G. USACE RESPONSE’S TO CONTRACTOR’S INQUIRIES: Provided below are the USACE’s responses to Contractor inquiries. The block of inquiries represent the questions that have been received from the issuance of the Bid Package through August 3, 2011.

QUESTION: Dredging Projects of this scope can consume a very significant amount of fuel a year and are one of the largest cost factors on a dredging project. How does the government anticipate the contractor to present fair and reasonable pricing and not have to make inflated assumptions for the cost of fuel five years from now?

Has the government considered some sort of fuel escalation clause?

USACE’S RESPONSE: This being a multiple year contract, contractors shall escalate their fuel costs for the out-years when bidding on this contract. Thus, no escalation clause will be incorporated into the contract.

QUESTION: Are contractor questions and government responses going to be posted on FBO?

USACE’S RESPONSE: Yes; responses will be posted via an Amendment on FBO.

QUESTION: References:

1) Section A (page 2 of 194), “Important Notes Regarding this Acquisition”, Paragraph 2;

2) Section L (page 175 of 194) Subsection 1.1 “Who may Submit,” Paragraph 2;

AND

3) Section L (181 of 194) Subsection 2.1 “Proposal Requirements” Subfactor 5A: Prime Contractor Experience

Reference 3 requires information to be included under TAB 5A (Prime Contractor Experience) in the submitted proposal for the prime contractor to present descriptions of projects completed that include a minimum cumulative of 5 years experience in mechanical dredging, hydraulic sediment transport and placement, disposal facility operation, and water management services. Similarly, requirements are identified for listing of at least three projects each that present experience in water treatment using mobile equipment , and ambient and real-time air monitoring.

References 1 and 2 indicate that “firms organized as construction contractors that have associated specifically for this project, or other interested parties may submit proposals. In the latter case the association may be a joint venture or a subcontractor.”

In many cases, the prime contractor or “offeror” will be comprised of an integrated team of contractors established to collectively perform the primary elements of the Statement of Work while retaining a small number of “niche” subcontractors to provide specialty products and services. In this case the association may be based on a formalized teaming agreement that establishes the relationships of the teaming partners but not based on the formation of an LLC or other similar entity to identify the “offeror” as being comprised of two or more contractors. In reading the requirements addressed in the discussion we have interpreted the term “Prime Contractor” as presented to mean the “offeror” , which may be comprised of a team of two or more contractors not necessarily comprised of a formalized LLC but who are bound by a formalized teaming agreement.. Given that the interpretation is appropriate in this case, would the 5 year requirement and other experience requirements be met using a combination of the experience from the contractors comprising the “offeror’s” team? Please provide clarification on this requirement.

USACE’S RESPONSE: The solicitation requires that the offeror, being the "prime," provide its experience where requested and that the subs experience be addressed where requested. As the prime, it cannot comingle its subs experience with its PRIME experience to meet the necessary technical experience called out in the respective EVALUATION FACTOR.

QUESTION: Section L – Instruction, Conditions and Notices to Bidders (Sub-factor 5A) Prime Contractor Experience: --If the Prime Contractor can demonstrate experience for mechanical dredging, hydraulic sediment transport and placement and disposal facility operation for similar projects performed with the USACE can it use a subcontractor to meet the experience requirements for the wastewater treatment and air monitoring?

USACE’S RESPONSE: Per the provisions stipulated by Subfactor 5A, the "Prime Contractor" experience must be demonstrated in the areas of "wastewater treatment and air monitoring," meaning, the experience cannot be satisfied by your proposed sub.

QUESTION: We have reviewed the announcement, plans and specifications for this important project. Upon review of the documents we cannot locate information concerning; Has a date / timeline been set for an on-site prebid / site meeting??

Do you anticipate this type of a meeting to take place?? If a meeting date has been scheduled, is there a specific registration process to attend?

USACE’S RESPONSE: A pre-proposal meeting has not been scheduled as of yet; once the specifics have been determined, contractors will be advised via the Notice (announcement) for this procurement, which is published on the Federal Business Opportunities Website.

Contractors will not have to register for the pre-proposal meeting.
