On behalf of the Government, the Contracting Officer intends to evaluate each quote and make an award without discussions. The Contracting Officer unilaterally reserves the right to determine if it is necessary to conduct discussions.

3. NG Agency Protest Program. The NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum rather than filing a protest with the Government Accountability Office (GAO) or another external forum. Contract award or performance is suspended during the protest to the same extent and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from filing. An agency protest may be filed with either the Contracting

Officer or the NG Agency's Protest Decision Authority, but not both, in accordance with NG protest procedures. To be timely, the protests must be filed within the periods specified in FAR 33.103. To file a protest under the NG Agency Protest Program, the protest must request resolution under that program and be sent to the address below:

Addendum to Evaluation - Commercial Product and Commercial Services

Miscellaneous text in this section has been modified to:

Basis for Award

BPA(s) will be issued to the responsive and responsible offeror(s) whose quote is the most advantageous to the Virginia Army National Guard based on the following evaluation criteria:

(a). Price. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 13.106-3. Through these techniques the Government will determine whether prices are reasonable, complete, and are not unbalanced. The Government will evaluate the price reasonableness of the offerors' proposed prices to ensure that in its nature and amount, it does not exceed what would be incurred by a prudent person in the conduct of competitive business. Interested vendors should note that pricing will be carefully reviewed to detect whether quotes are unbalanced between line items (meals). Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line-items is significantly over or understated as indicated by the application of price analysis techniques. Unbalanced pricing may be determined unacceptable.

(b). Quality of meals for the five-day menu. Offered meals shall be evaluated for overall quality. Quality will be assessed by a meal that prioritizes nutrient-dense, minimally processed ingredients and provides satisfaction and nourishment through good taste, texture, and flavor. Quality will encompass multiple aspects, including food that is fresh, safe, and high in essential nutrients, as well as appealing appearance and a balanced composition of macronutrients.

(c). Past performance. Past performance will be evaluated against previous purchase, call, delivery, and task orders for similar requirements. Similar requirements include meal delivery, catering services, food services, etc.

Issuance of Call Orders

The issuance of the actual BPA Calls will be rotated among BPA holders, regardless of the call order dollar amount.
