PERFORMANCE WORK STATEMENT

SCOPE OF WORK. The Contractor shall furnish all necessary management, supervision, inspection, personnel, materials, supplies, parts, tools, equipment, transportation, and vehicles required to perform the removal of 13 windows and replace them with new ones. Disposal of the old windows shall be the responsibility of the contractor. Lead paint and asbestos is present, see Environmental Program Section below. The existing steel windows are character-defining features of this National Register of Historic Places (NRHP) eligible building. Therefore the replacement windows shall have the same frame material (metal), pattern, pane size, and translucence as that of the existing windows. The contractor shall measure, order and install the new replacement windows that are tempered, multi-pained and energy efficient with a low emissivity rating. Each window shall have the ability to be opened to allow fresh air inside. New windows shall be installed according to manufacturer’s recommendations. Contractor shall ensure a finished installation product that properly fits window opening and is appropriately sealed to ensure no air gaps are present. Window sill trim in areas were paneling exist, shall be trimmed using stained wooden boards and corresponding trim pieces. All concrete window sills shall be painted to cover scrapes and scratches that occur during installation. A 41” X 33” section of 4” concrete block shall be removed in order to install one of the windows. Opening portions of windows shall be fully functional and hardware operational. Once installation is complete windows shall be cleaned and all construction dust and debris removed. Damage to windows and openings that occurs as a result of this contract work, shall be the responsibility of the contractor for repair.

The Contractor’s work and responsibility shall include, but shall not be limited to, all planning, administration and management necessary to assure that the window replacement service is conducted in accordance with all applicable laws, regulations, codes, or directives.

Work shall be complete within 90 days from the Notice of Award.

Location of work. Barkley Maintenance Shop, 213 Administration Drive, Grand Rivers KY.

WORKING HOURS.

a. NORMAL WORKING HOURS. Normal working hours and days, except as otherwise specified or approved in advance by the Contracting Officer Representative (COR), shall be

Monday through Friday, between 7:30 a.m. and 4:00 p.m. Work shall not be performed on holidays.

The ten federal holidays observed are:

New Years Day (January 1st) Martin Luther King's Birthday (3rd Monday in January) Washington's Birthday (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th)

PERMITS AND LICENSES. The Contractor shall, at his/her own expense, obtain any licenses or permits required to perform the contract. The Contractor shall comply with all current federal, state, and local laws and regulations and shall comply with any subsequent changes.

SAFETY AND SECURITY REQUIREMENTS. Work shall be performed in a safe manner.

If the Contractor fails or refuses to promptly comply with safety and security requirements as specified herein, the COR may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor shall comply with all current provisions of the Occupational Safety and Health Act (OSHA) in addition to the standards of the Corps of Engineers Manual, EM 385-1-1, "Safety and Health Requirements Manual." A copy of EM 385- 1-1 can be viewed at the following website:http://140.194.76.129/publications/engmanuals/em385-1-1/208_English/toc.html. The contractor will be notified of any changes to EM 385-1-1 during the contract period and upon notification thereof the contractor shall adhere to such changes. The Contractor shall submit a written Safety Plan before the contract begins and an Activity Hazard Analysis (AHA) for each area of work prior to commencing work on the contract.

DAMAGE REPORTS. In all instances where Government property and/or equipment is damaged by Contractor employees, it shall be the contractor’s responsibility to repair or replace the damage.

CONTRACT EMPLOYEES. All contract employees and subcontractors shall conduct themselves in a proper manner at all times. Continued improper behavior will be grounds for the removal of an employee from Government property by the COR. No alcoholic or intoxicating beverages or substances or illegal drugs or controlled substances not prescribed by a physician shall be possessed, consumed, or be under the influence of any such substance while on site.

DAMAGE OR LOSS OF CONTRACTOR'S SUPPLIES AND PROPERTY. The Contractor is responsible for taking the action necessary to protect all Contractor property and the personal property of Contractor employees from loss, damage, or theft. The Government assumes no responsibility for theft, damage, etc., of the above.

ENVIRONMENTAL PROGRAM. An Asbestos and Lead Survey has been conducted.

Window caulking was tested at four location in the building and determined to be present (<1%) in the exterior window mullion caulking. Lead was also detected in the wall paint at multiple locations. The survey results will be available to contractors for study and review Monday thru Friday from 8am until 4pm, at the Natural Resource Shop Building located at 213 Administration Drive, Grand Rivers KY. 270-362-8122. If the contractor determines that further testing is required, it will be the responsibility of the contractor.

The Contractor shall identify all hazardous waste associated with conducting required work, and properly label, handle, and dispose of such waste in accordance with applicable regulations. It shall be the contractor’s responsibility to protect the building’s interior/exterior and contain any paint chips, dust or other debris that may occur as a result of removal and replacement of the windows. All associated construction residue, debris, scrap etc. shall be disposed of according to all federal, state and local laws. Disposal cost shall be the responsibility of the contractor.

Disposal cost include but are not limited to: disposal of old windows, abatement, recovery and disposal of all lead paint and asbestos as well as other construction waste and residue. The Contractor shall address hazardous materials and hazardous waste on an Activity Hazard Analysis form prior to commencing work

The contractor shall furnish Material Safety Data Sheets (MSDS) or Safety Data Sheets and an inventory list for all items stored or in use by the contractor employees on Government facilities

The Contractor shall comply with all other Federal, State, and Local laws, regulations, and standards regarding environmental protection. As initial reference, many Federal regulations are identified in the Environmental Assessment and Management guide and the Corps of Engineer’s Environmental Review Guide for Operations (ERGO) manual, Environmental Assessment and Management (TEAM) Guide Manual and Occupational Safety and Health Act (OSHA) manual;

however Kentucky State Regulations are also applicable to work performance in this contract.

GOVERNMENT FURNISHED ITEMS (GFI).

Electrical. 110v electrical outlets will be available to the contractor to run power equipment.

Compressed air may be available unless it is being used by government employees. The COR may approve a tool and material storage area for the contractor. Access to this area will only be available Monday thru Friday from 7:30am until 4pm.

CONTRACTOR FURNISHED ITEMS.

Except as described elsewhere in this contract, the Contractor shall furnish all personnel, management, inspection, facilities, vehicles, transportation, equipment and operators, supplies, tools, materials and parts necessary to accomplish all required services.

SUSTAINABILITY

The Contractor shall utilize energy- and water-efficient building-related products and equipment, per the following link to the list of DOE Covered Product Categories:

The contractor shall utilize energy- and water-efficient building-related replacement windows.

All deliverables shall be printed double sided on paper that contains post-consumer fiber (recycled content).

The Contractor shall comply with the following specifications for sustainable products:

Use of Sustainable Design and Development principles Low or no toxic or hazardous chemicals (e.g., low VOC paint) Use of chemicals and products that do not contain ozone-depleting substances (ODS).

Note that if FAR clause 52.223-11 is included, it does not indicate compliance. This clause requires contractors to label products with ODS, but does not address the use of alternatives.

Use of biobased products for equipment maintenance

SECURITY

For this project the Contractor shall comply with the following security requirements:

All contractor and associated sub-contractor employees shall comply with all applicable project and local security policies and procedures (provided by the district representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by the District Security Management Office. Contractor workforce must comply with all personal identity verification requirements (FAR Clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

Since the work is being done within a controlled area but is expected to last less than six months, the investigation requirements fall under Category B1 for US Citizens and Category C for Foreign Nationals. Contract employees will need to be supervised/ escorted by a Corps employee while within the restricted area. In the event it is determined the contract will extend beyond six months, the contractor will need to comply with the requirements in Category B2 for US Citizens. Convict Labor: Because the work is being performed in a restricted area, there are restrictions on use of persons either imprisoned or previously convicted of a felony. The Contractor shall not employ in the performance of this contract any person undergoing a sentence of imprisonment imposed by any court of a State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, or the U.S. Virgin Islands, or the US Federal Government. The Contractor shall not employ in the performance of this contract any person who has been convicted of a felony imposed by any court of a State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, or the US Federal Government.

All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.

For this project the Contractor shall comply with the following security requirements only if he/she will be performing work at the Government facility for a total of 60 days or more:

All contractor and subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I Awareness Training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each applicable contract employee and subcontractor employee, to the COR or to the Contracting Officer (if a COR is not assigned), within 5 calendar days after completion of training by all contract personnel. AT Level I Awareness Training is available at the following website: http://jko.jten.mil/courses/atl1/launch.html . Each contract employee must take the training individually to receive a training certificate.

The contractor and all associated sub-contractors shall receive training on the local Suspicious Activity Reporting Program. This locally developed training will inform employees of the types of behavior to watch for and provide guidance on who to contact to report suspicious activity.

This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training." All new contractor employees will complete Level 1 OPSEC Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC Awareness Training. The contractor shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR or to the Contracting Officer (if a COR is not assigned), within 5 calendar days after completion of training.
