C. The following pages contains questions 16 – 91 that were submitted by potential offerors.
Answers provided to the respective questions do not amend the solicitation (specifications, drawings, etc.) unless revision to the specifications or drawings is specifically noted and incorporated into the solicitation. Please see attached list of questions.
D. The following revised responses provided for previous address questions 9 and 10.
RFI 9. The 2nd paragraph states "Compliance with JCG safety procedures may require diving operations to determine whether metal comply with the requirements of EM 385-1-1, Safety and Health Requirements Manual. All work dealing with suspect UXO shall be performed in accordance with EM 385-1-97, Explosives Safety and Health Requirements Manual. If the Contractor investigation identifies metal anomalies as UXO, the Contractor shall mark the anomaly, evacuate the area, and coordinate with the Contracting office for removal and disposal.
" EM 385-1-97, dated September 15, 2008, contains requirements for project management (Section 1.0), Safety Planning and Field Operations (Section 2.p - Use of DDSEB Technical Paper 16 for Determination of Exclusion zones, Munition and Explosives of Concern (MEC) encountered during USACE Activities (Chapter III), and Explosive Safety Site Plans (ESSP) requirements (Chapter IV). Essentially EM-1-97 requires UXO Tech I, II, IIIs, SUXOS, UXO Safety and UXO QC with requirements meeting US Standards. EM 385 -1-97's cover letter dated Sept 15, 2018, and signed by Col. Stephen Hill, section 4.d. allows for exceptions stating "Some of the technical requirements of this manual may not always be applicable to overseas activities due to conflicting circumstances, practices and laws or regulations of the locality or the unavailability of equipment. IN such instances, means other than the ones specified in this manual may be used to achieve the required protection. When this occurs, a hazard analysis must be made to document that the required protection will be achieved by the alternate means.
Question # 1 - Please confirm which sections of EM385-1-97 apply to this project. Question # 2 -please confirm which plans (such as an ESS), UXO submittals, etc. apply to this contract. The submittal register is silent and compliance with EM385-1-97 contains many UXO submittals.
Question # 3 - If the Government intends to enforce EM385-1-97, this will require US UXO companies to perform the work. Please confirm USACE will grant SOFA for the UXO firms. A recommend is to revise the Technical Spec to read in full compliance with JCG Safety procedures.
Revised Response:
1. Chapter III of EM 385-1-97 applies to work under this contract. Maintenance dredging in 1989 was performed to the nominal depth of 10.4, which reduces the likelihood of an encounter with munitions or explosives of concern (MEC) in the area to be dredged. Please see revised Specifications Section 01 35 26, Paragraph 1.17 Pre-Dredging Magnetic Survey and Anomaly Removal.
2. If the contractor proposes to use divers to identify metal anomalies, the contractor’s Accident Prevention Plan (APP) specified under section 01 35 26, paragraph 1.7 shall include documentation required under EM 385-1-1, paragraph 30.A.13 and/or hazard analysis to document that the required protection will be achieved by alternate means. See paragraph 4.f of the introduction to EM 385-1-1, titled Activities performed OCONUS.
3. The US Government will not extend SOFA status to the firms under subcontract to Japanese contractors. Additionally, please note contractors are required to comply with all work permit requirements in the country of Japan.
RFI 10. The 3rd paragraph states "DoD activities and DoD Contractors performing MEC-related activities are responsible for ensuring that the dive team meets the requirements in the DSEB TP 18 and Section 30 of EM 385-1-1, such that the diver and supervisor poses the required dive-related certifications for the tasks that he/she is to perform or supervise. This includes but is not limited to a minimum of one (1) diver who meets the requirements of a Unexploded Ordinance Technician I (UXO-TI) as well as the site supervisor for the dive team whom meets the requirements of a UXO-TIII." DSEB TP 18 references qualifications of US personnel meeting the UXO Technical requirements. Question # 1 - can this technical spec be revised to meet compliance with JCG safety procedure and the removal of the US based specifications. Question # 2 - if not, please confirm USACE will grant SOFA status to the UXO teams to perform this work. Pease see earlier questions in regards the exceptions stated in EM385-1-97 cover letter dated September 15, 2018.
1. The US Government will not waive requirements for diver and UXO Tech certification.
See Revised Specifications Section 01 35 26, Paragraph 1.17 Pre-Dredging Magnetic Survey and Anomaly Removal.
2. The US Government will not extend SOFA status to firms under subcontract to local sources.
E. The proposal due date has been changed from January 26, 2018 to February 8, 2018 at 2:00pm
