the contractor assumes must be covered to achieve the required cubic yards. Is there any guidance USACE can provide on how many square feet bidders should assume? The borings show anywhere from no soft sediment to more than 12” above the rock. Without bid items paid by the square foot, a huge risk is put on the contractor.
USACE Response 3. USACE is paying in cubic yards (per specifications section 01 22 00.00 10) to be able to accurately pay for rock removed based on pre- and post- dredge surveys. The area shown on the drawings contains areas of rock that need to be removed along with areas where rock is already below the required depth and does not need to be removed. Therefore, the contractor will need to determine, based on the information provided, a square footage that will be required to reach the removal amount requested within the area on the plans and use that to form the basis of the cost to perform the work. In utilizing the prism included in the drawings, a contractor can approximate feet of removal and use that to calculate an
W912P6-16-B-0013 approximate square footage of rock blasting that will be required to achieve the cubic yards of rock to be removed.
