QUOTE INSTRUCTIONS FOR HVAC SERVICES:

1. DESCRIPTION OF WORK: This service is a 100% set-aside for Woman-Owned Small Business

(WOSB) to provide replacements of the heating, ventilating and air condition (HVAC) units, which include the removal and disposal of the existing units at Center Hill Lake, Lancaster, TN in accordance with the attached scope of work. HVAC units shall be of a name brand American Standard, York or approved equal.

2. TYPE OF CONTRACT: The Government intends to award a Firm-Fixed Price services contract.

3. BASIS FOR SELECTION OF AWARD: Award shall be made to the lowest priced offeror who is found to be responsible. Quotes must meet or exceed the scope of work/specifications to be considered for award. The contractor shall provide HVAC equipment specification sheets with their quote. The Government will review the specifications sheet to ensure the equipment meets the Government’s specifications.

4. PLACE OF PERFORMANCE: Center Hill Lake Resource Management Office (RMO) located at 158

Resource Lane, Lancaster, TN

5. PERIOD OF PERFORMANCE: The completion date for this requirement is 60 days from contract award.

6. SITE VISIT: Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of the contract performance (FAR 52.237-1).

The Government has scheduled a Site Visit for May 24th at 9:00 a.m. Central Time. All attendees shall meet at the Center Hill Lake Resource Management Office (RMO) located at 158 Resource Lane, Lancaster, TN 38569. No other site visit will be scheduled or granted.

NOTE: All participants are required to have personal safety equipment, i.e. hard hat and safety toe shoes.

Contractors who do not have these items present at the Site Visit may not be able to participate in the visit.

7. REQUIREMENT TO REGISTER TO ATTEND SITE VISIT: Only registered persons will be permitted to attend the site visit. In addition to the below information, please also provide your name of firm, firm’s CAGE and/or DUNS number, and name and position title of primary point-of-contact and their telephone number and email address. Only two persons from each business entity will be permitted to attend.

U.S. Citizens: To register, U.S. citizens interested in attending the site visit must submit a Nashville District (LRN) Security Access Form to the Point of Contract (POC), Contract Specialist Eugenia Corder, by email to Eugenia.J.Corder@usace.army.mil no later than five (5) days prior to the site visit. If submitting the form in less than five days, the person may not receive approval for participation. Notification of approval or denial will be provided prior to the date of the site visit. The form is available as a pdf attachment on www.fbo.gov with this solicitation and is titled as Site Visit Registration Form.

Foreign Nationals (FNs): FNs wishing to attend the site visit shall submit a completed LRN FN Security Form and legible color copies of two of the following documents: Passport (unexpired or expired), Certificate of U.S. Citizenship (INS Form N-560 04 N-561), Certificate of Naturalization (INS Form N-550 or N-570), unexpired foreign Passport with I-551 stamp or attached INS Form I-94 indicating unexpired employment authorization, an Alien Registration Receipt Card with photo (INS Form I-151 or I-551), unexpired Temporary Resident Card (INS Form I-688), unexpired Employment Authorization Card (INS Form I-688A), unexpired Reentry Permit (INS Form I-327), unexpired Refugee Travel Document (INS- Form I571), or unexpired Employment Authorization Documentation issued by the INS which contains a photograph (INS Form I-688B) to the LRN POC. 8. 10. SUCCESSFUL OFFEROR: The following may be requested from the apparent successful offeror prior to actual award of the contract:

SCOPE AND SPECIFICATIONS

Scope and Specifications:

The new Heating, Ventilating, and Air Conditioning (HVAC) units replace existing HVAC units at the Resource Management Office, maintenance compound work bay and carpenter shop. Over the past couple of years numerous repairs have been made to the existing units, and due to age, the units need to be replaced. The unit supplying the shop work bay no longer works and estimates indicate that cost to repair are near the cost to replace.

Location

Center Hill Resource Management Office (RMO) is located at 158 Resource Lane, Lancaster, TN, off of Interstate 40E at exit 268, approximately 5 miles south.

Section 1 – Replace HVAC at Resource Management Office Scope of Work

The contractor shall furnish, deliver and install the following for the RMO: One, five ton [5TN] split unit; One, two ton [2TN] split unit; and One, one and a half Ton split unit [1.5TN]. These unit shall also be of a name brand American Standard, York or approved equal.

The scope for the work shall be: The contractor shall be responsible for removal and disposal of the existing units. The government shall be provided documentation assuring Freon has been collected according to all required laws and regulations. This documentation shall be provided prior to removal of the units from the worksite. The contractor shall provide all necessary supplies to install the new units. This shall include new concrete pads, any additional wiring (copper), breakers, conduit, and drain pans with float switches to include any plumbing to carry overflow condensation from the drain pans to a waste line. This work shall include programmable thermostats for each of the newly installed units etc.

All of the new systems shall be electric with the capacity to supply emergency heat properly rated for each unit, shall hold an energy star rating, and standard warranty for commercial applications. All units shall have a minimum 13 seer.

Work days are Monday – Friday from 7:00am to 3:00 pm. The designated work/storage area will be identified prior to start of work. A list of workers shall be identified by name and provided to the government prior to start of work. Workers will be required to wear identifying clothing or name tags.

Qualifications of installers shall be submitted prior to beginning of work.

The contractor shall provide owner’s manuals, warranty information and training on maintenance of the units and operation of the thermostats.

The contractor shall be required to make modifications to the existing duct work to comply/conform with the new units.

Note: all electrical work shall be performed according to current N.E.C. code requirements. All new wiring shall be copper, installed in conduits of proper size.

Specifications for Resource Management Office

Safety

All work shall be performed in accordance with safety requirements set forth in the Corps of Engineers safety manual, EM 385-1-1, entitled “Safety and Health Requirements Manual” revised 30 November 2014. A copy will be available for review. The work area must be clearly marked to warn visitors of any hazards. All work areas must be taped off to keep the general public out. At the end of each day, the contractor will assure that the area is checked to eliminate any safety hazards. The contractor shall comply with requirements of EM 385-1-1 lock-out/tag-out of electrical energy. Prior to the start of work the contractor shall submit an Activity Hazard Analysis and conduct a safety meeting. This meeting and review shall be attended by the contractor superintendent, his workers and a representative of the government.

Security

Access and General Protection/Security Policy and Procedures

All contractor and associated sub-contractor employees shall comply with all applicable project and local security policies and procedures (provided by the district representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by the District Security Management Office. Contractor workforce must comply with all personal identity verification requirements (FAR Clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

Contractors who do not require CAC, but require access to a Department of Defense (DoD) facility or installation.

Background investigations for U.S. Citizens who will work (a) within a control area, (b) on a government information system and/or (c) have access to government funds will be submitted in accordance with the appropriate level in Category B.

Convict Labor

Because the work is being performed in a restricted area, there are restrictions on use of persons either imprisoned or previously convicted of a felony. The Contractor shall not employ in the performance of this contract any person undergoing a sentence of imprisonment imposed by any court of a State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, or the U.S. Virgin Islands, or the US Federal Government. The Contractor shall not employ in the performance of this contract any person who has been convicted of a felony imposed by any court of a State, the District of Columbia, Puerto Rico, the Northern Mariana Islands, American Samoa, Guam, the U.S. Virgin Islands, or the US Federal Government

Will be escorted in areas where they may be exposed to classified and/or sensitive materials.

Escort Requirement will no longer apply once the Contract Representative has been notified a favorable long-term investigation (Category B3) has been completed.

Pre-screen candidates using E-Verify Program.

The Contractor must pre-screen potential employees to work on this contract using the E-verify Program (http:www.uscis.gov/e-verify) website to meet the established eligibility requirements. The Contractor must ensure that the employee has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible contract employees must be provided to the COR no later than 3 business days after the initial contract award.

*When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

Site Visits

Any pre-bid meeting which will cover anything other than public domain information shall be limited to US Citizens, except under unique circumstances.

U.S. Citizens: The Offeror/Bidder and/or Contractor shall submit a Nashville District (LRN) Security Access Form to the Nashville District Point of Contact (LRN POC) five (5) days prior to the site visit or any meeting held at or in LRN restricted/controlled areas (such as a Power Plant or Navigation Lock). If submitting the document in less than five days, the Offeror/Bidder may not receive approval for participation. The LRN POC will notify the individual(s) if the request is approval or denied.

Conduct of Contract Employees

All contract employees and subcontractors shall conduct themselves in a proper manner at all times. No alcoholic or intoxicating beverages or substances or illegal drugs or controlled substances not prescribed by a physician shall be possessed, consumed, or be under the influence of any such substance while on Government property.

The Contractor shall remove from the site any individual whose continued employment is deemed by the appointed receiving agent to be contrary to the public interest or inconsistent with the best interests of the U.S.

Army Corps of Engineers.

The Contracting Officer or the appointed receiving agent will require the Contractor to immediately remove from the work site anyone who is incompetent or who endangers persons or property or whose physical or mental condition is such that it would impair the employee’s ability to satisfactorily perform the work. Notification to the Contractor will be made in writing if time and circumstances permit. Otherwise, notification will be verbal and will be confirmed in writing as soon as possible. No such removal, however, will reduce the Contractor's obligation to perform all work required under this contract and immediate replacement shall be made as required.

52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A

FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)

(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--

(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (APR 2016)

ALTERNATE I (OCT 2014)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

(a) Definitions. As used in this provision--

“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

“Forced or indentured child labor” means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C.

395(c).

“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

“Subsidiary” means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Veteran-owned small business concern” means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business concern” means a small business concern --

(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
