SUMMARY OF CHANGES

SECTION 00700 - CONTRACT CLAUSES

The following have been modified:

31.105-101 EQUIPMENT OWNERSHIP

31.105-101 Equipment Ownership and Operating Expense Schedule (MAR 1995)

(a) This special contract requirement does not apply to terminations. See 52.249-5000, Basis for Settlement of Proposals, and FAR Part 49.

(b) Allowable cost for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier must be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment must be based upon the applicable provisions of EP 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region II. Working conditions must be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer.

For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations must apply. For retroactive pricing, the schedule in effect at the time the work was performed must apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36, Rental Costs. Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the SAT, the contracting officer may request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data must be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

9. What is the timing related to excavation of the navigation channel?

http://www.glerl.noaa.gov/data/dashboard/GLWLD.html http://www.lre.usace.army.mil/Missions/GreatLakesInformation/GreatLakesWaterLevels/WaterLevelForecast.aspx h5cosklm Highlight

The navigation channel needs to be provided as specified in Note 4 on contract drawing.

10. Does damage to the road need to be repaired?

Yes – Section 01 50 00, paragraph 3.13 states: “Restore access routes, storage and staging areas to the original or better condition. For areas that require seeding, scheduled watering may be required for a duration to be determined by the contracting officer. For paved portions, this may require resurfacing or additional work for restoration”.

Questions (submitted via email) from bidders with Government responses:

11. Question: Bid items H, I, J, & K are for Turbidity Curtain. What will be the specific location for each of these bid items?

Answer: Reference Section 31 32 23 BREAKWATERS AND LOW STONE SILL CONSTRUCTION, Paragraph 3.2 TURBIDITY CURTAINS: the first two sentences are as follows:

“Install turbidity curtains as directed by the COR. The COR will decide as work progresses if the curtains are needed.”

12. Question: The Reinforced Geotextile, Section 31 05 19, is to be sewn throughout the project.

The Geotextile used as Filters and Biodegradable Stabilization Fabric are to have a minimum of 18” overlap. Can the specification for the Reinforced Geotextile be amended to allow a 5ft overlap at unsown joints?

Answer: No, all seams for Geotextile (Reinforcement) required in Section 31 05 19 must be sewn.

*****Please note following change to specifications: Section 31 60 00, Paragraph 2.5.2 has been amended to give the option of using crushed stone instead of bedding stone. If a contractor decides to use crushed stone, they must install a second layer of geotextile. The second layer of geotextile does NOT have to be sewn. The amended version of paragraph 2.5.2 is as follows:

“NYS DOT Section 700 MATERIALS AND MANUFACTURING, Section 703‐02 COARSE AGGREGATES, paragraph C. Screen Gravel, Size Designation 5 (Material Designation 703‐ 0203). Instead of screen gravel, the Contractor may use NYS DOT Section 700 MATERIALS AND MANUFACTURING, Section 703‐02 COARSE AGGREGATES, paragraph A. Crushed Stone, Size Designation 5 (Material Designation 703‐0201). If crushed stone is used for bedding stone, the Contractor must then place a second layer of geotextile reinforcement 40 feet in width directly over the first layer of geotextile reinforcement shown on the contract drawings and centered over the spine breakwater, headland breakwater and groin centerlines for the entire length of these structures. The second layer of geotextile reinforcement is also required in all other areas where the Contractor will be operating dump trucks on the placed bedding stone. Panels comprising the second layer of geotextile reinforcement must be overlapped a minimum of 18 inches with appropriate measures taken to ensure the required overlap exists after bedding stone placement. The use of the second layer of geotextile will be at no cost to the Governement. Dumping of crushed stone outside the footprint of the second layer of geotextile reinforcement is prohibited.”

13. Question: The Armor Stone tolerances are exceedingly tight given the range of the armor stone.

The cross section on page c‐501 shows a single layer of armor stone. The lower range of the armor stone is 1.4 tons. Using 170 lb./cf the average stone is roughly 2.6ft. A single 1.4 ton armor stone on bedding stone at grade is 0.4ft below grade. The tolerance is +/‐.25ft. Please consider revising the tolerance for the armor stone.

Answer: Reference section 31 32 23, Paragraph 3.1.8 Tolerances: the table will be updated to read as follows:

Stone Above Neatline (Inches)

Below Neatline (Inches)

Bedding 2 2 Low Stone Sill 4 MAY NOT BE

BELOW GRADE

Thickness

Tolerance (Inches)

Armor – Stability Berm

+6 ‐9

Armor ‐ Crest +6 MAY NOT BE

BELOW GRADE

14. Question: Please clarify the sequence of work for the detached berms. Are they to be completed before the groins and spine breakwall?

Answer: No

15. Question: To place the type 2 beach fill can equipment run on top of the type 2 beach fill in areas where armor stone has been previously placed?

Answer: Note 5 and 8 (shown below) on contract drawing C‐502 indicates vehicle requirements

5. STAGE 1 BEDDING STONE MUST BE PLACED TO THE ENTIRE WIDTH SHOWN ON THE STAGE 1

TYPICAL BREAKWATER/GROIN CROSS‐SECTION A MINIMUM OF 25 FEET IN ADVANCE OF ANY

DUMP TRUCK TRAFFIC. DUMP TRUCK TRAFFIC MUST BE RESTRICTED TO 15 FEET FROM THE

CENTERLINE EXCEPT WHERE ACCESS ROADS ENTER THE BREAKWATER/GROIN FOOTPRINT.

8. OUTSIDE THE FOOTPRINT OF BREAKWATERS AND GROINS AND WITHIN 50 FEET OF THE

FOOTPRINT, ALL OFFSHORE EQUIPMENT TRAFFIC MUST BE RESTRICTED TO ACCESS ROADS

DESIGNED AND CONSTRUCTED BY 1 HE CONTRACTOR. ACCESS ROAD MATERIALS MUST BE

REMOVED PRIOR TO PROJECT COMPLETION. ACCESS ROADS CONSTRUCTED ON THE EXISTING

LAKEBED MUST UTILIZE GEOTEXTILE REINFORCEMENT UNDER THE FULL FOOTPRINT OF ACCESS

ROAD FILL. THE GEOTEXTILE REINFORCEMENT STRENGTH AND SEAM STRENGTH MUST MEET OR

EXCEED AS THOSE SPECIFIED FOR CONSTRUCTION OF BREAKWATERS AND GROINS. THE CREST

ELEVATION OF ACCESS ROADS CONSTRUCTED ON THE EXISTING LAKEBED MUST NOT EXCEED

THE ELEVATION OF THE TOP OF THE BEDDING STONE SHOWN ON THE STAGE 1 TYPICAL

BREAKWATER/GROIN CROSS‐SECTION. ACCESS ROADS CONSTRUCTED ON BEACH FILL MUST BE

A MINIMUM DISTANCE OF 80 FEET FROM THE CENTERLINE OF ANY BREAKWATER OR GROIN,

AND MUST HAVE A MAXIMUM CREST ELEVATION OF +6.0 LWD. VEHICLES HAVING A MAXIMUM

GROSS OPERATING WEIGHT OF 15,000 LB MAY OPERATE ON BEACH FILL WITHIN 80 FEET OF THE

CENTERLINE OF BREAKWATERS AND GROINS.

16. Question: The settlement plate detail shows a pvc pipe resting on a steel plate. How is this to be attached?

Answer: The detail on drawing C‐502 indicates a 3" steel pipe welded to the steel plate. The PVC pipe slides freely over the steel pipe and rests on the steel plate.

17. Question: Another question regarding the bedding stone specification. The specification refers to the NY DOT spec for a screened gravel product. The NY spec is attached. The screened gravel means the material will be a gravel based product and not a blasted and crushed material. Our material suppliers have stated that the product will be very difficult to supply as a screened gravel. We ask that the specification be revised to allow for a blasted product. This will be much more commercially available and a great benefit to the project.

Answer: Crushed stone is allowed. See answer to Question 12 above.

Changes to specifications

18. Clause 52.236‐16 QUANTITY SURVEYS is removed.

19. Clause SUBMISSION OF CONTRACT DOC is removed,

SD‐07 submittal Article 15 Permit

b. Paragraphs 3.1 and 3.2 have been updated to read as follows:

3.1 MECHANICAL TREATMENT

Mechanically treat (mow) the entire area within the limits as indicated on the contract drawings.

NOTE: It is possible, that unforeseen higher water levels, during the required periods for mechanical treatments, may make the use of tractor‐type equipment impractical. The contractor may use hand‐held equipment to perform the work. This may require the use of extra personnel, equipment, and require more time to complete the work. The contractor must plan the work so that it will be completed within the time periods shown on the Treatment Schedule table in paragraph 1.2 of this section. Time extensions for performing the work will not be granted. Any additional costs for extra personnel and equipment must be included in the "Invasive Species Treatment" line item on the bid form. Any Activity Hazard Analysis (AHA) and plans (which are required submittals for acceptance) that refer to mechanical treatment must include the use of hand‐held equipment. If the work is performed during higher water conditions, the treatment must be down to the height of the high water, at the time of the treatment.

3.2 CHEMICAL TREATMENT

Extreme care and caution must be used when transporting the herbicide to the treatment areas. Open containers are not permitted. Once a treatment area has begun to have the herbicide applied, the entire area must be treated in the same day so that the warning signs required may be posted that same day.

All persons applying the herbicide must wear all PPE required by the manufacturer of the herbicide.

NOTE: Within 4 weeks of contract award, the contractor must apply for an Article 15 Aquatic Pesticide permit and submit a letter to modify the existing Article 24 wetland permit. This permit is required if high lake levels result in standing water within treatment areas during the period of herbicide application. Obtaining the permit does not change the limits for treatment shown on the contract drawings and the contractor must perform the work in accordance with the permit.

To apply for an Article 15 Aquatic Pesticide Permit, complete the application (http://www.dec.ny.gov/chemical/8530.html) and submit to

Attn: Gail Mortimer NYSDEC ‐ Pesticides 6274 East Avon‐Lima Road Avon, NY 14414

The cost will be $100.00 for the Article 15 permit. To modify the existing Article 24 wetland permit, submit a letter requesting the change to the wetland permit and include the necessary Article 15 Aquatic Pesticide permit application forms, fee and supporting information to: thomas.haley@dec.ny.gov.

Any additional costs for obtaining the permit, additional personnel, and additional equipment required for complying with the permit, must be included in the "Invasive Species Treatment" line item on the bid form. Any Activity Hazard Analysis (AHA) and plans (which are required submittals for acceptance) that refer to chemical treatment must include the application of herbicide over standing water.

23. Section 35 20 23, Paragraph 1.1: The following sentence has been added to the end of the paragraph:

“Excavation outside the borrow area limits shown on drawing C‐101 is not permitted.”

24. Drawings G‐003 and C‐103 have been updated – Potholes, Channels, and Mounds have been revised.
