The Contractor will provide full food services at the government facility for the Kansas Army National Guard and Regional Training Institute (RTI), Nickell Hall, 2930 Scanlon Ave, Salina, KS 67401-8123. Contractor tasks include, but are not limited to the following: Kitchen Management; food preparation, preparing vegetables and fruits for the salad bar, cooking, serving and replenishing food; adhere to safe food handling practices; cleaning facilities, equipment, and utensils; mopping dining and kitchen areas; performing cashier services; maintaining quality control; and ensuring operator maintenance. The requirements of this contract include the following meals: Breakfast, Lunch and Dinner. These meals shall resemble the portion, variety and quality expected at established restaurants. The contractor shall perform to the standards in this contract.

1.2 CONTRACT PERIOD: It is anticipated that the first year contract period will be from date of contract award on or about May 1, 2013 through April 30, 2014 for a total contract period of five (5) years.

1.3 OPTION YEAR PERIODS: After the first year, the option renewal date shall be the anniversary date of the contract. In the event the Government elects to exercise the Option Period(s) hereunder, the Contractor shall be given preliminary notice at least sixty (60) days prior to the expiration of the current contract period. Option Year pricing will be increased in accordance with the percentages allowed under the Consumer Price Index (CPI) for subsistence cost and Employment Cost Index (ECI) for labor cost per the example found at Section J CPI and the Percentage of Subsistence and Labor cost provided on the Pricing Schedule.

1.4 SIK AND NON SIK DINERS: Authorized diners are identified by two classifications, Subsistence-in-Kind (SIK) and Non SIK. The government will provide payment for only the SIK diners. Non SIK diners will pay the contractor direct for meals consumed at the dining facility.

1.5 TYPE OF EVENTS AND SEPARATE ORDERING PROCESSES: Following is a list of the typical type of events that the contractor shall provide food services for. (See Attachment 3, Estimate of Workload, for the estimate of workload which represents the actual headcounts served during Training Year 1 Oct 2011 to 30 Sep 2012 for IDT and AT training events). Because of separate funding sources, the vendor needs to accommodate several separate delivery orders each month and will be required to invoice separately for each order. Example: IDT Training delivery orders may be separate orders for each unit training at RTI. Additionally, AT diners will be on a separate delivery order from IDT and deploying units will also be on another separate order.

1.5.1 Inactive Duty Training (IDT) Diners: Meal Service typically consists of weekend service for Saturday (Breakfast, Lunch and Dinner) and Sunday (Breakfast and Lunch) with a total of 5 meals for the weekend. The RTI IDT weekend typically covers one weekend a month. Other units also attend IDT at the RTI and will contract for meal services on a case by case basis. On occasion, units training at RTI for IDT will require remote site feeding at various training sites. The vendor will package the meals (IE single entre meals) in government furnished food containers for pick up by the unit at the dining facility.

1.5.2 Annual Training (AT) Diners: Meal Service consists of 3 meals (Breakfast, Lunch and Dinner) per day for a specific number of consecutive days. June is typically the Annual Training period for the Officer Candidate School (OCS). Other units also attend AT at the RTI and will contract for meal services on a case by case basis. On occasion, units training at RTI for AT will require remote site feeding at various training sites. The vendor will package the meals (IE single entre meals) in government furnished food containers for pick up by the unit at the dining facility.

1.5.3 School House Soldiers: Soldiers attending training at the RTI will utilize meal services for 3 meals (Breakfast, Lunch, and Dinner) per day for a specific number of consecutive days. Typical schools will have about 30 students for a 2 week period and will run throughout the year.

1.5.4 Outside Entities: On occasion, other corporate or government entities (i.e., Federal, State, or Local Governments) who are approved to utilize the RTI for planned training events may request meals under the regiment of this contract. Coordination and payment for these events will be made directly to the vendor from the outside organization.

1.5.6 Other Military Organizations: On occasion, other military organizations, other than the Kansas Army National Guard, i.e., regular army or units deploying for active duty may train at the RTI and request meals under the regiment of this contract. Depending on the funding source for these units, the unit may pay the vendor direct for the meals, or could send the funds to the USPFO for Kansas on a Interdepartmental Purchase Request (MIPR). If a MIPR is received by the USPFO for Kansas, then the USPFO Purchasing Office will issue a separate delivery order for these meals. The separate delivery order will be invoiced separately.

1.5.7 Outside Business: At no time can the vendor use the government furnished facility or equipment to cater to outside organizations or conduct an outside business for profit. The government furnished facility and equipment are strictly for the use in performing the requirements of this contract and preparing meals for the entities described above that may utilize the RTI facilities.

1.6 No funds are obligated under this contract until a task order is issued.

1.7 GUARANTEED MINIMUM ORDER: This contract offers a minimum guaranteed contract amount of $100,000 over the life of the contract. The maximum contract amount over the life of the contract is $5,000,000. (See Attachment 3, Estimate of Workload, for the actual headcounts served during Training Year 1 Oct 2011 to 30 Sep 2012 for IDT and AT training events). The estimate of workload is an estimate only and does not obligate the government to the headcount numbers reflected thereon. Other than the guaranteed contract amount of $100,000 over the life of the contract, the government is not obligated to pay the vendor for any anticipated profits or facility usage.

1.8 MINIMUM/MAXIMUM ORDER LIMITATION: When the government requires supplies or services covered by this contract in an amount of LESS THAN 15 (FOURTEEN) OR LESS MEALS OR GREATER THAN 800 MEALS PER SERVING; the government is not obligated to purchase, nor is the caterer obligated to furnish, those services under this contract.

1.9 TASK ORDERS: Services furnished under this contract shall be ordered on a Task Order (DD Form 1155 - Order for Supplies or Services). The delivery order shall obligate funds and provide the vendor with the 1) date of the order; 2) contract number and task order number; 3) period dates; 4) estimated headcount; and 5) estimated cost.

1.10 WEEKLY KITCHEN REQUISITION SHEET: The USPFO for Kansas Purchasing office will issue a monthly Delivery Order based on the headcount information submitted by the units utilizing the RTI. However, due to fluctuations in the number of soldiers attending the training center, the RTI On-Site Liaison for the COR will make adjustments in the headcount numbers reflected on the Delivery Order and will provide the vendor a Weekly Kitchen Requisition Sheet with the adjusted headcount numbers. The vendor is to use the adjusted headcount numbers on the Weekly Kitchen Requisition Sheet (and not the Delivery Order) to order and prepare meals. The Weekly Kitchen Requisition Sheet will also be the basis for invoicing.

1.11 HEADCOUNT AND ADJUSTMENTS - An estimated headcount shall be provided for each scheduled class approximately two weeks prior to the scheduled training on a Weekly Kitchen Requisition Sheet. Due to fluctuations in the number of soldiers attending the training center, it is anticipated that the number of meals required during a training period will vary. The contractor may adjust headcounts, but because of food shipments, the contractor must be given a 48 hour prior notification before meal consumption with the exception of the first two days of each OCS Annual Training session. KIND

AMOUNTS

Workmen's Compensation for

The State of Kansas

Comprehensive General Liability

$500,000/per occurrence for bodily injury

Comprehensive Automobile Liability

$200,000 per person and

$500,000 per occurrence for bodily injury and

$20,000 per occurrence for property damage

The above kinds and amounts of insurance shall also be maintained by each of the contractor's outside consultants, associates and subcontractors if any of their work will be performed on a Government installation.

The contractor shall provide to the Contracting Officer evidence of required insurance, including all necessary endorsements, in accordance with the terms of the above referenced clause before commencing work under this contract.

Government Quality Assurance Plan:

In your role as Contracting Officers Representative (COR), you assume some Quality Assurance duties. You will monitor contractor performance, complete and sign the Quality Assurance Worksheet provided below at least monthly, but you can submit the worksheet more frequently if needed. This worksheet allows you to document compliance with the Contract and fill a regulatory requirement to ensure adequate oversight is being performed.

Quality Assurance Plan Worksheets are to be sent directly to the Contracting Officer (CO), not later than the 5th day of the month following the service (every month). At a minimum, the COR must send a completed copy of the worksheet to the CO after the first month of service and for any months where there is a rating other than Green. The CO will assume a quality performance rating of “Green” on all measured deliverables unless otherwise notified.

The quality rating may change from “Green” to “Red” without notice, however we encourage the COR to utilize the “Yellow” quality rating to alert the CO of quality issues that have the potential for a “Red” quality rating if corrective action is not taken.

Any time the rating is less than Green the COR shall clearly document the worksheet to indicate what did or did not occur per the PWS requirement. When an observation indicates other than a “Green” rating, the COR will require the Contractor to initial the observation.
