II. BASIS OF AWARD- EVALUATION

Evaluation—Commercial Products and Commercial Services.

The Government intends to award a contract resulting from this solicitation to the responsible offeror (as determined within the meaning of FAR Part 9, paragraph 9.104), whose offer conforms to the solicitation and is determined to be the most advantageous solution to the Government, price and other factors considered. At minimum, the vendor must provide pricing in accordance with the instructions outlined in this solicitation. The vendor that provides the lowest price that can be determined both "fair and reasonable" and "realistic" by the Contracting Officer may be given additional consideration for awardee selection. However, the Government is under no obligation to do so. During the evaluation process the Contracting Officer will determine a "Total Evaluated Price" (TEP) for each responsive quote. The TEP is determined by totaling the amount of all line items identified in the offerors’ quote. For the purposes of this evaluation, a price deemed too high while conducting the evaluation of the quote in accordance with FAR 13.106-3 are not considered "fair and reasonable".

The Government has the right to award without any discussions.

(a) The following factors shall be used to evaluate offers:

(i) Price - The price will be evaluated by the lowest aggregate sum of the items including any additional charges, etc. (Quote must be all inclusive)

(ii) Technical Capability/Acceptability - Technical capability is equal to price.

For the purposes of this evaluation, a vendors quote that is not consistence with market pricing may reflect a lack of understanding of the contract requirement or displays an undue risk inherent in the vendors approach may not be considered "realistic" unless the vendor can provide documentation showing their ability provide or meet the requirement.

the clauses and provisions for this requirement are attached

III. PRICING/QUOTE SUBMISSION

Narratives are not required for this solicitation. Please fill in the following chart to allow for side-by-side comparison of offers. Please be sure to include maximum discounts as part of pricing below, along with foreseen variations in pricing.

IV. FAR CLAUSES AND PROVISIONS

For FAR Clauses and Provisions applicable to this solicitation see attachment titled “FAR Clauses&Provisions_W912L225QA003”

V. ORGANIZATIONAL CONFLICT OF INTEREST

The provisions of FAR 9.5, OCI, apply to any award under this solicitation. Potential offerors should review their current and planned participation in any other Government contracts, subcontracts, consulting, or teaming arrangements where they may be in a position of actual or perceived bias or unfair competitive advantage. A common example with the potential for OCI is where an entity performs work both as a system Contractor/Subcontractor and as a Government support Contractor for Government offices involved in supporting program efforts or related programs.

All offerors shall make a preliminary disclosure to the PCO, at the time of its quote, of any Organizational Conflict of Interest (OCI) issues it has identified or provide an affirmative statement that the offeror does not have an Organizational Conflict of Interest (OCI) as it applies to this solicitation.

An offeror failing to submit an OCI plan that it is later determined should have been submitted, could cause the quote to be rejected and no longer be considered for award. Offerors shall include in its plan where its employees are located and the total of employees in the location(s).

Offerors should disclose any potential OCI situations to the PCO as soon as identified including prior to quote submission. The disclosure should include the facts and an analysis of the actual or perceived conflict and a recommended approach(s) to neutralize or mitigate the potential conflict. The preferred approach to potential conflicts is to negate/obviate the conflict. Mitigation is considered only if it is not practical to negate/obviate the conflict. The PCO will promptly respond to resolve any potential conflicts.

VI. NATIONAL GUARD BUREAU, AGENCY PROTEST PROGRAM

NG Agency Protest Program is intended to encourage interested parties to seek resolution of their concerns with the National Guard (NG) as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum.

Contract award or performance is suspended during the protest to the same extent, and within the same time periods as if filed at the GAO. The NG protest decision goal is to resolve protests within 35 calendar days from Ver. December 2022 97 filing. An agency protest may be filed with either the Contracting Officer or the NG Agency’s Protest Decision Authority, but not both, in accordance with NG protest procedures.

To be timely, the protests must be filed with the periods specified in FAR 33.103.

1) Protests to the Contracting Officer shall be filed under FAR 52.233-2 at:

United States Property and Fiscal Office for Arizona Purchasing and Contracting Division Attn: Vasile Insuratelu 5645 East McDowell Road Phoenix AZ 85008-3495 Email: vasile.insuratelu.civ@army.mil
