Scope of Work – Tree Planting and Maintenance at Rockland Recreation Area
1. General Requirements
The Contractor will be responsible for planting and maintaining trees at Rockland Recreation Area, following this Scope of Work (SOW), its attachments, and all applicable legal requirements.
• All work must be completed in line with industry standards, current EM 385-1-1 safety guidelines, and the specifications outlined in this document.
• Work may take place while the recreation area is open to the public, requiring the Contractor to exercise caution. No holes or excavations may be left unattended.
• Coordination with the Rockland Rebuild Construction Contractor (AIS Infrastructure, LLC) is essential to prevent scheduling conflicts and ensure smooth project execution.
Before beginning work in a new planting area, the Contractor must coordinate with the designated technical point of contact (POC).
• When working near active construction, all Contractor personnel must wear appropriate personal protective equipment (PPE), including hard hats, steel-toe boots, high-visibility vests, eye protection, and hearing protection as required.
• The Contractor is responsible for adhering to the schedule outlined in this document and its appendices.
• If needed, the Government’s technical POC may approve alternate planting locations, zones, or tree species in writing. However, the Government is not obligated to accept proposed changes if they do not align with project goals.
2. Excavation, Soil Handling, and Restoration
• The Contractor is responsible for assessing soil conditions in planting areas before starting work.
• Any soil or materials removed during the project become the property of the Contractor and must be disposed of in accordance with all Federal, State, and Local regulations.
• All disturbed areas, including those affected by digging, excavation, or heavy equipment, must be restored. Restoration includes smoothing the ground, removing debris, and applying Kentucky 31 Tall Fescue seed at a rate of 200 lbs. per acre, covered with ½ inch of soil and straw mulch (two tons per acre).
• The Contractor must take precautions to avoid damaging surrounding property. Any accidental damage must be repaired or replaced to its original condition.
• If cultural materials, human remains, or other historical artifacts are discovered during work, the Contractor must follow the procedures outlined in the Discovery Plan (Attachment 3). Previously identified sensitive areas are noted in Attachment 2.
3. Tree Planting
The project includes the excavation of soil, planting of trees, and their initial maintenance.
• Trees will be planted within the five designated planting zones:
1. Boat Ramp
2. Shelters 3 & 4
3. Behind RMO
4. Playground and Volleyball Court
5. Shelter Complex
• The Contractor’s certified arborist must oversee the planting process and follow industry best practices.
• The Contractor should complete all tree planting in one zone before moving to the next, with written approval from the technical POC.
• The Government reserves the right to add additional tree planting under Option 3, as outlined in Attachment 2.
• Trees must be at least 2 inches in diameter at breast height and arranged to resemble a natural, manicured forest—avoiding repetitive or geometric patterns.
• Trees (except Bald Cypress) must be planted at least 10 feet from the water’s edge of Old Hickory Lake. Bald Cypress trees should be placed within 10 feet of the water’s edge.
• The minimum spacing between trees must follow industry standards but should not be less than 20 feet from center to center of the nearest trees.
• Trees should be planted at least 15 feet from paved surfaces, buildings, and other structures, with measurements taken from the tree’s centerline.
• The Contractor must avoid interfering with underground utilities and coordinate with the technical POC when planting near utility lines.
4. Tree Maintenance
Tree maintenance is required during the initial contract period. The Government may also exercise Option 1 and Option 2, which extend maintenance for two additional 12-month periods after the initial work is completed. Maintenance includes:
• Watering as needed to establish and maintain tree health. The Contractor may use water from Old Hickory Lake with prior written approval from the Nashville District’s water resource management office.
• Weeding and mulching around tree bases.
• Implementing methods to maximize tree survival throughout the contract period.
• Replacing any trees that die during planting or the maintenance period.
5. Coordination with Other Contractors
Multiple contractors will be working in Rockland Recreation Area simultaneously. The Contractor must:
• Check in with the technical POC before starting work in a new area.
• Plan tree planting activities to avoid interfering with active construction under the Rockland Rebuild project. Construction of foundations, pavilions, and other structures takes priority over tree planting in those areas.
6. Open Recreation Spaces
The Government requires at least one designated open area (between 2,500 and 10,000 square feet) with no trees planted to provide recreational space for park visitors. The Contractor must incorporate this into the planting plan.

Old Hickory Tornado Recovery Post-Review Discoveries, Unanticipated Effects, and Inadvertent Discoveries Plan for the Rockland Recreation Area and Tailwater/Left Bank Debris Removal, Rockland Recreation Area Redevelopment, and the Rockland Recreation Tree Planting Projects.
In the event of the discovery of cultural materials, sites, human remains, associated funerary objects, or other indicators of past human use, the Corps will ensure that all activity in the general area ceases, and the area is secured with a minimum of a 50-foot buffer. The individual(s) who made the discovery will immediately notify all appropriate parties, including the Corps Contracting Officer, Real Estate Manager, the Tennessee State Historic Preservation Office (SHPO), and Historic Preservation staff (Archaeologist or Historian). The Corps will make the determination if the discovery includes human remains and/or associated funerary objects.
The Old Hickory Tornado Recovery Projects for the debris removal, redevelopment, and tree planting are located on Corps property. In the event an inadvertent discovery of human remains and associated funerary objects occurs, the Corps will ensure that activities stop, and the location is secure and will be responsible for complying with the Native American Graves Protection and Repatriation Act (NAGPRA).
The Corps will ensure that stipulations related to post-review discoveries are included in construction contracts and apply to contractors. In accordance with Federal Acquisition Regulations the Corps Contracting Officer (CO) will be the main communicator with any contractor and has the authority to stop work and direct resumption of work.
Discoveries not involving human remains
When the Corps determines the discovery does not involve human remains then the Corps will notify the SHPO and the Tennessee Division of Archaeology (TDOA) and reinitiate consultation pursuant to 36 CFR Part 800.13. The discovery will be considered eligible for the National Register of Historic Places (NRHP) for the purposes of Section
106. The Corps will submit a new site record to the TDOA. The Corps will develop plans to avoid and minimize effects to the discovery. If impacts to the discovery cannot be avoided, the Corps will resolve adverse effects pursuant to 36 CFR Part 800.6.
When, through consultation with the SHPO, the discovery is either determined not to be eligible for the NRHP or adverse effects have been resolved through the execution of a Memorandum of Agreement (MOA), then the Corps may resume work in accordance with the terms of the consultation.
Discoveries involving human remains
In the event that human remains are encountered, the Corps will secure the area with a minimum 50-foot buffer, notify local law enforcement, coroner, State Archaeologist, and Corps cultural resource staff.
If such remains constitute a crime scene, all applicable laws and procedures will apply.
Attachment 3 - Discovery Plan
Should the remains be taken into federal custody and be determined to be American Indian in origin, associated funerary objects or object of cultural patrimony, the Corp will be responsible for compliance with Section 3 of the Native American Graves Protection and Repatriation Act (NAGPRA).
The Corps will notify the SHPO and all Indian Tribes with an interest in the discovery within 72 hours of the determination. The initial notification will occur by e-mail and followed with written notification.
If the human remains are not of American Indian origin, the Corps will assume the remains are eligible for the National Register of Historic Places and consult with the SHPO pursuant to 36 CFR Part 800.13(c).
The Corps will review construction plans to determine if avoidance and protection is feasible. The Corps will consult with the SHPO to obtain concurrence on the avoidance and protection measures.
If avoidance is not feasible, then the Corps, in consultation with the SHPO, will develop a Burial Removal Plan. Burial removal plans will include a Real Estate takings analysis to ensure appropriate compensation occurred at the time of federal land acquisition.
Burial removal will comply with all applicable state laws and will be executed by forensic anthropologists or mortuary archaeologists implementing specific requirements included in the Burial Removal Plan.
When, through consultation with the SHPO, the discovery or adverse effects been resolved through the execution of an MOA, then the Corps may resume work in accordance with the terms of the consultation.
