Questions and Answers Old Hickory Lake O&M Requirements Contract Solicitation Number W912P5-16-R-0003
1. On a phone call with contracting personnel, I was told a bid bond was not required; however, page 116 of the RFP indicates otherwise. Can you clarify if a bid bond is required with the proposal package?
Answer: A bid guarantee is required to be submitted with the contractor’s proposal. Please see page 116 of the solicitation for FAR clause 52.228-1 – Bid Guarantee (SEP 1996).
2. Regarding the bonding requirement, the payment/performance bond is 25% of total contract price. Is that the total contract price for one year or for all five (5) years?
Answer: Typically when the contractor has submitted performance and payment bonds for O & M contracts, they have submitted them for the base year and each option year. It is up to the contractor to determine the best course of action to take for submitting performance and payment bonds for this requirement.
3. On a phone call with contracting personnel, I understood the payment and performance bond was to cover one year. If that is the case then why isn’t the P&P requirement 20% instead of 25%, which would cover one year out of five?
Answer: Upon award, the contractor must submit performance and payment bonds for the contract award price (base year). The contractor can either request an increase of surety or submit new performance and payment bonds for each option year. There is no percentage established for performance and payment bonds. The percentage is only established for the bid guarantee.
4. Page 158 of the RFP indicates that the electronic version of Volume II, Price Proposal should include “the Excel version of the Price Schedule.” Will the Government provide an excel version of the Price Schedule for the Contractor to complete?
Answer; Yes, the Government will provide an Excel version of the Price Schedule with the issuance of an amendment to the solicitation.
5. Will a teaming arrangement be permitted for this contract with the HUBZone company as Prime and the non-HUBZone company as significant subcontractor? If such a teaming arrangement is allowed, will the government allow past performance of the teaming partner (significant subcontractor) for consideration?
Answer: From page 176 of the Solicitation: “Projects performed by contractors other than the Offeror, such as teaming partners or subcontractors, will not be evaluated as prime contractor experience, unless those other contractors are part of a Joint Venture (JV) Offeror, as demonstrated by a signed JV agreement. If the Offeror represents the combining of two or more companies (JV) for the purpose of this RFP, the JV will be evaluated as a single Offeror. The experience of each joint venture partner will be evaluated based on each partner’s role in cited past work and in the proposed JV role for this project.” Additional information concerning JV partner requirements is addressed throughout the Solicitation.
6. Why does the Government not allow previously submitted PPQ’s to be included? Our references have recently completed similar ones for USACE bids and it would save our references great time and trouble in having to complete new ones?
Answer: The Government has not allowed previously submitted PPQs because any contracting requirement that requires source selection must be evaluated individually. PPQs from previous solicitations may or may not pertain to the current requirement. However, the Government will allow previously submitted PPQs for similar work if the PPQs are less than six (6) months old.
7. Regarding Section C-5 Facility Repair, Maintenance, and Other Non-Routine Work, which item numbers 0051-0108 should include the operator with the listed equipment if any? As an example, CLIN 0063 Generator – should labor be included with the pricing for the generator?
Answer: The Price Schedule furnished as a part of Amendment 0001 now has asterisks with footnotes to identify which CLINs include qualified operators or drivers.
8. Regarding Section C-5 Facility Repair, Maintenance, and Other Non-Routine Work, if labor is to be included with Section 5, how then would you bid attachments for other equipment? As an example, CLIN 0071 Auger Attachment, should the Skidsteer as well as the operator’s rate be added to the auger attachment to price correctly?
Answer: The Price Schedule furnished as a part of Amendment 0001 now has asterisks with footnotes to identify which CLINs include qualified operators or drivers. For example, CLIN 0069, 0070, and 0071 would not include a qualified operator. All three are attachments for CLIN 0068 – Skidsteer, Loader. The qualified operator would be included with the Skidsteer, Loader.
9. Regarding Section C-10.2.C, can the Government include a copy of one of the 2015 MORs associated with NPDES Permit No. TN0021491?
Answer: A sample MOR from January 2015 is furnished with this amendment.
10. Regarding Section C-10.3.B, it states that Contractor is responsible to clean and inspect for charge all fire extinguishers. Is this only for the Wastewater Treatment Plant? How many extinguishers need to be cleaned and inspected in total?

11. Regarding Section C-7.2.A, can the Government provide any historical data on the labor hours involved in boundary line marking per mile?

12. Page 158, Item 3.3 indicates that text should be 12-point Times New Roman. Does that requirement apply to resumes? Can the text on resumes be smaller font?
Answer: Text on resumes may be of a smaller font as long as it is legible to the members of the Source Selection Board.
13. Section C-3.2e Litter states to “Pick up all trash, paper…..driftwood (regardless of size and quantity)….Does this mean that large trees with their root wads still attached as well as other large driftwood that require heavy equipment to remove is only paid as regular litter under Item #0042?
Answer: Yes. The requirements for Item #0042-Litter are fully defined in Section C-3.2e. There are no special provisions for extra payment for “large driftwood” or any other litter deposited in public use areas, where Item #0042 is required/ordered, for pool elevations below 448 feet msl.
14. How many times did the water elevation reach 448 feet msl in the last 5 years resulting in driftwood removal being paid by means other than regular litter removal?
Answer: There have been no instances in the last 5 years that resulted in the payment for driftwood removal by other than Item #0042-Litter. The last event where water levels reached and/or exceeded 448 msl elevation was the May 2010 Flood Event.
