Appendix A - Proposal Submittal and Basis of Award

1. Overview.

1.1. The intent of this solicitation is to select one (1) contractor for construction of new kitchen facility and upgrade/ renovation of the on-site waste water treatment plant of the existing Port Isabel Detention Center (PIDC), Port Isabel, TX.

1.2. The basis of award is Lowest Price Technically Acceptable. The Contracting Officer will award a Firm

Fixed Price Construction contract to the responsible offeror whom the Source Selection Authority determines conforms to the solicitation and is technically acceptable, is fair and reasonable and offers the lowest price to the

Government.

2. Submittal of offers.

2.1. Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein.

However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror’s capabilities to successfully complete the project. Proposals should follow in the order of sequence set forth in the RFP and be limited to fifty (50) pages. Information provided out of sequence may not be evaluated and may result in the offeror’s disqualification from award. Requirements stated in this RFP are minimums.

2.2. SUBMISSION REQUIREMENTS: Interested firms are invited to submit their proposal directly to Federal

Business Opportunities at www.fbo.gov only, hard copies and CD's will not be accepted.

A note will be visible within the “Notice Details” sub-tab. The “Electronic Response” sub-tab indicates that the opportunity allows for electronic responses. Note, a vendor must login to the system to be able to submit electronic responses for opportunities.

1.) There are two types of electronic response submissions possible. Please choose the “Document Upload.”

The user can enter a description for every file to be uploaded (note that this is optional). To select a file for upload, the user clicks on the “Browse” button. (Note for files over 10 Mb, please use the large upload (JAVA) button).

This will allow the user to select a file located on their computer for upload.

2.) After selecting the file, the user can click the “Add New” button to select additional files for upload.

3.) The user can delete any file(s) previously selected for upload by clicking on the “Delete” button.

4.) The user has three options at the bottom of the Response page:

(a) Submit saves and electronically submits the response to the government point of contact for that opportunity in the system. Note, the system will send an email to the email address on file for the user confirming the electronic submission;

(b) Save as Draft saves the response created, but does not submit it to the government point of contact for the opportunity in the system; if selected, the system returns to the Notice Details tab and there is a note at the top indicating that the user has saved a draft response for the opportunity. The user can click on the blue Click here link in the note to review/submit a response.

(c) After clicking the link to review/submit, the system opens the Electronic Response tab and displays the draft response for review. There is a note at the top which will advise the user whether or not the response deadline has passed. If not, the user can click on the blue Click here link to make changes to the draft response and submit if ready.

(d) Return does not save the response and takes the user back to the Notice Details tab for the opportunity.

3. Proposal Evaluation Process.

3.1. A Source Selection Evaluation Board (SSEB) comprised of representatives of the Corps of Engineers, User/Customer, and other required personnel, will evaluate the proposals. Offerors are advised that the technical evaluation and rating of proposals will be conducted in strict confidence in that technical/quality proposals are reviewed and rated without knowledge of the price offered. The number and identities of offerors are not revealed to anyone who is not involved in the evaluation and award process or to other offerors. Proposals will be evaluated based on the factors described herein, and the basis of award is Lowest Price Technically Acceptable.

3.2. The evaluation process essentially consists of three parts: proposal compliance review and responsibility determination, technical/quality evaluation, and price evaluation.

3.2.1. Proposal Compliance Review/Responsibility Determination: This is an initial review to ensure that all required forms and certifications are complete and that both a technical and price proposal were received.

Additionally, firms will be verified for business size status as applicable to the solicitation.

3.2.2. Technical/Quality Evaluation: The SSEB will evaluate and rate those proposals passing the first review, above. Proposals will be evaluated against the RFP requirements. Factors will be rated using an

“Acceptable/Unacceptable” basis.

3.3.3. Price Evaluation: The SSEB will evaluate price proposals independent of the technical/quality evaluation.

The SSEB will not have access to price information until completion of the technical/quality evaluation.

4. Proposal Information and Related Evaluation Factors.

4.1. Proposals will be evaluated in accordance with the factors and subfactors below. Offerors are reminded to include their best technical and price terms in their initial offer and not to automatically assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer. The Government may make award of a conforming proposal without discussions, if deemed to be within the best interests of the Government.
