Section 00 21 16 - Instructions to Proposers
INSTRUCTIONS TO OFFERORS
PROPOSAL SUBMISSION REQUIREMENTS, EVALUATION FACTORS, AND BASIS OF
AWARD
1.0 OVERVIEW
The Government will evaluate the proposal in accordance with the evaluation factors stated in this solicitation. The evaluation factors in this solicitation are described herein using the evaluation rating systems outlined for selection procedures.
2.0 BASIS OF AWARD
The Contracting Officer will award a Firm-Fixed Price contract to that responsible Offeror whose proposal conforms to the Request for Proposal (RFP), is determined to include fair and reasonable prices, and offers the overall best value to the Government considering the selection factors listed in this solicitation. The Government will determine the best overall value on the basis of the “Lowest Price Technically Acceptable” (LPTA) process. This process allows the
Government to make an award to the offeror who meets the Government’s minimum technical requirements and offers the lowest fair and reasonable price. In accordance with FAR 15.101-2, the LPTA process does not permit tradeoffs between price and non-price factors.
For a proposal to be considered for award, the proposal must, at a minimum, meet all proposal submission requirements for non-cost evaluation factors. The application of the best value, LPTA technique in the source selection and contract award process is as follows:
a. A decision on the technical acceptability of each Offeror’s proposal will be made based upon the comparison of the offer with the evaluation factors discussed herein. Only those
Offeror’s proposal determined to be technically acceptable, either initially or as a result of discussions, only if discussions are held, will be considered for award.
b. The Government’s intention is to award without discussions, but reserves the right to enter discussions if necessary.
c. Award will be made to the lowest-priced Offeror with acceptable rating for the two (2) non-cost factors. There are no ranking of factors and no tradeoffs between technical factors, past performance, or price in the LPTA process.
3.0 Evaluation Factors
Factor Location Description
FACTOR 1 VOLUME 1 Management Approach – Offerors shall describe their Operations Plan, Key
Personnel, and Experience Executing Job
Order Contracts (JOC).
FACTOR 2 VOLUME 1 Past Performance – Offeror shall demonstrate past performance in successfully executing JOC task orders.
FACTOR 3 VOLUME 2 Price and Other Required Information –
Submit a properly filled out bid schedule for CLIN 0001-0004, properly executed bid guarantee, required pre-award information, and representations and certifications.
Evaluation of Factor 1 - Management Approach
The purpose of this factor is to assess whether the Offeror’s proposal will satisfy the
Government’s minimum requirements.
The Government will review the clarity, adequacy, capabilities and resources of the Offeror’s described plan to respond to the Government’s notification of a proposed task order requirement.
The technical aspects of the Management Approach proposal will be evaluated based upon the following subfactors: Operations Plan, Key Personnel, and Experience Executing Job Order
Contracts (JOC).
Each of these subfactors will be evaluated for acceptability on a pass/or fail basis. If any subfactor of Factor 1 Management Approach is considered unacceptable, Factor 1 will be rated as unacceptable.
Factor 1 – Subfactor 1: Operations Plan.
For an Offeror’s Operation Plan to be considered acceptable, it must, at a minimum, accomplish the following:
a. The plan must adhere to the proposal submission instructions and address the Offeror’s approach and methodology and depth of understanding of the contract performance requirements for management, supervision, manpower and equipment resources, quality control/assurance, and safety associated with Job Order Contracts.
b. The Operations Plan shall also include an organizational structure, which demonstrates the efficiency in day-to-day operations, quick resolution of problems, clear roles and responsibilities and excellent communication networks.
c. The plan should also demonstrate the ability of the firm to manage multiple construction projects of varying magnitudes relating to the repair and alteration of real and personal property facilities, e.g. maintenance, repair, and minor construction services.
d. The plan shall include a list of primary subcontractors with capability and equipment resources to respond to Job Order Contract task orders.
Factor 1 – Subfactor 2: Key Personnel
For an Offeror’s Key Personnel to be acceptable, the proposal must identify the qualifications of key personnel in the following positions:
a. Contract Manager
b. Project Superintendent
c. Quality Control Manager
d. Site Safety Health / Environmental Compliance Manager
The above listed key personnel must have a minimum of three (3) years of experience in the operations of construction projects similar in nature, size, scope and complexity of this solicitation. Resumes for all team members to include Letter of Commitments signed by key subcontractors and the prime contractor shall also be provided.
Factor 1 – Subfactor 3: Experience Executing Job Order Contracts
The Offeror’s experience will be evaluated to allow the Offeror’s to demonstrate their ability to execute Contract requirements. Offeror shall submit a minimum of three (3) and no more than five (5) project experiences completed or substantially completed within six (6) years from the date of this solicitation that best represent their experience similar to the scope of work for this solicitation. Two (2) of the five (5) projects submitted may be current construction projects with at least 50% construction progress completed. If Offeror is proposing as a Joint Venture (JV) and project experiences cannot be provided as a JV, each partner shall submit project experience information, with no more than five (5) projects each.
Table 1. Management Approach Subfactor Evaluation Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 2 - Past Performance
The Offeror’s past performance record will be evaluated to determine the Offeror’s probability of successfully performing the Contract requirements. Offeror shall submit a minimum of three
(3) and no more than five (5) projects completed or substantially completed within 6 years from the date of this solicitation that best represent their experience similar to the scope of work for this solicitation. Two (2) of the five (5) projects submitted may be current construction projects with at least 50% construction progress completed. If Offeror is proposing as a Joint Venture
(JV) and past performance cannot be provided as a JV, each partner shall submit past performance information, with no more than five (5) projects each.
The past performance submissions shall match the project experiences submitted for Factor 1 -3.
In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/ affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror. The Government may also use other tools to gather information regarding an
Offeror's qualifications and past performance. The Offeror shall provide information on any problems encountered on the identified contracts and the corrective actions taken.
While the Government may elect to consider data from other sources, the burden of proof rests with the Offerors to provide past performance information that is accurate, detailed, current, and complete.
The Offeror’s Past performance shall be evaluated and assigned a rating based upon the minimum acceptability requirements described herein utilizing the following table:
Table 2. Past Performance Evaluation Ratings
Rating Description
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror[s performance record is unknown. (See Note Below)
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will successfully perform the required effort.
Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305 (a) (2) (iv)). “Pricing” of option periods, include consideration of any adjustments must be performed by an economic price adjustment for those periods, as follows:
An economic adjustment will be applied to the contract coefficient(s) addressing changes in the cost of labor, equipment and material in the Unit Price Book (UPB) (this includes consideration of Davis Bacon issues). This allows for economic increase or decrease of the prices in the UPB and serves to adjust line item prices by the percentage increase or decrease of the economic trend in the construction market. The economic price adjustment will be based on the Building Cost Index (BCI) found in the Market Trend pages of the Engineering News Record
(ENR). The economic adjustment is not applied to the cost items comprising the coefficient. No upward adjustment can apply to task orders awarded prior to the effective date of the adjustment, regardless of the date of commencement of work thereunder.
The adjustment will be made in accordance with the following equation. The resulting revised coefficient(s) must be applied throughout the option year.
N = C + i
Where: N = New Coefficient
C = Base Year Coefficient i = Change Factor (% increase or decrease from base to option year)
The Index Factor, i, shall be computed according to the following equation:
i = BCIN – 1
BCIC
Where:
BCIN is the Building Cost Index, published in the ENR, for the month prior to the effective date of the option period.
BCIC is the Building Cost Index, as published in the ENR, on the date of the award of the contract. The
BCIC is ___________, based on the award date of ___________.
If the BCI or the ENR ceases to be published, the parties shall agree on substitute indices.
EXAMPLE: For the base year of a contract the coefficient (C) is 1.10. The cost to the government for a line item whose cost is $100.00 is 1.10 x $100.00 = $110.00.
Option Year 1. For the first option year the coefficient will be adjusted as follows:
i = BCIN -1 = 3111.86 – 1 = 1.0133 -1 = .0133
BCIC 3071.10
The new coefficient would be calculated as follows:
N = C + i = 1.10 + 0.0133 = 1.1133
The above line item under the option period would be 1.1133 x $100.00 = $111.33.
Option Year 2.
For the second option year, if the BCI for the month prior to the effective date of the option period was 3002.99, the coefficient will be adjusted as follows:
i = BCIN – 1 = 3062.99 – 1 = .9974 – 1 = -0.0026
BCIC 3071.10
The new coefficient would be calculated as follows:
N = C + i = 1.10 -0.0026 = 1.0974
The above line item under the option period would be 1.0974 x $100.00 = $109.74.
Note 1. Round calculations for the Change Factor (i) to the nearest ten thousandth
Note 2. ENR indices for calculation of coefficients for the option years are taken from the McGraw Hill publication, ENR, published during the month prior to the effective date of the option. The ENR Index for the base year (contract award) is the most recent ENR Index published for the month prior to initial contract award.
Price will not be rated, but will be evaluated for fairness and reasonableness through the use of a price analysis. The price evaluators will also check for appearance of unbalanced line item prices.
Offerors are cautioned to distribute direct costs, such as material, labor, equipment, subcontracts, etc. and to evenly distribute indirect costs, such as job overhead, home office overhead, bond, etc., to the appropriate contract line items. Both parties shall presume that field overhead costs through the proposed contract duration are inclusive in the offered price for the contract. If deemed necessary, the supplemental price breakdown information will be used to assist the
Government in performing the price evaluations described above.
All pricing should be included in the coefficients. The Government considers a coefficient below 1.0 to be unreasonable and that Offerors proposal with coefficients below 1.0 will not be considered for award.
Price Analysis including techniques and procedures described under FAR 15.404-1(b) will be the primary means of assessing proposal price reasonableness.
Offeror’s Responsiveness. It is the Offeror's responsibility to ensure the completeness and accuracy of his or her proposal. Excepting any apparent clerical or arithmetic mistakes found in the bidding schedule (Section B), corrections will not be made by the Government. Any proposal that modifies or fails to conform to the requirements of this Solicitation will be considered unacceptable.
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20 percent of the bid price or $1.2M, whichever is less.-
(d) If the successful bidder, upon acceptance of its bid by the Government within the period specified for acceptance, fails to execute all contractual documents or furnish executed bond(s) within 10 days after receipt of the forms by the bidder, the Contracting Officer may terminate the contract for default.-
(e) In the event the contract is terminated for default, the bidder is liable for any cost of acquiring the work that exceeds the amount of its bid, and the bid guarantee is available to offset the difference.

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (OCT 2015)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or
State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.;
and
(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent
Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
52.209-13 VIOLATION OF ARMS CONTROL TREATIES OR AGREEMENTS--CERTIFICATION (JUN 2018)
(a) This provision does not apply to acquisitions below the simplified acquisition threshold or to acquisitions of commercial items as defined at FAR 2.101.
(b) Certification. [Offeror shall check either (1) or (2).]
____ (1) The Offeror certifies that--
(i) It does not engage and has not engaged in any activity that contributed to or was a significant factor in the
President's or Secretary of State's determination that a foreign country is in violation of its obligations undertaken in any arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. The determinations are described in the most recent unclassified annual report provided to
Congress pursuant to section 403 of the Arms Control and Disarmament Act (22 U.S.C. 2593a). The report is available via the internet at https://www.state.gov/t/avc/rls/rpt/; and
(ii) No entity owned or controlled by the Offeror has engaged in any activity that contributed to or was a significant factor in the President's or Secretary of State's determination that a foreign country is in violation of its obligations undertaken in any arms control, nonproliferation, or disarmament agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. The determinations are described in the most recent unclassified annual report provided to
Congress pursuant to section 403 of the Arms Control and Disarmament Act (22 U.S.C. 2593a). The report is available via the internet at https://www.state.gov/t/avc/rls/rpt/; or
____ (2) The Offeror is providing separate information with its offer in accordance with paragraph (d)(2) of this provision.
(c) Procedures for reviewing the annual unclassified report (see paragraph (b)(1) of this provision). For clarity, references to the report in this section refer to the entirety of the annual unclassified report, including any separate reports that are incorporated by reference into the annual unclassified report.
(1) Check the table of contents of the annual unclassified report and the country section headings of the reports incorporated by reference to identify the foreign countries listed there. Determine whether the Offeror or any person owned or controlled by the Offeror may have engaged in any activity related to one or more of such foreign countries.
(2) If there may have been such activity, review all findings in the report associated with those foreign countries to determine whether or not each such foreign country was determined to be in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament agreement to which the United States is a party, or to be not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. For clarity, in the annual report an explicit certification of non-compliance is equivalent to a determination of violation. However, the following statements in the annual report are not equivalent to a determination of violation:
(i) An inability to certify compliance.
(ii) An inability to conclude compliance.
(iii) A statement about compliance concerns.
(3) If so, determine whether the Offeror or any person owned or controlled by the Offeror has engaged in any activity that contributed to or is a significant factor in the determination in the report that one or more of these foreign countries is in violation of its obligations undertaken in an arms control, nonproliferation, or disarmament https://www.state.gov/t/avc/rls/rpt/ https://www.state.gov/t/avc/rls/rpt/ agreement to which the United States is a party, or is not adhering to its arms control, nonproliferation, or disarmament commitments in which the United States is a participating state. Review the narrative for any such findings reflecting a determination of violation or non-adherence related to those foreign countries in the report, including the finding itself, and to the extent necessary, the conduct giving rise to the compliance or adherence concerns, the analysis of compliance or adherence concerns, and efforts to resolve compliance or adherence concerns.
(4) The Offeror may submit any questions with regard to this report by email to NDAA1290Cert@state.gov. To the extent feasible, the Department of State will respond to such email inquiries within 3 business days.
(d) Do not submit an offer unless--
(1) A certification is provided in paragraph (b)(1) of this provision and submitted with the offer; or
(2) In accordance with paragraph (b)(2) of this provision, the Offeror provides with its offer information that the
President of the United States has--
(i) Waived application under U.S.C. 2593e(d) or (e); or
(ii) Determined under 22 U.S.C. 2593e(g)(2) that the entity has ceased all activities for which measures were imposed under 22 U.S.C.2593e(b).
(e) Remedies. The certification in paragraph (b)(1) of this provision is a material representation of fact upon which reliance was placed when making award.
