Combined Synopsis Solicitation W912LP-18-R-0006b
“Micro Lab Drug Recognition and Safety” Course Week Ending: 18 May 2018
Q1. Is there an incumbent to this contract, or is this a new requirement?
A1.
The previous contract has expired, therefore there is no incumbent. The last contract for a similar course was W912LP-16-C-0002.
Q2. If so, what was the previous contract award number, amount and incumbent name?
A2. N/A reference answer above.
Q3.
The statement of work contains the following language referencing a “live cook” and “Live demonstration of drug production:”
- “The course shall conclude with one of the following live cook demonstrations: One-Pot methamphetamine, butane hash oil (BHO), or Fentanyl”
- “5.2.6.3 Live demonstration of drug production for one of the following:
One-Pot meth, BHO, or Fentanyl”
This appears to indicate the contractor providing the MicroLabs training would be required to produce methamphetamine, butane hash oil, or fentanyl. These are controlled substances under the controlled substances act (CSA) (21 U.S.C. §801 https://www.deadiversion.usdoj.gov/21cfr/21usc/801.htm > et seq).
Does the Iowa National Guard have the authorization or an exemption (such as DEA schedule 1 registration) to manufacturer controlled substances? Or is the contractor awarded the bid is expected to possess State of Iowa and DEA authorization to manufacturer controlled substances?
While the Controlled Substances Act provides an exemption for on-duty law enforcement officers to possess controlled substances, the statement of work is clear the contractors would be manufacturing controlled substances.
A3.
The instructing firm (awarded vendor) will be required to have a DEA authorization number to manufacture the drugs; they will not need one from the State of Iowa.
