SECTION SF 30 BLOCK 14 CONTINUATION PAGE

SUMMARY OF CHANGES

SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS

The following have been added by full text:

AMENDMENT 4

1. Can Mobilization include:

a.

Preparing the site for excavation;

b.

Installing dewatering ditches;

c.

Installation of a dewatering system;

d.

Installation of equipment for quality control;

e.

Installation of equipment to determine quantities removed (i.e. truck scales)?

Answer: The Government is not dictating what items are included in mobilization costs.

2. The note for Section 00010 states that any awards of options will be made at the time of contract award. Section 52.217-7 states that the Contracting Officer has up to 60 days after contract award to award options. When will the contractor know of any option(s) award?

Answer: The fill in information for Clause 52.217-7 is incorrect. Any option(s) will be exercised at the time of contract award.

3. We appreciate that if hazardous material is encountered, that the Corps must be notified. At what point will ownership of excavated material be tendered to the contractor? Will the contractor be held responsible for:

a.

Ownership of hazardous materials;

b.

Transport and Disposal of hazardous material without further compensation;

c.

What about the scenario where hazardous materials are discovered in the excavated materials after placement at the final disposal site?

Answer: The Government is not aware of any hazardous material at the work site. Any hazardous material encountered will be treated as a differing site condition. Ownership will be tendered when the material is shipped off site.

4. Can existing cross-dikes, such as those formed by the East 26th St., East 30th St., and East 33rd St. sewer extensions, and the cross-berm, be used for transportation purposes?

Answer: The East 30th St. and East 33rd St. sewers are outside the project work limits so they are not available; see drawing C-103. See reference drawing 96-CLV-1/14 for the elevation of the East 26th St. sewer. See Section 01 35 13, paragraph 3.2 regarding the existing sewer line in the project area. The dikes and berms within the project work limits may be used; however, the requirements in Section 01 35 13 and FAR Clause 52.236-7 apply regarding damage to the CDF.

5. We appreciate the information provided in Section 01 35 13, Part 3, of the Bid Documents, which lists contact information for a potential disposal site located in the City of Cleveland. However, given that this information appears in the Project Bid Documents, we are perplexed by the vagueness of the Corps responses offered in Amendment 0003 to contractor inquiries, specifically questions 14-20, regarding the disposition of this particular disposal site. Further, it is our understanding that the City of Cleveland does not control the noted disposal site nor does it have authority to offer it for this, or any other, purpose. Is this a valid disposal site or not?

Answer: The site listed in the solicitation was deemed a potential disposal site. At this time, the Government has not done a complete analysis to determine if it is a valid disposal site or not. Per FAR Clause 52.236-7, this is a responsibility of the contractor.

6. Please provide a list of qualified bidders who have expressed interest in this project and the sign in sheets from the two pre-bid meetings.

Answer: The Government does not maintain a qualified bidders list. To see a list of interested vendors, please go to www.fbo.gov and click on interested vendors. The sign in sheet for the pre-bid meeting is attached to the solicitation already. The sign in sheet in response to the sources sought synopsis is attached to this amendment.

7. It was mentioned at the pre-bid meeting site visit that once the USACE completed it's initial survey, the digital topo. would be issued to bidders that were interested. Is the file available in CAD?

Answer: The Government has completed the field survey, but have not developed/prepared the project base mapping yet. CAD files will be provided to the successful bidder following contract award.
