DETERMINATION AND FINDINGS
DETERMINATION OF LIQUIDATED DAMAGES
MATOC PROJECT
The Contracting Division, USPFO for Kansas proposes to include FAR Clause 52.211-12 “Liquidated Damages – Construction” in the Contract for MATOC Task Order for CFMO L294 Wash Rack, Ft. Riley, KS.
FINDINGS
1.In accordance with FAR 36.206, Liquidated Damages will be assessed for each calendar day past the completion date required to complete the construction work on this project.
2. Liquidated Damages in the amount of $293.61 will be assessed daily on the Contractor for not completing the project within the specified amount of time. There is also a one-time charge of $200.00 for legal services that will apply.
3. The Government rates were determined by averaging the rates for each type of personnel (Engineers, Inspectors, Contracting Personnel, etc). Calculation of Construction Contract liquidated damages for Government personnel cost are computed using the accelerated rate for “All Others” in DFAS-DE 7010.5R paragraphs C&.8, C7.8.1.2, C7.8.1.3. and C7.8.2. Current FY civilian personnel fringe benefit factors and Military personnel reimbursement rates mandated by the directive found at http://www.dtic.mil/comptroller/rates were utilized in the calculation.
