ACQUISITION UTILIZING A MATOC

SWG TASK ORDER REQUEST NOTICE PROCESS
TORN Notice
• The Task Order Requirement Notice (TORN) is issued to the MATOC pool.
• For each task order awarded under a MATOC, the Contracting Officer shall notify all A-E firms within the selected MATOC pool of the task order requirement thru a TORN.
• All TORNs shall include:
• Short Summary of the Scope of Work
• Task Order specific Selection Criteria. Criteria is listed in order of importance and relative weight including at a minimum, the qualification-based selection criteria required by FAR 36.602-1.

MATOC’s SF330 Updates-This is a change 9 March 2023!
• AE firms will be encouraged to amend their SF330s with recently completed projects and updated resume experience around the anniversary date of the MATOC award.
• MATOC holders are recommended to meet with the government to obtain an overview on anticipated program requirements and a projection of potential upcoming A-E service requirements; this meeting is highly recommended just prior to the annual SF330 update.
• The Update process is a substitution of older information for newer information and is not an additive process whereby the SF330 increases the number of key personnel or example projects beyond what was in the original SF330.

Key Changes/Modifications to Previous Procedures
• Request for supplemental information will not be routinely asked
• KO, selection chair and local SB specialist coordinate on set aside decision
• DD 2579 is prepared for all awards not just set aside
• Selection Board initially evaluates SF330s on file and prepares a MFR for the KO that summarizes if supplemental info is needed
• These TORN procedures now apply to all MATOC A-E base contracts, both existing and new
• Annual SF330 update cyclical near anniversary date of the IDC base award
SWG TASK ORDER REQUEST NOTICE
PROCESS
Two TORN versions
• Simplified TORN: used when the selection board already has sufficient information in the existing SF 330s to determine the most highly qualified firm to perform the task order requirement and that supplemental information is not needed. The Simplified TORN must state clearly that supplemental information will not be requested, accepted, or evaluated.
• RSI TORN: used when the selection board determines that available information within the existing SF 330s is insufficient to determine the most highly qualified A-E firm to perform the task order requirement.
SIMPLIFIED TORN PROCESS
• Existing SF330s for all firms in the MATOC pool/reserve pool are reviewed to determine if supplemental information is needed in order to identify the most highly qualified firm for the task order requirement.
• A TORN is issued to all firms in the pool, or just to those firms in the selected MATOC reserve pool, as applicable.
• Government evaluates information using criteria in FAR 36.602-1
• Government notifies firms of selection, coordinates debriefs, if requested. All firms sent a TORN are notified by the KO within 3 business days of the selection decision.
PRE-PROPOSAL CONFERENCE
Preproposal conference(s) are held with the A-E firm and Government representatives.
• To discuss and resolve general questions concerning the contract requirements, SOW, and RFP instructions.
• An amendment may be issued to clarify the RFP.
• This will be held virtual or at the SWG USACE building in
Galveston, TX.
PROPOSAL EVALUATION
Government Technical Analysis of A-E Proposal:
• A-E’s Assumptions reviewed.
• A-E’s description of work reviewed for clearly delineated of tasks and what disciplines is performing it.

Common Proposal Mistakes.
• Providing Tasks that is not in the SOW.

• No providing definitive exhibits i.e. survey areas, stations numbers, etc.

THIS IS NOT A REQUEST FOR PROPOSAL – This is a public announcement (synopsis) with a response period of 51 days. (May 22 to July 12)
A-E services to provide planning, design, and engineering during construction primarily in support of the Civil Works mission area within the SWG boundary and may be used for similar horizontal engineering projects within the SWD area of responsibility (AOR). Capacity could be transferred outside the SWD AOR for high priority projects or emerging programs if capacity in other regions within the continental U.S. is inadequate.
CONTRACT INFORMATION
Multiple Award Task Order Contract (MATOC) with a total shared capacity of $900M and includes a target of six (6) Unrestricted A-E Indefinite Delivery Contracts (IDCs) and a target of six (6) separate IDCs reserved for Small Business.
The Government reserves the right to award more or less than the target number of IDCs within the Unrestricted and Small Business IDC groups depending on the number of contractors considered highly qualified IAW Brooks Act procedures.
The total contract value of this procurement not to exceed $900,000,000.00 over the eight-year life of the MATOC.
Task Order types include Firm-Fixed Price, Cost-Plus Award Fee, Cost-Plus Fixed Fee, Time and Materials, and Labor Hours.
The Government will issue a rate sheet to the most highly qualified offerors and will negotiate fair and reasonable prices once, with an escalation rate to be applied every 12 months.
As this MATOC includes a Small Business reserve pool, the qualifications of the reserve pool must first be considered for task order requirements.
Firms will be required to demonstrate an acceptable accounting system as required by FAR parts 16 and 31 and specifically defined by DFARS 252.242- 7006.
CONTRACT INFORMATION CONTINUED
A-E services for this contract will be used to provide all types of civil works related engineering areas, such as:
flood damage risk reduction;
floodplain modeling;
coastal erosion;
storm damage risk reduction and beach nourishment;
shoreline and stream bank erosion protection;
shallow and deep draft navigation;
environmental and ecosystem habitat restoration;
comprehensive watershed evaluations;
infrastructure;
and multi-purpose water resources projects.
PROJECT INFORMATION
The capabilities of A-E firms would include comprehensive planning, technical analysis, engineering, design, and engineering during construction. Services include:
data collection, geotechnical investigations, surveying, preliminary studies through feasibility report development;
engineering design through detailed plans, specifications, and design analysis/design documentation report prep;
alternate delivery method request for proposal development;
value engineering;
technical and biddability, constructability, operability, environmental, and sustainability (BCOES) reviews;
documentation for right of entry and right of way; and engineering during construction for both inland and coastal civil works or similar horizontal projects for the military and IIS programs.
A. Maximum ten (10) relevant projects of the prime, the subcontractor(s), or both...Submitted projects shall be at least 50% completed within the past fifteen (15) years from the date of issuance of the synopsis.
B. The selected firm must have, either in-house or through consultants, the disciplines listed below, with registration and board certification (where available) required (include licensure, state/country, and certification numbers) where applicable.
C. The firms will be evaluated in terms of work quality, compliance to schedules, and cost controls, with emphasis on projects submitted under Criteria A
D. At least three (3) individual task orders simultaneously (UR-$5M, SB-$500k)
E. Team’s familiarity within SWD Boundaries (TX, OK, KS, LA, AR,& MO)

Less Relevance will be given to projects submitted by subcontractor teaming partners.
Preference will be given to JVs who have previously performed work together as the prime contractor.
Projects for federal agencies, USACE, or associated with USACE (such as work-in-kind for non-federal sponsors) will be MORE relevant, when all other aspects of the scope are considered equal.
Specialized Experience and Technical Competence
Offerors shall ensure that the total combination of projects submitted address all five areas of emphasis. Offerors shall annotate when individual projects address more than one area of emphasis.
Areas of Emphasis:
(1) navigation structures (lock and dams, floodgates, etc.);
(2) floodwalls and closure structures;
(3) beaches, dunes, and coastal structures;
(4) dams and levees; and
(5) pump stations.
Interested firms having the capabilities and qualifications to perform this work must submit one copy of SF330 (7/2021 Edition) including Parts I and II as described herein not later than 2:00 p.m. (Central Time) on the response date as above.
Submit only one SF330, Part I of the SF330 from the Prime for the design team, completed IAW the SF330 instructions and additional instructions herein. It must contain information in sufficient detail to identify the team (prime, other offices of the prime, and consultants) proposed for the contract.
SF330 Part II shall be provided for the specific prime, other offices of the prime, and subcontractor offices proposed to perform the work.
Section H, Part I of the SF330, SHALL NOT EXCEED 15 PAGES.
Submittals must be received no later than 2:00 P.M. Central Time on 12 July 2023.

JOINT VENTURES

1) EXAMPLE – ABC-XYZ JV provides 6 projects, Remaining 4 projects from ABC, XYZ, or Subs.
a. At least six (6) projects are performed by the prime “ABC-XYZ JV”. Preference will be given for projects performed by ABC, XYZ, and ABC-XYZ JV …demonstrating capability to self-perform a greater number of areas of emphasis without teaming arrangements.
b. Preference will be given to JVs who have previously performed work together as the prime contractor.
c. Less Relevance will be given to projects submitted by subcontractor teaming partners.
2) EXAMPLE – ABC-XYZ JV provides 2 projects, ABC (managing member) provides 4 projects, XYZ provides 4 projects.
a. ABC, the managing member, receives credit for meeting the minimum six (6) projects.

b. However, no previously performed work. Preference will be given to JVs who have previously performed work together as the prime contractor.
2) EXAMPLE – USA (managing member) shall provide 6 projects, CE provides 2 and subconsultant provides 2.
a. Only eight (8) projects are performed by the prime “USA-CE JV”. Preference will still be given if the 8 projects demonstrate capability to self-perform a greater number of areas of emphasis without teaming arrangements.
b. Not a JV who has previously performed together as the prime contractor.
c. Less Relevance will be given to projects submitted by subcontractor teaming partners.

13 CFR 125.8(e)…A procuring activity may not require the protégé firm to individually meet the same evaluation or responsibility criteria as that required of other offerors generally.
Synopsis - the Prime must have performed and completed a minimum of six (6) projects (as the prime contractor, or designer of record)
The protégé firm (GPT) is not required to meet the same criteria “generally” as the prime. Managing members must only “supplement” experience. GPT may choose to propose with a JV that it has previous experience with to meet the six (6) project minimum.
13 CFR 125.8(e)…When evaluating the capabilities…of an entity submitting an offer for a contract set aside or reserved for small business as a joint venture established pursuant to this section a procuring activity must consider work done and qualifications held individually by each partner to the Joint Venture as well as any work done by the joint venture itself previously.
Agency gives preference to previous work performed by the joint venture itself and further considers the individual experience of the protégé firm (GPT-managing member) as well as the mentor firm (AI) within the maximum ten (10) projects.
SB MENTOR-PROTEGE
Minimum Requirement – Team submits ten (10) projects for five (5) Areas of Emphasis:
(1) navigation structures (lock and dams, floodgates, etc.);
(2) floodwalls and closure structures;
(3) beaches, dunes, and coastal structures;
(4) dams and levees; and
(5) pump stations.
