INSTRUCTIONS, CONDITIONS & NOTICES TO BIDDERS
1.0 GENERAL REQUIREMENTS
1.1 Funding Status: This Invitation for Bid (IFB) is subject to availability of funds. Funds are not currently available. No contract awards will be made until funds become available.
1.2 Intent: The intent of this solicitation is to award a target of four contracts for environmental services for the U.S. Army Corps of Engineers (USACE), Nashville District (LRN) Area of Responsibility (AOR).
1.3 Basis of Selection of Award: Award shall be made to a target of four of the lowest priced bidders who are found to be responsive and responsible. See Federal Acquisition Regulation (FAR) clause 52.214-10, Contract Award—Sealed Bidding, for more information.
The Government intends to evaluate bids for award purposes by the total price of all seed projects.
1.4 Type of Contract: The Government intends to award a target of four Firm-Fixed Price (FFP) Indefinite-Delivery Indefinite-Quantity (IDIQ) Multiple Award Task Order Contracts (MATOCs).
1.5 Who May Submit: The procurement is set-aside for 8(a) concerns only.
1.6 North American Industry Classification System (NAICS) Code and Small Business Size Standard: The NAICS code for this project is 562910, entitled “Environmental Remediation Services”. It has a size standard of 750 employees.
1.7 Pre-Bid Site Visit:
An organized site visit has been scheduled for Wednesday, August 31, 2016, 9:00 AM Central Time, at Old Hickory Dam Powerplant, 10 Power Plant Road, Hendersonville, TN 37075-3465.
Offerors should inspect the job site prior to submitting a bid. Offerors should take such other steps as may be reasonably necessary to ascertain the nature and location of the work and the general and local conditions that can affect the work or the cost thereof. Failure to do so will not relieve offerors from the responsibility for properly estimating the difficulty or cost of successfully performing the work. The Government assumes no responsibility for any understanding or representations concerning conditions made by any of its officers, agents or employees, unless included in the solicitation, the specifications or related documents. Please refer to the Federal Acquisition Regulations (FAR) clause 52.237-1, incorporated by reference.
REGISTRATION: Only registered persons will be permitted to attend the site visit. In addition to the information below, please also provide your firm’s name, firm’s CAGE and/or DUNS number, and name and position title of primary point-of-contact and their telephone number and email address. Please provide this information via email to Isaac.j.taylor@usace.army.mil.
PERSONAL PROTECTIVE EQUIPMENT (PPE): All participants are required to have PPE, i.e. hard hat, safety glasses, and safety toe shoes before entering the project site. Contractors who do not have these items present at the site visit may not be able to participate in the visit.
Contractors and/or potential contractors wishing to attend a pre-bid meeting held at or in LRN restricted/controlled areas (such as a Power Plant or Navigation Lock) shall submit a Nashville District (LRN) Security Access Form to the Contract Specialist five (5) days prior to the site visit or meeting. If submitting the document in less than five days, the Offeror may not receive approval for participation. The Contract Specialist will notify the Contractor if the request is approval or denied. Any pre-bid meeting which will cover anything other than public domain information shall be limited to US Citizens, except under unique circumstances. The Security Access Form and guidance is available at http://www.lrn.usace.army.mil/BusinessWithUs/Contracting/Contract Security Requirements.
U.S. CITIZENS: The Offeror shall submit a Nashville District Corps of Engineers U.S.
Citizen Pre-Bid and/or Site Visit Request Form to the LRN Point of Contact, Contract Specialist Isaac Taylor, no later than five calendar days prior to the site visit. If submitting the document in less than five days, the Offeror may not receive approval for participation.
The LRN POC will notify the individual(s) if the request is approved or denied. The Security
Access Form and guidance is available as a pdf attachment on www.fbo.gov with this solicitation and is titled Pre-Bid Meeting and/or Site Visit Request Form.
FOREIGN NATIONALS (FNs): All non-U.S. Citizens, including permanent residents wishing to attend the site visit must be approved in advance. FNs wishing to attend a site visit shall submit a completed Nashville District Corps of Engineers Foreign National Pre- Bid Meeting Request Form and legible color copies of two of the following documents:
Passport (unexpired or expired), Certificate of U.S. Citizenship (INS Form N-560 04 N-561), Certificate of Naturalization (INS Form N-550 or N-570), unexpired foreign Passport with I- 551 stamp or attached INS Form I-94 indicating unexpired employment authorization, an Alien Registration Receipt Card with photo (INS Form I-151 or I-551), unexpired Temporary Resident Card (INS Form I-688), unexpired Employment Authorization Card (INS Form I- 688A), unexpired Reentry Permit (INS Form I-327), unexpired Refugee Travel Document (INS Form I-571), or unexpired Employment Authorization Documentation issued by the INS which contains a photograph (INS Form I-688B) to the LRN Point of Contact, Contract Specialist Isaac Taylor, who will forward the documents to the LRN-SM mailbox (dll-celrn-sm@usace.army.mil) for approval. These documents must be submitted two (2) weeks prior to the site visit. FN requests require approval at the Headquarters U.S. Army Corps of Engineers (HQUSACE) level. Exceptions will be considered on a case by case basis but will be limited. The form is available as a pdf attachment on www.fbo.gov with this solicitation and is titled Foreign National Pre-Bid Meeting Request Form.
POINT-OF-CONTACT: For questions and /or concerns regarding the site visit, please contact Contract Specialist Isaac Taylor via email at the address referenced above.
This will be the only site visit for this project. If you miss the scheduled site visit, no other arrangements will be made due to personnel and time restrictions.
1.8 POC for Communication/Questions: Any communications regarding this procurement must be made in writing to the Nashville Contracting Branch, Attn: Isaac Taylor at email Isaac.J.Taylor@usace.army.mil or facsimile: (615) 736-7124. Inquiries must identify the solicitation number, the requestor’s company name, address, email address, telephone and facsimile numbers to include area code.
Phone calls or requests to arrange meetings at the Nashville District during the solicitation period to discuss project requirements or company’s capabilities are highly discouraged and will not be scheduled.
QUESTIONS: Questions regarding the solicitation must be submitted to Isaac Taylor via email at Isaac.J.Taylor@usace.army.mil no later than seven calendar days after conclusion of the organized site visit.
1.9 Amendments Prior to Date Set for Closing of IFB. The right is reserved as the interest of the Government may require, to revise or amend the specifications or drawings or both prior to the date set for submission of bid. Such revisions and amendments, if any will be announced by an amendment or amendments to this IFB. If the revisions and amendments are of a nature which requires material changes in quantities or prices proposed or both, the date set for receipt of bids may be postponed by such number of days as in the opinion of the issuing officer will enable bidder to revise their bid. In such cases, the amendment will include an announcement of the new date for receipt of bid.
2.0 WHAT, HOW, AND WHERE TO SUBMIT BID
2.1 The following documents must be submitted with your IFB in original and one (1) copy:

NOTE: To establish its responsibility the bidder may be requested by the Government to submit a statement regarding previous experience in performing comparable work, business and technical organization, financial resources, and plant available to be used in performing the work. The requested statement submitted will have the following: a minimum of one (1) up-to-date banking reference for their firm and a minimum of three
(3) past performance references for similar work.
a. The banking reference shall include the financial institution’s legal name, complete physical address, a point-of-contact (POC) at the financial institution, the POC’s telephone number, fax number, and email address.
b. The past performance references shall include firm’s name, the contract number, the contract period of performance and/or contract completion date, the contract’s aggregate value, a brief description of the project, a POC, the POC’s telephone number, fax number, and email address.
2.2 PUBLIC OPENING OF BIDS: Bids will be publicly opened at the time set for opening in Block 8 of the SF1449 at the Estes Kefauver Federal Building, USACE Conference Room A681 110 9th Avenue South, Nashville, Tennessee, 37203. The content will be made public for the information of bidders and others interested, who may be present. Unbalanced bids may be rejected.
2.3 Bidders shall submit sealed IFB packages to the USACE address listed below. Receipt of delivery is highly recommended. The Government will accept sealed IFB packages prior to the due date. It is highly recommended that IFB packages be received at the address listed below at least one day prior to due date to avoid a possible late bid situation. The Government will accept hand delivered packages until the time of bid closing but will not accept bids submitted via email or fax. The Government must be in receipt of your IFB by the bid closing time set forth in Block 8 of the SF1449.

3.0 INSURANCE: Contractor shall carry Liability Insurance. See FAR clause 52.228-5, Insurance – Work on A Government Installation.

4.2 Contractors shall have representations and certifications completed in www.sam.gov OR provide FAR clause 52.204-8, Annual Representations and Certifications, with paragraph (c) completed. If completing the aforementioned clause, provide with submitted bid.
5.0 BIDDERS CHECKLIST
All information required by the terms of the Solicitation must be furnished. MISTAKES OR OMISSIONS CAN BE COSTLY. Important items for you to check are included in but not limited to those listed below. This checklist is furnished only to assist you in submitting a proper bid. The Government shall not be responsible for items not described below. It is not required to be return with your bid.

STATEMENT OF OBJECTIVES
SECTION C
STATEMENT OF OBJECTIVES (SOO)
C. 1 General: The purpose of this contract is to provide a full range of non-Architect-
Engineer (A-E) environmental services to the Nashville District (LRN) of the US Army Corps of Engineers (USACE) (The Government) and Fort Campbell, Ky.
The environmental services will fall generally under the categories of environmental compliance, environmental restoration, environmental conservation, and asbestos abatement. Examples of the types of services under these categories that may be ordered under this contract are given in the sections below, although actual services ordered under task orders will not be limited to these examples. The Contractor shall furnish all materials, equipment, supplies, plant and qualified personnel, and all other services required to perform the environmental services outlined in this section and as specifically identified in individual task orders.
C.2 Governing Guidance and Documentation: The Contractor is expected to be familiar with and able to operate within the processes of all applicable environmental laws governing the site relevant to each Performance Work Statement (PWS). The execution of this work shall be in accordance with applicable USACE, United States Occupational Safety and Health Administration (OSHA) and United States Environmental Protection Agency (EPA), Kentucky Department of Environmental Protection (KDEP), and Tennessee Department of Environment and Conservation (TDEC) regulations as appropriate. The Contractor shall comply with all state and Army guidance when applicable unless otherwise stated in the PWS or directed by the LRN USACE Contracting Officer (KO). In cases where conflicts between guidance documents arise, the KO will make a final decision on how to proceed. Should the Contractor identify any additional guidance documents that could be relevant to a project, they should immediately be brought to the attention of the Contracting Officer’s Representative (COR), who will request the KO determine their applicability.
C.3 Worker Certification for Asbestos Containing Materials (ACM) Abatement: For any task order requiring asbestos exposure the contractor shall provide proof that all personnel who will be exposed to, or might reasonably be expected to be exposed to, airborne concentrations of asbestos at or above the permissible exposure limit has received the appropriate asbestos training. All asbestos workers shall have a current asbestos worker identification card/certification.
Personnel designated as a “Supervisory Person” for asbestos abatement work shall have current certification of having successfully completed an Environmental Protection Agency approved or State accredited Contractor/supervisor 32-hour course.
C.4 General Work Requirements: For each task order the contractor may be required to fulfill the following general requirements as directed by the task order.
This listing of requirements is not all encompasing and is subject to change.
C.4.1 Integrating Antiterrorism and Operations Security Into Contract Support Services:
a. AT Level I Training: All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, and controlled access areas shall complete AT Level I awareness training within 30 calendar days after task order start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee to the COR or to the contracting officer, if a COR is not assigned, within 5 calendar days after completion of the training by all employees and subcontractor personnel. b. Access and General Protection/Security Policy and Procedures: The contractor and all associated subcontractors’ employees shall comply with applicable installation, facility, and area commander installation and facility access and local security policies and procedures (provided by the Government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by Directorate of Plans, Training, Mobilization & Security (DPTMS), Security & Intelligence Division or Nashville District U.S. Army Corps of Engineers Security Office. The contractor workforce must comply with all personal identity verification requirements as directed by DoD, HQDA, and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
c. Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something): The contractor and all associated subcontractors shall receive a brief/training (provided by the Requiring Activity (RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of training.”
d. For Contracts that Require OPSEC Training. All new contractor employees will complete Level I OPSEC Training within 30 calendar days of their reporting for duty. Additionally, all contractor employees must complete annual OPSEC awareness training. The contracto shall submit certificates of completion for each affected contractor and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training. OPSEC awareness training is available at the following websites: https://www.iad.gov/ioss/ or http://www.cdse.edu/catalog/operations-security.html; or it can be provided by the RA OPSEC Officer in presentation form which will be documented via memorandum.
e. Employee Data: The contractor shall provide to the COR, seven days in advance of the event, names and Social Security numbers (or equivalent identification numbers for non-U.S. citizens) of all employees who will be entering Army-controlled installations or facilities.
f. Access Badges and Passes: The contractor shall ensure that its employees entering Army-controlled installations or facilities have obtained access badges and passes in accordance with facility regulations and that these badges and passes are obtained in advance so as not to delay the accomplishment of contracted services. Failure to obtain access to a site or installation shall/may result in termination of the contract for default.
g. Will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or restricted areas. All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access priveleges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.
h. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
i. Security Clearance. Since the work is being done in a controlled area and will require long term access, all Contractor and subcontractor employees working under this task order shall undergo background investigations by the LRN Security Management Office (LRN-SM). Guidance and forms for the investigation requirements are available on the LRN Public Website:
http://www.lrn.usace.army.mil/BusinessWithUs/ContractSecurityRequirements .aspx. Investigation requirements fall under Category B3 for US Citizens and Category C for foreign nationals. In the event it is determined that the Contractor will use Subcontractors for a period of less than 6 months, the prime contractor shall insure his Subcontractor(s) comply with the requirements in Category B1 for US Citizens.
j. For contractor requiring Common Access Card (CAC). Before CAC issuance, the contractor employee requires, at a minimum, a favorably adjudicated National Agency Check with Inquiries (NACI) or an equivalent or higher investigation in accordance with Army Directive 2014-05. The contractor employee will be issued a CAC only if duties involve one of the following: (1) Both physical access to a DoD facility and access, via logon, to DoD networks on-site or remotely; (2) Remote access, via logon, to a DoD network using DoD-approved remote access procedures; or (3) Physical access to multiple DoD facilities or multiple non-DoD Federally-controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more. At the discretion of the sponsoring activity, an initial CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled NACI at the Office of Personnel Management.
k. For contractor not eligible for CAC, but requires access to DOD facility or installation. Contractor and all associated sub-contractor employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05/AR 190-13), applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by Government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
C.4.2 Quality Control Plan (QCP): The Contractor shall develop and submit a QCP.
The QCP shall clearly define quality verification activities for specific organizational elements (professional disciplines). The design verification process is intended to ensure that the designer produces an acceptable design.
The plan shall conform to the requirements of CEORD 1110-1-9 and ER 1110-1- 12.
The Contractor shall perform an independent review of the designer’s work to verify that an acceptable design has been provided. The review will target major activities including plans and reports as well as field activities.
A signed certification statement shall be included with all products submitted to the Government. The certification shall state that the product has been reviewed and all comments have been resolved. Comments generated by reviewers, and response to comments shall be documented and submitted with this statement.
The QCP shall be signed by all the reviewers that the Contractor intends to use and should identify their discipline. The QCP shall also have a signature line for the USACE manager/coordinator to indicate his/her approval of the QCP.
C.4.3 Activities Work Plan (AWP): The Contractor shall prepare an AWP as directed by each task order. The work plan shall address the Contractor's approach for achieving the project objectives and present a proposed work schedule. The Contractor shall accomplish required tasks in accordance with the functional requirements herein and accepted industry standards to fulfill those requirements.
The Contractor shall assume draft and final versions of the AWP document. The draft document shall be submitted to and reviewed by CELRN and DPW. The
Contractor shall address each comment sufficiently before issuing the final version. No fieldwork shall begin until the AWP is designated final by CELRN.
C.5 General Scope of Services: The work location, schedule and specific procedures for each item of work will be described in individual task orders. The Government and the Contractor shall negotiate the price of each individual task order including the Contractor’s fee or profit. Task Orders will be issued as firm-fixed price (FFP) task orders. The scope of the task order requirements may include, but are not limited to, the following types of services:
C.5.1 Environmental Compliance: The Contractor shall be capable of providing a wide range of environmental compliance services. Examples of some of the environmental compliance work that may be required are listed below:
a. Complying with Federal, State, and/or local air pollution regulations. This includes, but is not limited to, preparation of air permits, monitoring air emissions, maintaining air emissions inventories, and inspecting permitted facilities, and complying with applicable regulations while performing work under this contract.
b. Complying with Federal, State, and/or local solid waste handling and disposal regulations. This includes, but is not limited to, solid waste management plans and solid waste recycling; solid waste landfill inspection, monitoring, permitting and closure; and actual disposal of solid waste generated by others.
c. Complying with Federal, State, and/or local hazardous waste handling and disposal regulations. This potentially includes actual disposal of hazardous wastes generated by work under this contract or by others.
d. Complying with Federal, State, and/or local Emergency Planning and Community Right to Know regulations.
e. Complying with Federal, State, and/or local water quality regulations. This includes, but is not limited to, drinking water systems, wastewater treatment systems, stormwater systems, lands leased for agricultural production, and maintained forest lands, as well as other water encountered or generated in the conductance of work under this contract.
f. Complying with Spill Prevention Control and Countermeasures Plan (SPCCP) implementation in accordance with leak or spill containment guidance provided in 40CFR Part 112, Oil Pollution Prevention (June, 2009).
g. Complying with Federal, State, and/or local underground storage tank monitoring and/or removal/closure regulations.
h. Establishing and/or upgrading GIS systems.
i. Establishing and/or upgrading extensive databases. Some of these databases may be integrated with GIS systems.
j. Lead-based paint investigations and abatement.
k. Asbestos surveys and abatement, including but not limited to materials in and related to turbine-generators and electrical systems associated with powerhouses.
l. Radon surveys and testing.
m. Indoor air quality monitoring.
n. Other compliance issues.
C.5.2 Environmental Restoration: The Contractor shall be capable of providing innovative technologies, as well as traditional methods of remediation. Examples of some of the environmental restoration work that may be required are listed below:
a. Develop site-specific work plans with accompanying sub-plans. These sub-plans include, but are not limited to, such documents as sampling and analysis plans, site specific safety and health plans, Contractor quality control plans, erosion control plans, and surface water pollution prevention plans.
b. Sampling and testing of soil (from surface to deep subsurface) and/or other solid matter; sampling and testing of sediment; sampling and testing of groundwater; sampling and testing of air; sampling and testing of surface water; and sampling and testing of potentially hazardous materials encountered in work under this contract or generated by others. Soils may be tested for both chemical and geotechnical parameters. Groundwater sampling may involve installation and development of monitoring wells and extraction wells.
c. Conduct remedial action activities at sites contaminated with the following types of substances: RCRA listed hazardous wastes, RCRA characteristic hazardous wastes, metals, PCBs, asbestos, petroleum hydrocarbons and chlorinated hydrocarbons, TSCA regulated substances and other contaminants not specifically listed.
d. Remediation of contaminated soil. Soil remediation may include, but is not limited to, such techniques as excavation and off-site disposal, soil vapor extraction and multi-phase extraction, bioventing, soil washing, bioremediation (ex-situ and in-situ), stabilization and/or solidification.
e. Demolition, removal, decontamination, treatment, transport and/or disposal of manmade structures. Manmade structures include, but are not limited to, buildings, sumps, tanks (both aboveground and underground), oil/water separators, oil pits, lube racks, drums, and transformers. Additionally, these manmade structures may contain, or be contaminated with, asbestos, lead-based paint, PCBs, petroleum products, or other solid or hazardous wastes.
f. Remediation of contaminated groundwater. Groundwater remediation may include, but is not limited to, multi-phase extraction, groundwater treatment technologies, in-situ bioremediation, reactive barriers, and air sparging.
g. Chemical sampling, treatment, and/or disposal of containerized wastes, such as waste inside tanks, drums, and transformers.
h. Operation and maintenance of remediation facilities, such as, groundwater collection and treatment systems, soil vapor extraction systems, multi-phase extraction systems, air sparging systems, and bioventing systems.
i. Provide Corps of Engineers approved laboratory services for chemical and physical analyses of air, soil, groundwater, surface water, and sediment samples.
j. Participation in community education and public affairs activities, including but not limited to support of public meetings and Restoration Advisory Boards.
k. Prepare Remedial Action Reports and/or Closure Reports/Post-Closure Reports after completion of the remedial action activities.
C.5.3 Environmental Conservation: The Contractor shall be capable of providing a wide range of environmental conservation services. Examples of some of the environmental conservation work that may be required is listed below:
a. Complying with Federal, State, and/or local surface water quality regulations. This includes, but is not limited to, protection of surface waters from undue sediment loads including on lands leased for agricultural production and maintained forest lands, as well as other water encountered or generated in the conductance of work under this contract.
b. Support installations in implementation of their Installation Natural Resources Management Plan (INRMP), the principle guidance document for management of natural resources on a military installation. The INRMP implements the Army Strategy for the Environment, which is to integrate environmental values into the military mission to sustain readiness, improve the soldier’s quality of life, strengthen community relationships, and provide sound stewardship of resources. The INRMP is developed in accordance with the Sikes Act; Department of Defense and Army Regulations and guidance; other Federal laws; and the specific installation's regulations.
INRMP implementation includes but is not limited to: improve and protect endangered species and species at risk habitat; improve timber stands;
enhance forest and field diversity; maintenance of the Barrens Ecosystem;
enhance forested and grassed lands to improve the use of the lands and access to the lands for improved troop maneuver and training; improvements to counter encroachment of woody debris into grasslands, agricultural leases and managed open spaces used for training; fire and installation boundary breaks maintenance; and, reduction of potential wildfire fuel.
C.6 Administrative Requirements:
a. Environmental Projects: The Contractor, the Contractor's subcontractors, and the Contractor's suppliers shall perform all work in full compliance with applicable Federal, State, and Local environmental laws and regulations including the following: pertinent Occupational Safety and Health Administration and Department of Transportation requirements, National Environmental Policy Act, Clean Water Act, Clean Air Act, Endangered Species Act, National Historic Preservation Act, Fish and Wildlife Conservation Act, Federal Insecticide, Fungicide, and Rodenticide Act, Asbestos Hazard Emergency Response Act, Noise Control Act, Pollution Prevention Act, Toxic Substances Control Act, Resource Conservation and Recovery Act as amended by the Hazardous and solid Waste Amendments, and Comprehensive Environmental Response and liabilities Act as amended by the Superfund Amendments and Reauthorization Act. Any incidents of spills, releases, or noncompliance with regulations noted by the Contractor shall immediately be brought to the attention of the Contracting Officer with written notice provided as soon as possible thereafter. Nothing in this contract shall relieve the Contractor of his responsibility to comply with these laws and regulations. Further, the Contractor shall obtain all permits, licenses, and/or certificates required by each task order. When required, the Contractor shall provide all personnel, equipment, tools, materials, supervision, and other items and services necessary to perform the work as defined in each task order Performance Work Statement. The Contractor shall provide necessary labor, supervision, insurance, vehicles, equipment, packing materials, labels, waste analysis, lab packing, weight slips, and manifest forms to safely and legally transport and dispose of, or recycle, solid non-hazardous waste, hazardous waste, and hazardous materials. The Contractor shall perform all work in accordance with 40 CFR Parts 190 through 289 and 49 CFR Parts 100 through 177.
b. CADD Files: When required, and requested in a task order, all CADD files (survey and topographic data, remedial action design drawings, contaminant migration maps and models, etc.) shall be digitized into files compatible with Microstation vector format (or other format if directed in the individual task order). Specific design file features will be provided in the individual task orders. CADD files shall also meet any upgrade to all Corps of Engineers systems throughout the duration of the contract.
c. Contractor Manpower Reporting Application (CMRA): This requirement applies only to Military funded work, such as work for Fort Campbell. The CMRA requirement does not apply to Civil Works funded projects. The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the Contractor shall report all Contractor manpower (including subcontractor manpower) required for performance of this contract. The Contractor is required to completely fill in all the information in the format provided at the web site:
https://cmra.army.mil All reporting is annual. Data for each separate delivery order is entered at the completion of the delivery order or the end of the Fiscal Year, whichever comes first. The deadline to enter data is 31 October of the reporting year.
d. Monthly Accrual Reports: As a requirement in the management of each task order, on a monthly basis Contractor shall provide USACE an estimate of work that has been performed but not yet billed. In addition, Contractor shall provide information related to the number of employees currently on the task order and the number of new employees (if any) that were placed on the task order during the month. This information shall be delivered to the USACE project POC by the end of the first week of each month so that the USACE can complete accrual reporting for open task orders as required by higher authorities. The reports must be submitted in writing (hardcopy or email) to provide USACE documentation that the Contractor provided such information.
It is anticipated that the Contractor can provide a single Monthly Accrual Report each month listing each open Task Order and its accrual value. If the Contractor is billing monthly on a percent complete basis and thus their accrual is zero, their monthly accrual value for that project/task order shall be “0”.
C.7 Government Furnished Information: Specific Government furnished information for each item of work will be described in the task orders. In general, the information will consist of topographic maps, information gathered during previous investigations (e.g., results from environmental compliance audits and surveys, geologic logs from wells or borings, results from any previously conducted soil and groundwater sampling and chemical analyses, etc.), available hydrogeologic information, and utility maps and clearances.
C.8 Technical Requirements:
a. Safety and Health: This subsection describes, in general terms, the minimum Contractor safety, health, and emergency response requirements associated with this contract. The Contractor shall have an ongoing Safety and Health Program meeting the requirements of Occupational Safety and Health Administration (OSHA) standard, 29 CFR 1910.20, 29 CFR 1910.21, and 29 CFR 1910.120. In addition, whenever work is to be performed at an uncontrolled hazardous waste site, the Contractor shall prepare, implement, and enforce a Site-Specific Safety and Health Plan (SSHP). The Contractor shall ensure that the subcontractors, suppliers, and support personnel follow all safety and health provisions.
(1) Safety and Health Program: The Corps of Engineers reserves the right to review the Contractor's corporate "Safety and Health Program." The Contractor shall incorporate any additions or revisions required by the Contracting Officer.
(2) Site-Specific Safety and Health Plan: For each action at an uncontrolled hazardous waste site (or when directed in the specific task order), the Contractor shall prepare a written Site-Specific Safety and Health Plan (SSHP) that complies with the specific task order. Acceptance of the Contractor's SSHP is required prior to start of field activities. The Corps of Engineers reserves the right to visit and/or inspect site work at any time and reserves the right to require the Contractor to make changes in his SSHP and operations as necessary to assure the safety and health of all persons on or near the site.
(3) Regulations: The Contractor's Safety and Health Program , and as appropriate, each SSHP, shall comply with and reflect the most recent releases of the following applicable regulations and publications:
(a) NIOSH/OSHA/USCG/EPA Document, "Occupational Safety and Health Guidance Manual for Hazardous Waste Site Activities," DHHS Publication No. 85-115 (October 1985).
(b) OSHA General Industry Standards, 29 CFR 1910, and Construction Industry Standards, 29 CFR 1926; especially 29 CFR
1910.120 / 29 CFR 1926.65 - “Hazardous Waste Site Operations and Emergency Response”.
(c) U.S. Army Corps of Engineers, Contractor Guidelines for: 1.
The preparation of the Accident Prevention Proposal (Safety Plan);
and 2. The preparation of activity Hazardous Analysis, ORNP 385- 1-2 (May 1986).
(d) U.S. Army Corps of Engineers, ER 385-1-92, Appendix B, Safety and Occupational Health Document Requirements for Hazardous Toxic, and Radioactive Waste (HTRW) Activities (August 1984).
(e) U.S. Army Corps of Engineers regulation "Safety and Occupational Health Document Requirements for Hazardous, Toxic, and Radioactive Waste (HTRW) and Ordnance and Explosive Waste (OEW) Activities," current date.
(f) U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 (most recent release).
(g) Other relevant Federal, State, and local regulations.
(4) Responsibility: The overall responsibility for the development, implementation, and continued enforcement of the Contractor's Safety and Health Program and SSHPs lies with the Contractor.
(a) The Contractor shall utilize the services of an experienced Certified Industrial Hygienist (CIH) to implement and oversee the Safety and Health program and to develop, implement, and sign all SSHPs. Any changes to the established Safety and Health Program or SSHPs shall be at the direction and approval of the CIH. The CIH will not necessarily be required to be on site during site activities, but shall be readily available for consultation when required.
(b) During work at an uncontrolled hazardous waste site (or when required by the specific task order), the Contractor shall utilize a trained, experienced Site Safety and Health Officer (SSHO) to assist and represent the CIH in the continued implementation and enforcement of the approved SSHPs. A SSHO shall be assigned to each site during work activities on a full-time basis and shall be either a Contractor employee or a subcontractor who reports to the Contractor and the CIH in matters pertaining to site safety and health.
b. Chemistry: This subsection identifies the chemical expertise and laboratory support required to document the Contractor's understanding of the chemistry related details of the work and his approach to quality control of chemical measurements, including all requirements specified in USACE EM 200-1-3, dated February 2001.
(1) Laboratory Support Services: Field testing capability, field laboratory capability, and a stationary lab shall be used either in combination or individually depending on the circumstances of the project.
(a) Field testing capability shall include, as a minimum, the standards, equipment, and knowledge to use photo ionizing detectors, flame ionizing instruments, combustible gas/oxygen meters, ionizing radiation meters, and pH and conductivity/DO/turbidity meters. Other field testing devices (e.g., portable Gas Chromatograph, immunoassay kits, etc.) shall be readily available for use for meeting project specific needs.
(b) As a minimum, access to a field lab with the capability of gas chromatography, atomic absorption spectrophotometry, and gravimetric and volumetric analysis is required. Various support equipment for the above instrumentation as well as sample preparation and storing shall also be needed.
(c) The capabilities of the in-house or subcontracted stationary lab shall include the whole range of environmental analyses of air, water, soil, and materials using standard methods. More than one laboratory may be identified to cover the range of analyses required. All levels of data quality will be specified by the Contractor and approved by the U.S. Army Corps of Engineers. In addition, any subcontracted laboratory shall hold a current DOD QSM verification.
(d) Analysis capabilities shall include, at a minimum, volatile organic compounds (TCL), semi-volatile organic compounds (TCL), TAL metals, cyanide, explosives compounds, pesticides, PCBs, herbicides, dioxins and furans, major anions and cations, biological and limnological parameters, and radioactivity. Tests to determine if a material is hazardous waste according to 40 CFR 261 shall also be within the lab's capability.
(e) Analytical methods used shall be DOD Quality Systems Manual (QSM) compliant and laboratories selected must hold a current DOD QSM verification. Environmental Protection Agency (EPA) standard methods, unless technically impractical shall be used.
Methods shall include, but shall not be limited to, those described in EPA SW-846, EPA 600/4-79-020, EPA 600/4-82-057 and the EPA Contract Laboratory Program (CLP). Also, the laboratory shall be a successful participant in a NIOSH PAT PROGRAM or AIHA certified and be completely capable of analyzing required air samples. The laboratory shall be certified by the State when appropriate to the program. For the purposes of laboratory certification, it is anticipated that work under this contract will be performed in the following states: Kentucky and Tennessee. All laboratory certifications must remain effective for the duration of the individual task orders. The laboratory must participate in a federally recognized performance evaluation program as required by the
QSM.
c. Geological: This subsection describes, in general terms, the technical geological requirements for subsurface sampling associated with this contract. Specific geotechnical requirements will be described in each task order.
