E. USACE’S RESPONSES TO CONTRACTOR’S INQUIRIES

Q1. What is your expectation for dewatering during this project both at the ditch work and the box structure installation? The borings for HA3 and PA2 show that we will be in the water when placing the stone under the box structure.

A1. It is anticipated that the construction work and regrading of the ditch will lower the static water in this area during the drier summer months of July, August and September. Refer to Specification Section 01 57 20.02 03 for dewatering procedures as part of the Environmental Protection Plan. Also, a Dewatering Work Plan shall be submitted as described in Specification Section 31 00 00. Finally, dewatering is included in the cost for certain bid items described in Specification Section 01 22 00.00 03.

Q2. I understand 36" RCP in lieu of 33" RCP is not acceptable. Would you consider pouring a 33" restrictor into the 36" concrete pipe. 33" pipe would most likely have to come from Minnesota or Ohio or a form rental would be required, either will add considerable cost to the 33" pipe.

A2. Reference the USACE’s response to Question #39 of Amendment 0001, dated 17 Feb 2012, the response should have read as: Contractor’s shall bid on the 3’x 4’ box culvert, as specified in the Bid Set. Subsequent to the contract award, the winning Contractor may propose material savings via the Value Engineering Contruction Clause, 52.248-3.

Q3. Between Stations 71+50-72+50 on Sheet C-13 shows a fill on the contour lines and shows a cut on the profile. Also, cross sections on Sheets C-51 and C-52 show fills.

Please clarify.

A3. There was a software error when producing the existing contours shown in the plan view on Sheet C-13 and existing profile shown on Sheets C-51 & C-52. The profile view on Sheet C-13 best represents the existing conditions of a plateau or “land bridge” between Sta. 71+50 to 72+50. This area must be excavated to install the new 33” RCP and shall be regraded to the elevations shown in the plan/profile view on Sheet C-13.

Q4. Just spoke with pipe supplier and he cannot find any type 2 pipe 33" in diameter. Please advise.

A4. Reference the USACE’s response to Question #39 of Amendment 0001, dated 17 Feb 2012, the response should have read as: Contractor’s shall bid on the 3’x4’ box culvert, as specified in the Bid Set. Subsequent to the contract award, the winning Contractor may propose material savings via the Value Engineering Contruction Clause, 52.248-3.

Q5. [Question] #39 in Addendum #1 appears to ask if a 38” x 60” elliptical pipe could be substituted for the 3’ x 4’ box culvert. The governments answer is that the pipe could be substituted if the cross sectional area is greater or equal. Rausch Construction believes this answer is improper. The project is designed and the CLIN call out for 36” x 48” Precast Box Culvert. The low base bid should be evaluated on that basis. If a contractor want to submit a VE proposal after award to substitute a elliptical pipe for the box culvert, then that is the proper time for that substitution. If the government wants to issue a alternate bid documents indicating the use of a 38’ x 60” elliptical pipe then all the contractors and material suppliers can submit bids on that. The answer to this question, the way it was issued, could result in the government comparing apples to oranges if some contractors pricing is based on the IFB design and others are on some alternate pipe section not shown on the IFB. With all due respect this is not the way lowest, responsive, responsible bidding is supposed to work. We formally request the government issue another addendum stating the lowest bid will be based on the IFB which has a 36” x 48” precast concrete box culvert and elliptical pipe could be considered in a VE proposal.

Q6. Plans/specs clearly indicate that there is to be 4" of topsoil re-spread along the box culvert section. However, it is not as clear on what to do for the ditch and fill areas (along

Rohrman Rd.) Is 4" topsoil to be re-spread along those sections (prior to the erosion blanket)?

It appears as if there is very little existing true topsoil. So if we are to place topsoil along the ditch/fill areas, then will the contractor be required to import topsoil as part of this contract? Or will that be handled as a change order later?

A6. Per Specification Section 31 00 00 and the “RCP Trench Detail” on Sheet C-16, a minimum of 4” of topsoil shall be placed to ensure grass growth. Topsoil excavation and placement is part of the unit cost for CLIN 0010 so the contractor shall identify areas of topsoil strip before excavation. Soil testing in the ditch after excavation is highly recommended to ensure material suitable for plant growth.

Additionally, attention to the material from the wetland excavation (Sheets C-03 & C- 04, Sta. 20+00 to 28+50) should be given for use as topsoil respread. It is anticipated all excavated topsoil can be reused onsite as respread.
