6. BONDING THRESHOLDS (MAR 2015).

a. Under the Federal Acquisition Streamlining Act of 1994, Public Law 103-355 (FASA), the Miller Act (40 U.S.C. 270a-270f) no longer applies to contracts that do not exceed the amount of $150,000. Therefore, the Government will not require the successful bidder to furnish a performance bond if it appears that award of a contract to the bidder will be in an amount of ¥17,250,000 or less.

b. The government requires a bid guarantee to accompany a bid when a performance bond will be required under the resulting contract. Failure to submit a bid guarantee in such case may render the bid non-responsive to the solicitation.

c. A bid under this solicitation that does not exceed ¥17,250,000 shall not require a bid guarantee to be submitted with the bid. Absence of a bid guarantee in such case will not, in and of itself, render the bid non-responsive to the solicitation.

Specifically, a prospective offeror must be duly authorized to operate and conduct business in Japan and must fully comply with all laws, decrees, labor standards, and regulations of Japan during the performance of the resulting contracts. In addition, prior to award of the contracts, offerors must be registered with the Government of Japan to do construction work in Japan and possess necessary construction licenses and permits to perform work required under this solicitation.

The U.S. Government will not offer “United States Official Contractor” status under Article XIV of the US-Japan Status of Forces Agreement (SOFA) to U.S. contractors normally resident in the United States; nor will the U.S. Government certify employees of such contractors as “Members of the Civilian Component” under Article I(b) of the SOFA.

17. ACCEPTABLE SURETIES (MAR 2013). Notwithstanding the statement contained in paragraph (d) of the clause, FAR 52.228-15, "Performance and Payment Bonds - Construction (OCT 2010)", concerning the acceptable corporate sureties appearing on the Treasury Department Circular 570, a corporate surety that has received official approval to execute bid bonds (Standard Form 24) and performance bonds (Standard Form 25) on United States Forces Japan construction projects from the Government of Japan will be considered an acceptable surety. Banks are not acceptable sureties; bid bonds and performance bonds executed by banks will be rejected.

18. FUNDING. Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available from which payment for contract purposes can be made.

19. METHOD OF PROCUREMENT. A Firm-Fixed Price construction contract will be awarded to the offeror who submits a proposal determined to be the lowest priced, technically acceptable proposal by the Government (see Section 00 22 16).

20. PRE-AWARD SURVEYS. The Government reserves the right to conduct a pre-award survey of any firm under consideration to confirm any part of the information furnished by the offeror, or to require other evidence of managerial, financial, technical, and other capabilities, the positive establishment of which is determined by the Government to be necessary for the successful performance of the contract.

21. PRE-PROPOSAL CONFERENCE.

a. Offerors are strongly urged and expected to attend and participate in the pre-proposal conference. The purpose of this conference is to promote uniform interpretation of the solicitation documents and work requirements and can include discussions of any problems with interpretations of the solicitation documents and work execution identified by potential offerors through written questions. In no event will a failure to attend the pre-proposal conference constitute grounds for a claim after award of the contract.

b. Offerors are encouraged to ask questions at the conference. Any questions made at the conference may or may not be addressed at the conference, but will be addressed in the minutes of the conference.

c. The Pre-Proposal Conference will be conducted concurrently with the Pre-Proposal Site Investigation. Please see Section 00 21 00, Provision No. 52.236-27 Alt I, Site Visit for information regarding the meeting.

SECTION 00 22 00

SUPPLEMENTARY INSTRUCTIONS

PROPOSAL SUBMISSION REQUIREMENTS

1.0 GENERAL INSTRUCTIONS

This acquisition is being conducted using a “One-Phase” design build procurement process.

1.1 Offerors shall strictly adhere to the requirements in this Section when preparing the proposal to be submitted in response to this Request for Proposal (RFP). All proposals shall be in English. The Government will not reimburse any Offeror any cost incurred in response to this RFP. Proposals that fail to comply with the proposal submittal requirements addressed in this section of the solicitation may be deemed unacceptable. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) solicitation at or before the exact time specified.

There will be no public opening of the proposals received as a result of this RFP. Failure to meet a requirement may result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will be posted to and made available for viewing in Federal Business Opportunities (http://www.fbo.gov). All amendments will be posted to and made available for viewing in FedBizOpps. It shall be the Offeror’s responsibility to check the website for any amendments.

1.2 The Government seeks award of one contract to the responsible offeror whose proposal represents the best value to the Government using the Lowest Priced Technically Acceptable (LPTA) process.

1.2.1 The Government will determine which offeror demonstrates the required competence for performing the requirement described herein and offers the lowest priced technically acceptable proposal to the Government. Offerors are advised the Government intends to make an award on the basis of initial proposals without conducting discussions with the offerors (other than communications conducted for the purpose of clarification). However, the Government reserves the right to conduct discussions if the Contracting Officer determines it necessary.

1.2.2 The Government reserves the right to discuss aspects of proposals with Offerors in the competitive range, if one is determined to be necessary, upon completion of the evaluation.

Offerors are advised that the Government may make award without discussions, clarifications, or any contact concerning the proposals received. Therefore, proposals should be submitted initially on the most favorable terms from a price and technical standpoint. Offerors shall not assume that they will be contacted or afforded an opportunity to clarify, discuss or revise their proposals.

1.3 Proposals received by the Government after the date and time set for receipt of proposals will be handled in accordance with the requirements of Provision “52.215-1, Instructions to Offerors – Competitive Acquisition”.

1.4 Offerors are required to provide information addressing all stated factors in a clear and understandable format. If an offeror does not have information relating to a specific factor, the offeror shall clearly state so in the proposal. Proposals that do not clearly address all factors may be considered unacceptable and may not receive further consideration.

2.0 PROPOSAL SUBMISSION INSTRUCTIONS

2.1 General Requirements: The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the Offeror intends to meet the requirements. Offerors shall assume that the Government has no prior knowledge of their facilities or experience, and will base its evaluation on the information presented in the offeror’s proposal.

2.1.1 Proposals shall be submitted in two (2) separate envelopes as follows:

2.1.1.1 Volume I shall contain the Technical Proposal and shall be clearly marked Volume I – Technical Proposal. In addition, follow instructions in Paragraph (c)(1) of Section 00 21 00, 52.215-1, INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION.

2.1.1.2 Volume II shall contain the Price Proposal and shall be clearly marked Volume II – Price Proposal. In addition, follow instructions in Paragraph (c)(1) of Section 00 21 00, 52.215-1, INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION.

2.1.2 Each volume shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other. It is recommended that the pages be standard 8-1/2” x 11” or A4 white bond paper using 12 characters per linear inch or equivalent as the minimum size standard for text.

2.1.3 The Government recognizes that offerors go to considerable expense to prepare proposals for this solicitation, so the Government prefers that proposals be practical. Elaborate format, special binders, special reproduction techniques, and the like are not necessary or desired. In short, the proposal shall completely and adequately address the requirements stated in solicitation. Proposal legibility, clarity, coherence, and contents are important.

2.1.4 Revised Proposal. Revised proposals will not be accepted unless specifically requested by the Contracting Officer. If the Contracting Officer decides to conduct discussions and requests revised proposals from the offerors; offerors shall ensure that all replacement pages are clearly marked “REVISED”, shall show the date of revision, shall be submitted in the appropriate number of copies (e.g., if two copies of the original page was required, then two copies of the revised page will also be required). All proposal revisions shall be submitted as page replacements with revised text readily identifiable, e.g. bold face print or underlining.
