About this file
This solicitation is for a full and open unrestricted competition to repair the Little Sodus West Pier located in Sterling, New York. Work includes encapsulating approximately 600 linear feet of the existing pier with new sheet pile walls and a concrete cap. Other tasks involve clearing driving lines, removing sections of existing sheet pile and concrete cap, installing new sheet piles connected with wales and tiebacks, backfilling with granular material, pouring a new concrete cap, and adding safety ladders and concrete stairs. The U.S. Army Corps of Engineers Buffalo District will issue the solicitation as a firm-fixed-price Invitation for Bid, with bids due by February 28, 2022. The repair work addresses issues of pulled and disconnected existing sheet piles no longer contained by the concrete cap.

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE (SF 30)
The following have been added by full text:
QUESTIONS AND ANSWERS/ROLL CAL
The Following are the Answers to this Solicitation.
1) Can the material excavated for the drive line on the land and water sides be side cast?
a. The village of Fair Haven owns the land adjacent to the pier. Per coordination with the village of Fair
Haven, NY, the drive line material should be hauled offsite.
2) What are the grading requirements on the land side excavation after scrubbing is completed?
a. Any excavations performed by the contractor on the land side of the project must result in the contractor returning the ground to the existing soil elevations at the completion of the project.
3) Can the land side buried boulders and cobbles be side cast?
a. Since the village of Fair Haven, NY owns the land adjacent to the pier, please coordinate with them on side casting any buried boulders and cobbles. Please note there may be concrete, which the village has mentioned should be hauled offsite. The village can provide some suggestions for concrete disposal. The POC is Mayor Jim Basile, jbasile14@yahoo.com, (585) 313-4911.
4) Can the contractor quality control person also be the SSHO? or do they have to separate individuals?
a. Yes, per the specs the SSHO may also serve as the Quality Control Manager. The SSHO may not serve as the Superintendent.
5) The solicitation has a prevailing wage rate for Heavy (Dredging and Marine). Can a wage rate be issued for regular Heavy as well or replace the current since a majority of the work can be accomplished land side without the current wage rates for dredging, floating plant, etc. Currently no wages are listed for operating engineers, laborers, cement finishers, laborers for tree removals, etc.?
a. The solicitation has changed to include two Wage Determinations.
-For in water work, IL18 applies.
-For work done on land, NY36 applies. NY36 is attached
6) Are any contract price escalations allowed for steel?
a. No price escalation are to be included in the contract.
7) Shall the existing site access road that can be utilized be restored to pre construction conditions for example no rutting etc? or are improvements expected?
a. The existing access road is gravel/sand, so it just needs to be restored to pre-construction conditions.
If the main asphalt roadway is damaged somehow, this would need to be repaired to pre-construction conditions, too. The preconstruction survey will document all of this.
8) Please confirm that currently due to DEC permitting in water work can not begin until July 15th 2022.
a. Correct, in-water work cannot currently begin until July 15th per section 01 35 13 paragraph 1.3.1(d).
We have requested an earlier in-water work through NYSDEC, but no decision has been made yet.
9) Sheet C101 indicates approx. 6 trees to be removed. Are those the only trees to be removed or is there a distance from the pier that is desired for trees/brush to be removed? In addition if additional removals are needed to facilitate construction can additional trees/brush be removed?
a. Note 1 should cover this. Any tree, including the stump, interfering with the drive line should be removed, and if it is not in the way it can remain. Please coordinate with the COR at the walk through prior to removals starting.
10) What are the requirements to prevent the public from entering the construction area for example: Temp.
chain link fence panels, orange safety fence, signage, etc.?
a. A chain link fence is noted in the drawings and specs.
11) Please confirm that West Bay Road can be utilized for truck traffic delivery of materials and equipment.
a. It is a public road and there are no posted limits so it can be utilized for truck traffic delivery of materials and equipment.
12) Can a list please be provided of pre bid attendees both onsite and WebEx.
a. WD Malone
b. Veteran Material
c. Ryba Marine
d. Kovilic Construction Co., Inc
e. Music City Renovations & Construction, LLC
f. Marion Hill Associates
g. Great Lakes Dock & Material, LLC
h. Crane-Hogan Structural Systems, Inc.
i. Winn Construction Services, Inc.
j. M. A. BONGIOVANNI, Inc.
13) Can you please clarify who is responsible for providing concrete testing?
a. The contractor is responsible for all concrete testing per the contract specifications.
14) Can you please clarify the insurance coverage requirements?
a. The insurance requirements in FAR Part 28.307-2 apply. See changes to Instructions to Bidders below.
15) Are there requirements/restrictions for utilizing a barge within the channel?
a. As per paragraph 1.3.7 in Section 01 35 13 “Perform the work in a manner as to obstruct navigation as little as possible and, in case, the Contractor's plant obstructs a channel as to make it difficult or endanger the passage of vessels, promptly move plant on the approach of any vessel to such an extent as may be necessary to afford practicable passage.” This is only applicable if the contractor’s barge is within the federal channel and does not apply if said barge is tied up outside of the channel and within project limits.
16) Project document Section 01 35 13, subsection 1.3.9 Temporary Lights, Signals and Buoys Required by the Coast Guard states, “display all temporary lights, signals and buoys required by the U.S. Coast Guard during the project”. The contact phone number provided in this section responds as no longer in service. Can you please clarify what temporary lights, signals and buoys, etc. will be required?
a. Contractor is responsible for coordinating any temporary lights, signals, or buoys the coast guard requires while working close to, or within the federal channel. The POC for the coast Guard should be Doug Sharp for the 9th District.
17) We see that this project is to be bonded. On previous USACE projects there would be a separate CLIN item for activity. We do not see that being the case for this project and was curious as to which CLIN we should have the price part of.
a. Mobilization/Demobilization
18) Specification 05 50 13 Paragraph 2.4 Ladders call out yellow and black paint for the ladders. Are there additional specifications associated with this paint that will be required I.E. paint system to be used?
a. Intent is for the contractor to use a paint and primer that is recommended by the manufacturer for exterior steel surfaces to prevent rust.
b. The color of the ladder is to be changed so that the entire ladder is painted safety yellow.

(c) 19.1307 Price evaluation preference for HUBZone small business concerns.
(a) The price evaluation preference for HUBZone small business shall be used in acquisitions conducted using full and open competition. The preference shall not be used -
(1) Where price is not a selection factor so that a price evaluation preference would not be considered (e.g., Architect/Engineer acquisitions); or
2) Where all fair and reasonable offers are accepted (e.g., the award of multiple award schedule contracts).
(b) The contracting officer shall give offers from HUBZ one small business a price evaluation preference by adding a factor of 10 percent to all offers, except -
(1) Offers from HUBZone small business that have not waived the evaluation preference; or
(2) Otherwise successful offers from small business concerns.
(c) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors, such as transportation costs or rent-free use of Government property, shall be added to the offer to establish the base offer before adding the factor of 10 percent.

(d) The insurance requirements in FAR Part 28.307-2 apply.
(a) Workers’ compensation and employer’s liability. Contractors are required to comply with applicable Federal and State workers’ compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer’s liability section of the insurance policy, except when contract operations are so commingled with a contractor’s commercial operations that it would not be practical to require this coverage. Employer’s liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit workers’ compensation to be written by private carriers. (See 28.305(c) for treatment of contracts subject to the Defense Base Act.)

The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.
(d) Aircraft public and passenger liability. When aircraft are used in connection with performing the contract , the contracting officer shall require aircraft public and passenger liability insurance . Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger liability, and $200,000 per occurrence for property damage. Coverage for passenger liability bodily injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union, which prevailed in the survey for this classification, which in this example would be Plumbers 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
