SUMMARY OF CHANGES
SECTION 00700 - CONTRACT CLAUSES
The following have been modified:
31.105-101 EQUIPMENT OWNERSHIP
31.105-101 Equipment Ownership and Operating Expense Schedule (MAR 1995)
(a) This special contract requirement does not apply to terminations. See 52.249-5000, Basis for Settlement of Proposals, and FAR Part 49.
(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier must be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment must be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region II. Working conditions must be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer.
For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations must apply. For retroactive pricing, the schedule in effect at the time the work was performed must apply.
(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer may request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data must be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

BRADDOCK BAY RESTORATION
GREECE, NEW YORK
BIDDERS QUESTIONS,
GOVERNMENT RESPONSES, AND
AMENDED SPECIFICATIONS
17 SEPTEMBER 2015
This document contains the following information:
1. Questions submitted via email and Government responses.
2. Revisions to the specifications.
Questions (submitted via email) from bidders with Government responses:
1. Question: Can you provide a manufacture’s name for the Biodegradable Stabilization Fabric? I have not found anyone who is familiar with it.
Answer: Use the following link:
http://www.nedia.com/biodegradable_stabilizer_fabric.html
2. After reviewing the drawings we have the following questions and comments for your clarification:
1. Drwg. G-003:
a. Note 8, states debris and vegetation must be removed before placement of the geotextile reinforcement and breakwater stone. Is the contractor required to remove the underwater seaweed beds? If so, what is the acceptance criteria?
Response: Any seaweed encountered is vegetation and needs to be removed per Note 8 on drawing G-003.
b. Note 9, Is the Contractor able to use the Access and Staging Areas 24 hrs/day and 7 days/week?
Response: Yes
2. Drwg. C-101:
a. Note 4, after construction of the spine breakwater begins the contractor will be responsible for providing and maintaining a navigation channel. The specifications require the dredge spoils from providing the navigation channel, be placed in the void spaces between the armor stone. The Armor Stone placement rate for Stage 1 construction will not provide enough void space to accept the dredge spoils from the Min.
Navigation Channel dredging (75’W x El-2.0LWD) “after construction of the spine breakwater begins”.
Furthermore, the placement of the Stage 2 Armor Stone will be the last activity of the Breakwater Construction. Please identify the location where the dredge spoils from providing the Min. Navigation Channel should be stockpiled. Or is it possible to change the sequence of construction in Note 4?
Response: The navigation channel required by Note 4 on drawing C-101 is required from September 15 through October 31. If there is not sufficient length of the breakwater constructed in which to place the Type 1 beach fill as required by the contract documents, then the excavated material from the required navigation channel may be side cast into the limits of the borrow area shown on drawing C-101.
3. Drwg. C-103:
a. Identifies the location of four (4) Access Routes to the wetland restoration work areas from the Lake Ontario
State Parkway. The Lake Ontario State Parkway does not permit Commercial Vehicles to travel on the Parkway. Has the USACE obtained a Waiver or Special Use Approval allowing the Contractor to bring in the Equipment and Materials to the worksite via the Lake Ontario State Parkway?
h5cosklm Highlight
Response: The Contractor is responsible for obtaining the necessary permits to access the Lake Ontario State Parkway per Subparagraph (c) in Special Clause 52.236-4 PHYSICAL DATA (APR 1984) of Section 700 of the contract specifications.
4. Drwg. C-501:
a. Stage 1-Typ. Cross Section; can the 30 ft. width between the Stage 1 Armor stone be increased to 40 ft. to accommodate the turning radius of the hauling equipment and the counterweight swing radius of the placement equipment?
Response: Add Note 6 to contract drawing C-501 as follows: “The area available for Stage 2 construction access of 30’ shown on the Stage 1 cross section may be increased to 40’ (20’ from centerline on each side).
If the Contractor uses crushed stone for bedding stone, the required 40’ wide second layer of geotextile reinforcement must be increased to a minimum of 50 feet.”
b. Note 4, Stage 1 Bedding Stone that settled beyond the toe of the El. +2.5 LWD trapezoidal section does not need to be reconstructed back up to El. +1.0. How will the Armor Stone Layer be measured to determine the Thickness and Accepted given the specified Placement Tolerances?
Response: Add the following sentences to the end of the first subparagraph of Paragraph 1.2.2.1.1 of Section 31 00 00: “The check survey that is performed for the bedding stone placed during Stage 2 construction must also include a survey of the Stage 1 bedding stone to the edge of the Stage 1 armor stone that is closest to the centerline.”
5. Drwg. C-502:
a. Note 1, Geotextile Reinforcement requires Sewn Seams between the geotextile sheets.
The Geotextile Subgrade (Lk Btm.) varies from El. -0.5 LWD to -1.75LWD, and the average long term water surface (1918-2014) Varies from El. + 2.0 LWD (Apr) to El. +2.83 LWD (Jun), and Even as high as El. +3.35 LWD in July 2015. This means the Geotextile will be below the water surface anywhere from 2.5 ft. of water (+2.0 to -0.5), to as much as 4.1 ft. of water (+3.35 to -1.75) depending which months the Geotextile is Placed.
The Bedding Stone Placed to El. + 1.0 ft. will also be 1.0 to 2.35 ft. below the water surface. The specified Geotextile Floats on the water surface. The Geotextile Sewing Machine are Electrically Powered.
Please specify how the Geotextile Sheets are continuously sewn together safely in standing water and waves.
Response: Determination of means and methods to accomplish this work is the responsibility of the Contractor.
b. Note 9, Dump Trucks are restricted to a Gross Vehicle Weight of 55,000lbs., 25 PSI, and an empty Weight of 25,000 lbs Can these Equipment Restrictions be opened up to reduce the costs and schedule of using the small equipment?
Response: No.
c. Note 11, Wheeled Equipment is limited to 15,000 lbs., and less than 400 PSF. .
Can these Equipment Restrictions be opened up to reduce the costs and schedule of using the small equipment?
Response: No.
d. Note 12. Equipment operating on stage 1 bedding stone within 25ft of the leading edge of stage 1 bedding must have a gross operating weight not exceeding 15, 000 lbs. Please consider increasing the weight limit or give a PSF maximum.
Response: Load restrictions must be as currently specified in the contract documents.
6. Drwg. C-503:
a. The Typical Cross Sections of the Potholes and Channel both illustrate a Vertical Slope in the Cut locations.
Is the Vertical Slope Illustrating the Cut Locations, or the required As-Built Slope of the Potholes and Channels? If side slope sloughing is allowed, which is the controlling point of the cut, the top of slope or the toe of the slope? Please clarify the intent of Note 2 in this regards.
Response: The vertical slopes shown on the drawings are the initial cut locations. The intent is to have the volume of excavation to be approximately the same for cuts that stay vertical and cuts that slough down.
b. Note 7, Beyond 100ft. from shore, Construction Equipment shall not be operated on the Low Stone Sill or the borrow material placed adjacent to the Low Stone Sill. Ninety Percent (90%) of the Length of the Low Stone Sill is at El. 0.0 to -1.0ft. Even with high water for a couple of weeks there is only 2-3 ft. of water. This is not enough water for the draft of even the smallest of vessels. Please re-evaluate this requirement.
Response: The contract requirements for this work will remain as currently specified in the contract documents.
Changes to specifications
2. Section 31 23 20.23 Paragraph 2.3.1: Add the following sentence to the end of the paragraph:
“As an alternative to the CONCRETE SAND specified above, materials meeting the gradation and testing requirements as indicated in New York State Department of Transportation (NYDOT) specifications, Section 700, 703-06 CUSHION SAND may be used for Type 2 beach fill except the upper sieve size of 1/4 inch may be increased to 3/8 inch.”
