This Amendment EXTENDS the Bid Opening date for this Solicitation. Accordingly, the Bid Opening Date is changed from 3 July 2014 to 9 July 2014; the time for opening bids remains 2:00 p.m. CDT, therefore, all bids must be furnished PRIOR to 2:00 p.m. on 9 July 2014 to be considered timely.

The Contingency Statement posted to Page 1 of the Solicitation document is hereby removed as the USACE has received the Section 10, IL State Permit. Said permit is enclosed herew ith.

AMENDMENT PARTICULARS:

A. AMENDED SOLICITATION SECTIONS:

(1) Section 00010: The Bid Schedule issued with the Solicitation has been revised to incorporate multiple changes; therefore, a new Bid Schedule is being issued hereunder. Accordingly, Bidders shall replace the previously issued Bid Schedule with the Revised Bid Schedule included in this Amendment and is required to fully complete ALL line items to be considered responsive to the IFB and eligible for a contract award.

(2) Section 00010: At paragraph 2 under “IMPORTANT NOTES REGARDING THIS ACQUISITION,” the exercise of Options paragraph is changed to read as below; this language is also being included at the bottom of the Revised Bid Schedule:

EXERCISING OF OPTION ITEMS:

The Government intends to immediately award the Base Bid Items. At the discretion of the government, the OPTION Items in the Bid Schedule may be awarded at the bid prices stated in the Bid Schedule within the timeframes stated below. Note: The Government does not guarantee any work beyond the Base Bid work (items).

• Any, all or none of Line Items 0010, 0014 and 0017‐0022 may be exercised within 60 calendar days following the contract award. The number of construction days to be added if any item is exercised is 0 calendar days. Any award/exercise of an option item will be accomplished via a formal contract modification under the contract.

B. AMENDED PROJECT SPECIFICATION SECTIONS: The following Specification Sections have been amended as delineated below; therefore bidders shall remove the affected pages and replace them with the respective pages attached hereto.

‐ Section 01 22 00 – “Job” items have been renamed to “Lump Sum” and CLINs have been renumbered to match the revised bid schedule.

‐ Section 01 57 21 ‐ Reference to the pending IL State Permit (Section 10) has been removed.

Permit is attached at the end of revised section.

C. AMENDED PROJECT DRAWING SHEETS: One drawing sheet has been amended as delineated below;

therefore bidders shall replace the affected sheet with the respective sheet attached hereto.

‐ Drawing sheet C‐102 (revised to correct the location of work limits 14 and 15)

D. WAGE RATES: This Amendment incorporates the correct Davis Bacon wage rates, IL140018, dated 05/23/2014, which are attached hereto.

USACE RESPONSES TO CONTRACTOR’S QUESTIONS

Inquiry #1: Clauses: 52.211‐10 Commencement, prosecution, and Completion of Work: Allows 400 calendar for completion of work. Section 01‐57‐20: No Dredging is allowed in the approach Channel in 2015 unless the government is provided new permits for the work. Does the FY14 approach channel dredging have to be complete in 2014 or is it expected the new permits will be provided and work can take place in 2015?

Does the inner harbor dredging need to be complete in 2014?

USACE Response #1:

a. The FY14 Approach Channel dredging will need to be completed this calendar year. The FY15 option work will be dependent upon receipt of the necessary permit.

b. The Outer Harbor or as you referred to it, the inner harbor, (inside the outer breakwater, but outside of the inner breakwalls) does not need to be completed in this calendar year.

Inquiry #2: Please clarify if the seawall at the land disposal site is included in the work limits. If you protect the wall and accept responsibility for damage, can you moor barges there and place a crane along the wall to off load barges?

USACE Response #2: The sea wall is within the work limits as shown on plan sheet C‐002. Placement of equipment on site is at contractor's discretion assuming it meets specified requirements and fits within the prescribed site layout plan on sheet C‐101. Any damage to existing site facilities would need to be repaired at contractor's expense.

Inquiry #3: General Wage Decision Number: IL20130019 dated 01/24/2014 is included in the solicitation which covers Dredging Construction Projects on the River System in Illinois. In the past, Chicago District dredging projects have always included General Wage Decision Number IL140018 which covers Dredging and Marine Construction on the Great Lakes and is the correct determination for this solicitation. A Heavy and Highway determination should also be included to cover the land based disposal area requirements of the solicitation.

USACE Response #3: The contractor is correct. By this Amendment, the USACE has made the necessary correction by incorporating the attached Wage Determination into the Solicitation.

Class IV - Deck Equipment Operator(Machineryman/Fireman) (Four equipment units or more) Off Road Trucks, Deck Hand, Tug Engineer and Crane Maintenance 50 ton capacity and under or Backhoe weighing 115,000 pounds or less, assistant tug operator.

WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is union or non-union.

Union Identifiers

An identifier enclosed in dotted lines beginning with characters other than "SU" denotes that the union classification and rate have found to be prevailing for that classification. Example: PLUM0198-005 07/01/2011. The first four letters , PLUM, indicate the international union and the four-digit number, 0198, that follows indicates the local union number or district council number where applicable , i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination.

The date, 07/01/2011, following these characters is the effective date of the most current negotiated rate/collective bargaining agreement which would be July 1, 2011 in the above example.

Union prevailing wage rates will be updated to reflect any changes in the collective bargaining agreements governing the rates.

0000/9999: weighted union wage rates will be published annually each January.

Non-Union Identifiers

Classifications listed under an "SU" identifier were derived from survey data by computing average rates and are not union rates; however, the data used in computing these rates may include both union and non-union data. Example: SULA2004-007 5/13/2010. SU indicates the rates are not union majority rates, LA indicates the State of Louisiana; 2004 is the year of the survey; and 007 is an internal number used in producing the wage determination. A 1993 or later date, 5/13/2010, indicates the classifications and rates under that identifier were issued as a General Wage Determination on that date.

Survey wage rates will remain in effect and will not change until a new survey is conducted.

1.3 JOBLUMP SUM PAYMENT ITEMS

Payment items for the work of this contract for which contract joblump sum payments will be made are listed in the BIDDING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular joblump sum or unit price payment item, shall be included in the listed joblump sum item most closely associated with the work involved. The joblump sum price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

1.1.1 Mobilization and Demobilization (Bid Items 0001 and Option Bid Item 002119)

1.1.1.1 Payment

Payment at the applicable joblump sum price shall include all costs for mobilization and demobilization of all the Contractor's plant and equipment. Payment constitutes full compensation for all plant, labor, equipment, and incidentals associated with mobilization and demobilization as defined in the special clause payment for mobilization and demobilization.

1.1.5 Project and Safety Signs (Bid Item 0002)

1.1.5.1 Payment

1.1.2 Silent Scow Inspector (Bid Item 0003)

1.1.2.1 Payment

Payment will be made at the contract joblump sum price for the payment item "Silent Inspector Implementation," and the price shall constitute full compensation for all labor, equipment, tools, and incidentals necessary to install, operate and maintain the system as specified in Section 35 21 23 NATIONAL DREDGING QUALITY MANAGEMENT (dqm) PROGRAM for the duration of the dredging operations. Fifty (50) percent of the joblump sum bid shall be for furnishing and installing the necessary equipment and fifty (50) percent of the amount bid shall be for operating and maintaining the system. Any down time due to fault of the Contractor or Contractor's equipment will be an amount determined by percentage of time deducted from 50% of the bid amount.

1.1.4 Pre-Survey (Bid Item 0004)

1.1.4.1 Payment

Costs associated with this item shall be included in the joblump sum contract price. Payment for the performance and payment bonds under each option shall only cover the cost required to perform the work within that option.

1.4 UNIT PRICE PAYMENT ITEMS

1.1.12.2 Unit of Measure

1.4.1 Maintenance Dredging and Disposal at Placement Area 1 for Approach Channel Dredging (Bid Items 0009AA, and Option Bid Items 0009AB10, 00240, 0025 1, 00262, 00273, 00284, 00295)

1.4.1.1 Payment

Payment for dredging, handling and disposal of dredged materials in Placement area 1 will be made at the contract unit price per cubic yard as described in Section 35 20 23 MECHANICAL DREDGING. Existing conditions shown on the drawings indicate conditions at the time of survey. Actual conditions may vary. Monthly partial payments will be based on approximate quantities determined by the progress payment quantity surveys taken by the Contractor or other means acceptable to the COR. All survey shall be performed in accordance to Section 35 20 23 MECHANICAL DREDGING, paragraph "Measurement".

As of the time of contract award, the Government is in the process of procuring new permits for dredging in the Federal Navigation Approach Channel in 2015. It is not known when those permits will be obtained. No dredging work in the Approach Channel or Advanced Maintenance area is allowed until after those permits have been obtained, which will determine the award of the Approach channel optional bid items. All conditions associated with those permits must be adhered to for any 2015 Approach Channel dredging, including but not limited to sediment sampling, sediment and elutriate analyses, and water quality monitoring if required by the Illinois Environmental Protection Agency as part of the permit.

1.4.1.2 Measurement

The Contractor shall, in the presence of the COR, take soundings after dredging to confirm that the proposed dredging depths have been completed.

The program and methods for calculating quantities must be submitted in the dredging operation plans and approved by the COR prior to pre-dredging survey by the Contractor.

(a) Method of Measurement. The total amount of materials removed and to be paid for under the contract will be measured by the cubic yard in place by computing, within the limits of the allowances and tolerances the volume between the bottom surfaces shown by the prior and after survey soundings. The "after dredging survey" shall be made as soon as practicable after the work specified has been completed. Results of soundings by an approved method will be the basis for payment. Once the post-dredge soundings have confirmed that the proposed depths have been reached, the Contractor and the Government shall agree on an estimated percent of completion based upon plan quantities and surface area completed.

(b) Survey Prior and During Progress of Work. The contract drawings are believed to represent accurately the conditions existing at the time of survey, however, all soundings of the proposed dredging areas shown on the drawings shall be verified and corrected by a "prior dredging survey" consisting of soundings taken before dredging occurs. Contract depth will be determine by soundings or sweeping taken behind the dredge as work progresses. The Contractor shall take progress soundings or sweepings in the presence of the COR. The measurement and computation of payable quantities within the allowances and tolerances described in this section after having once been made, will not be reopened, except on evidence of collusion, fraud, or obvious error.

(c) Excessive Dredging. Material taken from beyond the limits specified in paragraphs "Allowable Dredging Prism" and "Side Slope" of Section 35 20 23 MECHANICAL DREDGING, will be deducted as excessive channel or sideslope dredging, from the total amount dredged for which payment will not be made. The final determination of the amounts of excessive dredging will be based wholly on the surveys made for final examination and acceptance. See paragraph, "Final Examination and Acceptance", of Section 35 20 23 DREDGING.

(d) Pre, Post and Progress Payment Quantity Surveys shall be performed in accordance with Section 35 20 23 MECHANICAL DREDGING. Additional soundings will be taken as the COR may deem necessary.

(e) Monthly Estimate. Monthly estimates of work completed will be based on the result of soundings taken during the progress of the work based on an estimated percent of completion. Deductions will be made for dredging and disposal not in accordance with the specifications.

1.4.1.3 Unit of Measure

1.4.2 Maintenance Dredging and Disposal for Outer Harbor Dredging (Bid Items 0010AA 3 and 0010AB4)

1.4.2.1 Payment

1.2 DEFINITIONS

1.2.1 Environmental Pollution and Damage

Environmental pollution and damage is the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life;

affect other species of importance to humankind; or degrade the environment aesthetically, culturally and/or historically.

1.2.2 Environmental Protection

Environmental protection is the prevention/control of pollution and habitat disruption that may occur to the environment during construction. The control of environmental pollution and damage requires consideration of land, water, and air; biological and cultural resources; and includes management of visual aesthetics; noise; solid, chemical, gaseous, and liquid waste; radiant energy and radioactive material as well as other pollutants.

1.2.3 Contractor Generated Hazardous Waste

Contractor generated hazardous waste means materials that, if abandoned or disposed of, may meet the definition of a hazardous waste. These waste streams would typically consist of material brought on site by the Contractor to execute work, but are not fully consumed during the course of construction. Examples include, but are not limited to, excess paint thinners (for example, methyl ethyl ketone and toluene), waste thinners, excess paints, excess solvents, waste solvents, excess pesticides, and contaminated pesticide equipment rinse water.

1.2.4 Clean Construction and Demolition Debris (CCDD)

As defined by the Illinois Environmental Protection Agency, CCDD is uncontaminated broken concrete without protruding metal bars, bricks, rock, stone, or reclaimed asphalt pavement generated from construction or demolition activities. When uncontaminated soil is mixed with any of these materials, the uncontaminated soil is considered CCDD.

1.2.5 Hazardous Waste

Wastes designated by the U.S. Environmental Protection Agency as hazardous, as defined in 40 CFR 261.

1.2.6 Land Application for Discharge Water

The term "Land Application" for discharge water implies that the Contractor shall discharge water at a rate which allows the water to percolate into the soil. No sheeting action, soil erosion, discharge into storm sewers, discharge into defined drainage areas, or discharge into the "waters of the United States" shall occur. Land application shall be in compliance with all applicable Federal, State, and local laws and regulations.

1.2.7 Surface Discharge

The term "Surface Discharge" implies that the water is discharged with possible sheeting action and subsequent soil erosion may occur. Waters that are surface discharged may terminate in drainage ditches, storm sewers, creeks, and/or "waters of the United States" and would require a permit to discharge water from the governing agency. All projects with land disturbances greater than or equal to one acre in total area must have a National Pollution Discharge Elimination System (NPDES)Construction Site Activity Storm Water Permit to discharge surface water from a construction site, issued by the Illinois Environmental Protection Agency. All projects with discharge of dredged or fill material to waters of the United States must have a Section 401 Water Quality Permit issued by the Illinois Environmental Protection Agency.

1.2.9 Waters of the United States

All waters which are under the jurisdiction of the Clean Water Act, as defined in 33 CFR 328.

1.2.10 Wetlands

Wetlands means those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, and bogs. Official determination of whether or not an area is classified as a wetland must be done in accordance with

WETLAND MANUAL.

1.3 GENERAL REQUIREMENTS

The Contractor shall minimize environmental pollution and damage that may occur as the result of construction operations. The environmental resources within the project boundaries and those affected outside the limits of permanent work shall be protected during the entire duration of this contract. The Contractor shall comply with all applicable environmental Federal, State, and local laws and regulations. The Contractor shall be responsible for any delays resulting from failure to comply with environmental laws and regulations.

1.4 SUBCONTRACTORS

The Contractor shall ensure compliance with this section by subcontractors.

1.5 PAYMENT

No separate payment will be made for work covered under this section. The Contractor shall be responsible for payment of fees associated with environmental permits, application, and/or notices obtained by the Contractor. All costs associated with this section shall be included in the contract price. The Contractor shall be responsible for payment of all fines/fees for violation or non-compliance with Federal, State, Regional and local laws and regulations.

1.6 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government.
