Bidder Inquiry Amendment Response

1 06/02/17

Will you accept the change in the expense of dredging and material disposal, especially in the case that the result of sounding shown on the drawing, which the government provided the contractor in advance, differs from the result of the sounding the contractor will conduct before dredging?

Bid as advertised. The government has provided information known about the site conditions through a hydrographic survey and shoaling rate information provided in the contract documents, but the Offeror must take steps reasonably necessary to satisfy itself as to the general and local conditions which can affect the work or its costs, consistent with 52.236-3 Site Investigation and Conditions Affecting the Work. Should the actual conditions at the site differ materially from those indicated in this contract, or differ materially from known physical conditions that are ordinarily encountered and generally recognized as inhering in the work of the character provided in the contract, the Contractor shall provide notice to the Contracting Officer and follow the process of 52.236-2, Differing Site Conditions; as well as 252.243-7002 Requests for Equitable Adjustment, and 52.243-4 Changes, and/or other applicable clauses in the contract.

2 06/02/17

We make the estimate of the materials disposal based on the date the government provided the contractor though. If the result of the material analysis, which the contractor conducts after awarded, differs significantly from the date above and it eventually causes the change of the material disposal area, will you accept the change in the expense of disposal of dredged materials and related to it?

Bid as advertised. The government has provided the dredge material analysis information. An Offeror must take steps reasonably necessary to satisfy itself as to the general and local conditions which can affect the work or its costs, consistent with 52.236-3 Site Investigation and Conditions Affecting the Work.

3 06/02/17 Will you give us the drawings and cross sections of the existing wharf in the dredged area so that we can take advantage of it as the references in order not to do any damage to it?

Cross-sections of the existing wharf will be provided to the successful offeror after contract award if required. Bid as advertised.

4 06/02/17

Will you accept the expense for the suspension of work caused by the Unexploded Ordinance (UXO) clearing as the objection of change? If so, will it be still the acceptable objection of change even when the contractor completes the construction in time (within 380 days)?

Similarly, will you accept the expense for the suspension of work caused by the government's vessels enter or exit as the objection of change?

In accordance with Specification Section 01 57 19 Para 3.10 Military Munitions, immediately stop work in the area and notify the Contracting Officer if a UXO is discovered. The contractor shall stop work in the immediate vicinity and maintain a minimum of 300 meters distance from the item. The contractor shall maintain flexibility in redirecting personnel and work effort during the UXO destruction/removal process.

Your attention is also drawn to the clause 52.242-14, Suspension of Work, in particular sub-paragraph (b).
