Repair of Emergency Generator and Automatic Transfer Switch
(ATS)
13 August 2019
1. GENERAL: Contract to repair the backup generator and the Automatic Transfer Switch (ATS) which switches between utility power and the backup generator for Building 1047. This equipment is located adjacent to Building 1047 on the Air National Guard Complex located at 2251 Air Guard Rd SE, Kirtland AFB, NM 87117.
1.1 Background: The backup generator has been out of service between 1 – 2 years and cannot be started due to the lack of 12V batteries. The maintenance history for the generator shows it was last started and received maintenance on 05 May 2018. In addition the ATS is faulty and switches to backup generator power even when utility power is available. Electricians have noted that voltage occasionally spikes to 500+ Volts for the utility supplied power.
1.2 Basic Services/Terms and Conditions: The Contractor shall provide qualified personnel, services, materials, equipment, supplies and facilities necessary to perform the generator and ATS repair and maintenance. The contractor shall furnish all management, labor, transportation, pick-up, waste disposal and delivery services and facility operations in accordance with the terms and conditions of this contract.
1.3 Objectives:
1.3.1 Repair and Maintenance of Backup Generator:
1.3.1.1 Provide missing components and complete a functional system check or startup of generator.
1.3.1.2 Top off any fluids that are low and replace worn belts.
1.3.2 Repair and Protect Existing ATS:
1.3.2.1 Restore ATS to original functionality where utility power is the main source of power to the building and will switch to the generator as the emergency source when utility power is unavailable or when utility power is poor in quality. Provide a Surge Protection Device (SPD) that will protect the ATS from voltage surges.
1.4 Scope: All work accomplished will be in accordance with OSHA regulations and the NEC.
1.4.1 Repair and Maintenance of Backup Generator: Ensure the generator is repaired such that it provides quality power to Building 1047 when utility power is unavailable or degraded. The generator will provide the correct voltage with the correct phase rotation to Building 1047. Ensure all gauges and instrumentation are accurate. Install the 12V batteries needed for generator functionality.
1.4.2 Repair Existing ATS: Repair sensors and instrumentation so that the ATS functions by utilizing utility power as its primary source and the generator as its secondary or emergency source of power.
Utility conductors and generator conductors inside the enclosure shall be properly labeled/marked with its source and corresponding phase. Phase rotation of utility power and emergency power will match. Install a sufficiently sized SPD that will protect the ATS from voltage spikes from utility power.
1.5 Report: Provide a report that details all service performed on the generator and ATS. Include all values that were measured from gauges on the generator or from meters that were utilized to assess the generator and the ATS. The report shall be delivered with a clear and easy to read title on the cover and spline of a 3 ring binder.
1.6 Location: Work will be accomplished at the New Mexico Air National Guard, Kirtland Air Force Base, Albuquerque, New Mexico. Most work will be conducted adjacent to Building 1047. The contractor will be given a work area to conduct scans and develop report information.
1.7 Performance Period: Work must begin before 30 Sep 2019. Failure to begin work by this date will result in the cancellation of the contract by the Contracting Officer. Work will be completed within 30 calendar days of the start date. The Government reserves the right to extend the terms of this contract to an annual service contract with option years.
1.8 Contractor Requirements: The contractor shall ensure that all personnel under his employment are familiar with and obey all applicable regulations and restriction of the NMANG. Personnel are to stay within the limits of the established work area. Contract personnel will not enter areas identified as controlled or restricted unless under escort by an authorized military member.
1.9 Work Schedule: The contractor shall coordinate all work during regular working hours (as indicated below).
1.9.1 Normal base work hours for the CONTRACTOR will be between the hours of 7:30 am through 4:30 pm, excluding Saturdays, Sundays, and Federal Holidays. If the Contractor desires to work during periods other than above, Contractor must notify the Contracting Officer 5 working days in advance of Contractor’s intention to work during other periods to allow assignment of additional inspection forces and for notification of Contracting Officer’s Representative; fire; security; and safety. When the Contracting Officer determines that they are reasonably available, Contracting Officer may authorize the Contractor to perform work during periods other than normal duty hours/days.
However, if inspectors are required to perform in excess of their normal duty hours/days solely for the benefit of the CONTRACTOR, the actual cost of the inspection, at overtime rates, will be charged to the Contractor and will be deducted from the final payment of the Contract amount.
(Note: If applicable, at time of award this paragraph will be modified to the negotiated schedule for this Project). The following Federal legal Holidays are observed by this base:
New Year's Day 1 January Martin Luther's King's Birthday Third Monday of January President's Day Third Monday of February Memorial Day Last Monday of May Independence Day 4 July Labor Day First Monday in September Columbus Day Second Monday in October Veteran's Day 11 November Thanksgiving Day Fourth Thursday in November Christmas Day 25 December
NOTE: Any of the above holidays falling on a Saturday will be observed the preceding Friday, holidays falling on a Sunday will be observed on the following Monday. Any deviation from this schedule will require 24 hours advance notice and approval of the Contracting Officer.
1.10 Military Installation Requirements: Due to security concerns, the Government requires all contractors and associated subcontractors to be in the presence of a US military escort at all times within specific “restricted” locations. This escort shall be provided by the NMANG. It is the Contractor’s responsibility to notify the Contracting Officer or their designated representative at least 24 hours in advance of the time and location that the escorts shall meet the Contractor. The Contractor must make all attempts to promptly meet this appointment. If the Contractor is more than one hour late, the Contractor will not be allowed access to Kirtland Air Force Base on that working day. The Contractor will not be able to resume work until a new escort arrangement can be made. The NMANG will not be held liable for any claim attributable to the Contractor’s failure to follow these guidelines for arranging and meeting escorts.
1.10.1 The Contractor is responsible for the collection and disposal of all debris, rubble, residue, and waste material generated in the performance of work under this contract. All such materials shall be disposed of at an approved landfill by the Contractor or at a location specified by NMANG/CE personnel. The Contractor is not permitted to deposit any such materials in base trash collection containers or at any on-base locations without prior approval of the Contracting Officer.
1.10.2 The Contractor shall coordinate the work of subcontractors and shall ensure the coordination of the work between the various trades. The Contractor will seek advice from 150th Civil Engineer Flight (CES) Government Point of Contact or Project Inspector (PI) on specific expectations. 1.3.3 The government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The government may require repair or replacement of nonconforming supplies or re-performance of nonconforming services at no increase to contract price. If repair/replacement or re-performance will not correct the defects or is not possible, the government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies and services. The government must exercise its post-acceptance rights (1) within a reasonable time after the defect was discovered or should have been discovered; and (2) before any substantial change occurs in the condition of the item, unless the change is due to a defect in the item.
1.11 Workplace Safety: The Contractor is responsible for the safety of those under his charge. Care should be taken with all vehicles especially when backing (using a spotter to watch for obstructions and personnel) and in the performance of all work. The Contracting Officer or their designated representative reserves the right to halt progress of work if unsafe workplace practices are found and until they are addressed to his satisfaction. The Contractor shall ensure that all work performed is compliant with OSHA regulations, federal, state and local laws.
1.12 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer and government POC may meet periodically with the contractor to review the contractor's performance. At these meetings the Contracting Officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.
These meetings shall be at no additional cost to the government.
1.13. Quality Control: The contractor will develop and implement a quality control plan specific to this contract effort, and will be responsible for self-inspection of his own work.
1.14 Convenience Facilities: Contractor shall use restroom facilities unless other arrangements are made and approved by the Contracting Officer.
1.15 Utilities: The contractor may use base utility services on the base, where reasonable, when required for this work.
2. DELIVERABLES:

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified.
