About this file

This is a presentation document from the US Army Corps of Engineers (USACE) Japan Engineer District briefing industry partners on innovative and alternative contract delivery methods.

The presentation introduces three alternative acquisition strategies: Progressive Design-Build (PDB) with Other Transaction Authority (OTA), Design-Build to Budget (DB2B), and related methods. For PDB-OTA, the approach integrates design and construction under a single contract with phased development, qualifications-based selection, collaborative risk management, and transparent open-book pricing. The process includes selection based on contractor expertise rather than lowest price, followed by Phase 1 (design and preconstruction services) with negotiated pricing, and Phase 2 (final design and construction) with locked-in guaranteed maximum pricing. OTA authority allows USACE to bypass Federal Acquisition Regulation (FAR) and DFARS requirements, enabling faster procurement and commercial business arrangements while broadening the industrial base to include non-traditional defense contractors and startups. For DB2B, the government discloses a fixed budget upfront in the Request for Proposal, and contractors propose designs and scopes to maximize value within that fixed ceiling rather than proposing variable prices. The DB2B process uses a two-phase evaluation: Phase 1 down-selects the most qualified contractors (typically three) without requiring full design packages, and Phase 2 involves proprietary one-on-one meetings (up to three meetings over three months) to refine requirements and validate designs before final proposal submission. Unsuccessful Phase 2 offerors receive stipend payments ranging from 0.01-0.25 percent of project budget. The total procurement timeline spans approximately 250 days. USACE has successfully applied DB2B on projects including the Component Rebuild Shop at Letterkenny Army Depot, Pennsylvania and a Barracks Building at Fort Gordon, Georgia, and seeks to expand these strategies globally including in Japan.

Questions 質問

USACE intends to solicit feedback from participants after the event - we kindly ask for honest and constructive feedback to assist us in making determinations on the implementation of these acquisition processes.

(PDB) Question:

In PDB procurements, how does JED envision allocation of professional liability and design responsibility among the Government, Design-Builder, and A-E firms, particularly where the A-E serves as a subcontractor to the Design-Builder?

(IDAC, PDB, DB2B) Question:

Source Selection and Evaluation Weighting - For PDB, IDaC, DB2B, and OTA acquisitions, how does JED envision source selections being conducted, and what relative importance will be placed on the qualifications, experience, and past performance of the A-E partner versus those of the construction partner? If price is the primary driver, is there concern A-E quality may suffer?

Transparency and Predictability - As JED adopts these alternative delivery methods, how will industry be informed of the circumstances under which a project will be procured through Brooks Act A-E procedures versus PDB, IDaC, DB2B, OTA, or other alternative acquisition strategies?

Risk - Given the historical preference of Japanese construction contractors for Design-Bid-Build contracting, how does JED anticipate the construction industry will respond to increased use of PDB, IDaC, and DB2B acquisitions? Has JED assessed the potential impact on competition, pricing, and industry participation if contractors are required to assume additional risk?

Long-Term Acquisition Strategy - Of JED's future workload, what percentage do you envision being delivered through traditional Brooks Act A-E acquisitions versus Progressive Design-Build (PDB), Integrated Design and Construction (IDaC), Design-Build to Budget (DB2B), Other Transaction Authority (OTA), and other alternative delivery methods? Do you view these approaches as pilot programs or as part of a fundamental shift in how design and construction services will be acquired in Japan?

(IDAC, PDB, and DB2B) Question:

Among IDaC, PDB, and DB2B, which delivery methods does JED believe are most likely to be applied to future projects in Japan, and what project characteristics would drive those selections?

DESIGN BUILD TO BUDGET

OVERVIEW

What is DB2B?

A delivery method providing Target Budget Transparency: the Government discloses the exact design and construction budget to industry upfront in the Request for Proposal.

Performance Based acquisition strategy following a two-phase Design Build (DB) procedures: Contractors receive basic requirements and provided the flexibility to propose innovative solutions without the constraints of a fixed design progression.

What is the objective?

To maximize the achievable scope and deliver the most possible value within the fixed target budget.

Focus is on the basic performance requirements and the proposed betterments; not the lowest price.

Why is USACE pursuing this process?

To obtain not just the best-value, but the maximum value possible by optimizing what can be built within the available budget.

Design-Build to Budget is not a new concept for USACE. We have successfully applied this acquisition strategy in multiple solicitations across the United States, including recent projects:
