AMENDMENT 0003 Q&A

W912P521R0002 Chickamauga Upstream Approach Wall Construction Project

Questions and Answers Amendment 0003

51. Will the contractor be required to repair pre-existing cracks on the approach wall beams?

Answer: Pre-existing cracks in the approach wall beams must be repaired. Specification Section 03 41 34, Paragraphs 1.4, 3.1.2 and 3.1.5, Section 01 22 00, Paragraph 1.4.3.5, and CLIN 0305 have been added or updated.

52. Will the contractor be required to repaint portions of the approach wall beams where the paint system has failed?

Answer: Yes. Specification 09 97 02, Paragraph 3.6, Section 01 22 00, Paragraph 1.4.9, and CLIN 0901 have been added.

53. Are as-builts available for the ramp facility at Watts Bar?

Answer: No. Current as-builts for the ramp facility at Watts Bar are not available.

54. Reference plan drawing 61W520-82-UAW, Bearing Elevation A – Please verify non-shrink grout under elastomeric bearing pad is to be placed in the dry or in the wet.

Answer: The non-shrink grout shall be placed in the dry. Specification Section 03 30 01, Paragraph 2.8 has been updated. The Government may consider a variance request after award, but additional detail would be required to determine if this is acceptable and Offerors should develop their proposals in accordance with the current requirements.

55. At Watts Bar, can the concrete foundation take initial jacking loads of approx. 405psi [58,188psf]?

Answer: There is not enough detail in the question for the Government to provide an accurate answer.

56. Please verify only the exposed portions of embedded metal is coated, meaning there is no coating to the concrete embedded portion of the metal.

Answer: Please reference Specifications section 09 97 02, paragraph 3.1.2, which has been updated.

57. Specification section 31 63 27 Drilled Shafts for Approach Walls Part 1.10 Site Conditions provides general information of an unknown circular object in the footprint for some of the drilled shafts. Due to the unknown magnitude of the work required to deal with this obstruction and possible obstructions at other piers, we suggest that pricing for the drilled shaft not include any assumed cost for this work and that USACE add an allowance item which the contractor can submit the time and materials cost for reimbursement for any needed investigating and the work needed to deal with the obstructions.

Answer: Assume the obstruction to be removed is sheet pile embedded 20 feet into the river bottom. Specification Section 31 63 27, Paragraph 3.2, Section 01 22 00, Paragraph 1.4.31.3, and CLIN 3103 have been added.

58. Electrical Junction Box Specification reads: “Size as indicated on drawings, UL 50, NEMA 4X stainless steel. Furnish all junction boxes with screw-fastened covers. Boxes are to have a continuous hinge on one edge, with poured in place gaskets.” Hinged covers with screw covers are not standard. We would be dealing with very long lead times due to stainless shortages at customs. Will the owner consider hinged cover with clamps? They would still meet the stainless and NEMA requirements specified.

Answer: Specifications Section 26 05 00, Paragraph 2.1.2 has been updated.

59. We request the USACE consider including an escalation clause in the contract, as of the bid due date, due to the extreme volatility of pricing currently being experienced with lumber and steel and to ensure consistency in the overall pricing of proposals submitted by the Offerors.

Answer: The Government will not include economic price adjustment in this contract.

60. Ref spec. section 01 57 19, paragraph Environmental Commitments, #7 (page 270/1118): Freshwater mussel surveys and relocation would be required. Given the new lock construction timeline, mussel surveys are anticipated to occur after contract award. Mussel survey results are generally accepted for 2 years before additional surveys are required. No drilling or in-river, or in-reservoir disturbance is allowed until consultation with USFWS, TVA, and TDEC has been completed by USACE; and no in-river or in-reservoir work would occur before May 1 or after October 31, and when river water temperature reaches 60 degrees Fahrenheit of higher.

a. Is a mussel survey to be performed by the USAW Contractor?

b. Is this paragraph stating no in-reservoir work may occur after October 31 until May 1?

Answer: This portion of the paragraph has been removed. Specification Section 01 57 19, Paragraph 3.17 has been updated.

61. Ref spec. section 01 50 00, paragraph 1.3 Submittals (page 204/1118): Is a Government Field Office required to be furnished by the USAW Contractor?

Answer: Specifications Section 01 50 00, Paragraph 1.3 was updated to remove the Government Field Office submittal.

62. Ref. spec. section 03 31 07, paragraph 1.8.a.4 (page 930/1118):

a. Please confirm this demonstration test is the Technique Shaft shown in the plan drawings.

b. Please identify the depths of the 12-ea. cores.

c. Please identify the location of the one (1) longitudinal and one (1) transverse dissections of the concrete specimen.”

Answer:

a. Yes, this demonstration is for the technique shaft shown in the plans.

b. The depths of the cores will be determined by the Government Contracting Officer's Representative (COR) in the field.

c. The depths of the one (1) longitudinal and one (1) transverse dissections of the concrete specimen will be determined by the Government COR in the field.

*Drawings 61W520-16-UAW & 61W520-18-UAW that were referenced in question 31 in amendment 0002 Q&A have been updated with Amendment 0003.

SECTION 00 21 00

PROCEDURES FOR SUBMITTAL OF OFFERS

AND

PROPOSAL EVALUATION APPROACH

1.0 Submittal of Offers

1.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein.

However, in order to be effectively and equitably be evaluated, the proposals must include information sufficiently detailed to clearly describe the Offeror's past performance, technical approach, safety management, and small business participation plan necessary for successful completion of the project. The requirements stated in this RFP are minimums.

1.2 Offerors shall submit their proposals to the Government no later than the time and date specified in Block 13 of Standard Form 1442 of this solicitation. Detailed submission instructions are listed above in section Instructions to Offerors, paragraph 6.0, Where to Submit & Submittal Deadline.

1.3 Offerors are required to submit a proposal made up of Past Performance, Technical Approach, Safety Management, Small Business Participation Plan, Price, and Pro Forma. All proposal materials shall be submitted via the SAFE website with a bookmarked table of contents and/or a standard electronic Tab Index. The sections should parallel the submission requirements identified below. Volume I shall be submitted in Portable Document Format (PDF) and shall be either tabbed or bookmarked to reflect the division of Factors in accordance with paragraph 3. Volume II shall be submitted as a separate PDF file and shall also be tabbed or bookmarked in accordance with paragraph 3, Proposal Information and Related Evaluation Factors.

*NOTE: Provide the complete Volume I proposal submittal including text, renderings, drawings, photographs, etc.

on SAFE site. Provide the complete Volume II proposal submittal on SAFE site with the final price breakout schedule electronically.

2.0 Proposal Evaluation Process

2.1 A Source Selection Evaluation Board (SSEB) comprised of representatives of United States Army Corps of Engineers will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence. Technical proposals will be reviewed and rated without knowledge of the price offered. The number and identities of Offerors are not revealed to anyone who is not involved in the evaluation and award process or to other Offerors. Proposals will be evaluated based on the factors described herein, and the basis of award is the Best Value Tradeoff Process.

2.2 The evaluation process essentially consists of three (3) parts: ( 1 ) proposal compliance review and responsibility determination; (2) past performance, technical, and price evaluations; and best value decision.

2.2.1 Proposal Compliance Review: This is an initial review to ensure that all required forms and certifications (if applicable) are complete and that a past performance, technical, and price proposal were received.

2.2.2 Past Performance and Technical Evaluations: The SSEB will evaluate and rate the proposals against the RFP requirements. Some factors will be rated using an adjectival-based system. Others will be rated on an “acceptable/unacceptable” basis. Past Performance will be rated based on recency/relevancy and confidence.

2.2.3 Price Evaluation: The SSEB, Cost Engineering, and the Source Selection Authority (SSA) will evaluate price proposals independent of the technical evaluation. The SSEB will not have access to price information until completion of the technical2 evaluation.

2.2.4 Best Value Decision: After all, above evaluations are complete the SSA performs this assessment by comparing the strengths, weaknesses, and the cost/price of the competing proposals to determine which proposal represents the best value to the Government.

3.0 Proposal Information and Related Evaluation Factors.

3.1 Proposals will be evaluated in accordance with the factors listed in relative order of importance.

Note: To be eligible for award, Factor I, Past Performance, must be rated at least “Neutral Confidence,” and Factors II - IV, must be rated at least “Acceptable.”

All non-cost/price factors, when combined, are approximately equal to cost or price. Offerors are reminded to include their best past performance, technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interest of the Government.

No Confidence Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will successfully perform the required effort.

Technical Approach and Safety Management Combined Technical/Risk Ratings

Adjectival Rating Definition Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements and/or risk of unsuccessful performance is high.

Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is un-awardable.

The following Definition of Risk chart defines the level of risk listed in the above chart, Combined Technical/Risk Ratings:

Definition of Risk Applied to Combined Technical/Risk

Ratings Risk Level Definition

Low Proposal may contain weakness(es) which have little potential to cause disruption of schedule, increased cost or degradation of performance.

Normal contractor effort and normal Government monitoring will likely be able to overcome any difficulties.

Moderate Proposal contains a significant weakness or combination of weaknesses which may potentially cause disruption of schedule, increased cost or degradation of performance. Special contractor emphasis and close Government monitoring will likely be able to overcome difficulties.

High Proposal contains a significant weakness or combination of weaknesses which is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special contractor emphasis and close Government monitoring.

Unacceptable Proposal contains a material failure or a combination of significant weaknesses that increases the risk of unsuccessful performance to an unacceptable level.

Small Business Participation Plan Ratings

Acceptable Proposal indicates an adequate approach and understanding of small business objectives.

Unacceptable

Proposal does not meet small business objectives.

3.7 Definitions

1. Adverse Past Performance is past performance information that supports a less than satisfactory rating from sources where the information is from other than formal rating systems such as Contractor Performance Assessment Reporting System (CPARS) or Federal Awardee Performance and Integrity Information System (FAPIIS).

2. Best Value means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement. See FAR2.101.

3. Clarifications are limited exchanges between the Government and Offerors that may occur when award without discussions is contemplated. See FAR 15.306(a)(1).

4. Communications are exchanges, between the Government and Offerors, after receipt of proposals, leading to establishment of the competitive range. See FAR 15.306(b).

5. Competitive Range - See FAR 15.306(c).

6. Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See

FAR 15.001.

7. Discussions are exchanges (i.e., negotiations) in a competitive environment that are undertaken with the intent of allowing the Offeror to revise its proposal. Discussions take place after establishment of the competitive range.

See FAR 15.306(d).

8. Evaluation Notice (EN) is the Procuring Contracting Officer’s (PCO) written notification to the Offeror for purposes of clarifications, communications, or discussions.

10. Recency, as it pertains to Past Performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant.

11. Relevancy, as it pertains to Past Performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.

12. Risk, as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor may involve risk of disruption of schedule, degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.

13. Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.

14. Source Selection Authority (SSA) is the official designated to make the source selection decision.

4.0 Volume I – Factor I (Past Performance) – Performance Assessments

The Past Performance Confidence Assessments will consider an Offeror’s previous relevant experience with similar projects. If the Offeror does not self-perform all work on this contract, then the Offeror must clearly demonstrate that its major subcontractors have the relevant technical experience, of a similar scope and complexity as required in the Specifications, for the portion of work they will perform.

Offerors relying on the technical experience of a subcontractor will be required to provide evidence of a firm commitment (i.e., signed agreement or letter of commitment) from the subcontractor to perform if the Offeror is awarded the contract.

4.1 Submission Requirements:

Each Offeror shall provide descriptions of at least three (3) but not more than five (5) past or current construction projects completed, or substantially complete (75% or more), within the last twenty (20) years (from the solicitation issuance date) that are similar to this project in scope and magnitude. The Offeror must submit at least one (1) project they have performed as the prime contractor. If any firm has multiple functions or divisions, limit the project examples to those performed by the division, unit or team member submitting the offer.

Detailed project information shall be provided using the Project Detail Sheet format described at the end of this section. Ensure the proposal clearly describes which work the Offeror and the subcontractors performed.

In order to demonstrate relevant past performance, Offerors must submit detailed information for projects that are similar in scope and magnitude as further defined below.

Similar in scope: An individual project must meet a minimum of two (2) criteria. The collective portfolio of submitted projects must meet all four (4) criteria listed below:

a. Working alongside other contractors or operations, that are not part of your contracting/subcontracting team, requiring extensive coordination between entities;

b. Marine construction based experience with bedrock removal in areas that require a degree of precision to a prescribed tolerance;

c. Structural and mass concrete placements in marine environments and placement of concrete underwater;

d. Heavy lift/transportation of large/oversized items.

Similar in magnitude: The project(s) submitted to satisfy criteria (a), (b), and (c) above shall be valued greater than $35 million to be considered similar in magnitude. The project(s) submitted to satisfy criteria (d) above shall be valued greater than $2 million to be considered similar in magnitude.

The format for Project Details is included at the end of this section. Use as many forms as necessary to meet the criteria. If you elect not to use the formats, all information identified on the formats is still required for evaluation of this item.

The Past Performance Questionnaire (PPQ) included in the solicitation is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor I Performance

Confidence. Ensure correct phone numbers and email addresses are provided for the client point of contact.

Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s).
