In the past the USACE has taken care of that and there is no mention of this requirement in the specification. Is this part of the solicitation because we are delivering via tractor trailer and have no equipment for this?

Government Response: Answer:

Cheatham Lock is the only site that the contractor is responsible for providing the means and methods for delivering and unloading the liners and fillers. The Contractor is responsible for delivering the fabricated items to Nickajack and Wilson Lock, but not the unloading of the fabricated items. The Government will be responsible for unloading the liners and the fillers at Nickajack and Wilson Lock.

For additional information, see Specification 01 11 00 – 1.1.1 Project Description; Specification 01 22

00.00 10 – 1.1.3 Unloading Cheatham Structural Components; and Specification 05 50 14 – 1.3.1 Delivery, Storage, and Handling.

Government Response: Cheatham Lock – 2, Nickajack Lock – 4, and Wilson Lock – 4. One Filler Hanger is required for each Slot Filler Hanger Recess in the Cheatham, Nickajack, and Wilson Slot Liners.

40. Industry Question/Comment: Will the USACE be issuing Alabama and Tennessee sales tax exemption certificates for this project?

Government Response: As a general rule, by operation of sovereign immunity, the Federal Government is exempt from state and local sales taxes. Therefore, when submitting bids, bidders should not include sales taxes on their bids. However, the sales tax exemption only applies where goods and services are being purchased "directly" by the Federal Government. Therefore, even though a contractor may be purchasing materials or services in the performance of a contract for the Federal Government, such goods and services are subject to state and local sales taxes because they are being purchased by the contractor "indirectly" for the Federal Government.

41. Industry Question/Comment: The solicitation states that the fabricator will deliver the slot liners and fillers to their respective project locations (FOB Destination), but the Bid Schedule includes Item No’s 0003, 0006, & 0008 for “Unloading”. Are we to provide both equipment and labor to offload the product at each site or will COE forces be doing the unloading and the pricing is merely to include the freight cost to deliver the product to each of the three locations?

Government Response: See the Government’s Response to Question No. 39.

42. Industry Question/Comment: If the proposals are to include equipment and labor to unload the slot liners and fillers (not unloaded by COE equipment & labor), please provide site details (for all three sites) that include details indicating where the product is to be unloaded, where the product is to be placed for storage and any weight capacity limitations that may limit equipment selection and use.

43. Industry Question/Comment: Specification Section 01 11 00 paragraph 1.1.1 states “The Contractor is to unload the Slot Liners and Slot Fillers for Cheatham Lock. Government is to unload the Slot Liners and Slot Fillers for Nickajack Lock and Wilson Lock.” The bid schedule in the solicitation has “Unloading” line items for each lock.

Please clarify whether the Government or contractor is unloading at the Nickajack Lock and Wilson Lock.

44. Industry Question/Comment: Is it acceptable for the bidder to submit a complete hard copy of their online SAM Representation and Certifications in lieu of Section 00600?

Government Response: No, prospective bidders should provide their SAM Representation and Certifications in accordance with Section 00600.

45. Industry Question/Comment: Will redlined mark ups of PDF files be allowed for As-Built/Record Drawings in place of drawing files produced in AutoCAD or MicroStation format since this is a fabrication only supply contract?

Government Response: No. The Contractor is to provide as-built shop drawings in the same format as the initial shop drawing submittal. The Contractor is not required to update As Awarded – Certified Final CAD drawings provided by the Government.

46. Industry Question/Comment: Can you clarify the delivery dates required for each location? The dates listed in Section F, Deliveries or Performance on page 7 of 41 of the solicitation differ from those listed in Section L Instructions, Conditions and Notices to Bidders on page 38 of 41 in the solicitation.

Government Response: The delivery date for Cheatham Lock liners and fillers is March 30, 2021. The delivery date for Nickajack Lock liners and fillers and Wilson Lock liners and fillers is June 30, 2021.

47. Industry Question/Comment: To allow for flexibility in response due to COVID-19, will electronic signatures, mechanically applied or printed dates be accepted as original signatures for this bid?

Government Response: Yes. Electronic signatures and printed dates will be accepted as original signatures for purposes of the Blocks 17 and 18 on the SF 33.

48. Industry Question/Comment: To allow for flexibility in response due to COVID-19, can there be a waiver of the corporate seal and notary requirements on documents controlled by FAR part 28?

Government Response: There is no requirement for any corporate seal and notarized documents.

49. Industry Question/Comment: Specification Section 01 78 00, paragraph 3.1 requires that As-Built drawing be submitted 30 days prior to Beneficial Occupancy Date (BOD). Can this requirement be deleted as this is a fabrication supply contract with no “occupancy requirements”?

Government Response: Contractor shall submit As-Built drawings and all native design and model files associated with the production of the As-Built drawings no later than 30 days after the delivery of the fabricated items.

50. Industry Question/Comment: To allow for flexibility in response due to COVID-19, can any “paper copy” submittal requirements be waived with only electronic file submission being required?

Government Response: No paper copies of submittals are required.

51. Industry Question/Comment: Can ASTM A706 Rebar be provided instead of ASTM A615 to allow better weldability?

Government Response: Yes.

52. Industry Question/Comment: Can Corner Caps fabricated from bent/rolled plate steel be allowed instead of castings? With such a small quantity of Corner Caps required the casting costs will be quite excessive

Government Response: See answer to Question 33 regarding the fabrication of the Corner Caps.

53. Industry Question/Comment: Specification Section 05 50 14, paragraph 2.3.2 requires that “structural unit be operated a sufficient number of complete cycles to demonstrate satisfaction of Contracting Officer”. Please confirm that no “use” testing of structural assemblies will be required.

Government Response: Confirmed. Confirmed. The requirements in Specification 05 50 14, paragraph

2.3.2 were removed in Amendment 0001.

54. Industry Question/Comment: Can clarification of weld NDT requirements be provided. Several places in the drawings indicate “100% NDT” in the weld symbol tail but this does not dictate which form (UT, PT, MT etc.) of NDT is required.

Government Response: 100% of welds regardless of construction require a visual inspection following the requirements of Specification 05 50 14, paragraph 2.3.3.1. All other welds shall be inspected using the specific testing procedure and frequency listed for each weld construction as described in Specification 05 50 14, paragraph 2.3.3.2.3.
